Program Terms

Equinavia Affiliate Program Agreement

This Agreement begins upon our acceptance of your affiliate application and continues until terminated by either party. Either you or Equinavia may terminate this Agreement at any time, with or without cause or notice. As an affiliate, you are also bound by the terms of the affiliate network. Breach of these terms may result in immediate termination, transaction voids, and negative feedback on your affiliate profile.

We reserve the right to monitor your site and promotional activities at any time. If we notify you of required changes and you fail to comply, we may terminate your participation and void related transactions.

 

1. Commissions

Standard commission: 10% on all sales, tracked with a 30-day cookie.

Last-click attribution applies. Conversions occurring within 10 minutes of a click will not generate commission to prevent fraud.

Commission rates may vary for coupon affiliates, sub-affiliate networks, or shopping cart abandonment affiliates.

VIP commissions may apply for content affiliates and short-term loyalty placements.

Questions should be directed to the affiliate manager.

 

2. Independent Contractor Status

You are an independent contractor. Nothing in this Agreement creates an employment, agency, or partnership relationship. You are solely responsible for your taxes, benefits, and any legal obligations arising from your activities.

 

3. Trademark & Intellectual Property

Prohibited: PPC advertising on trademark terms, direct linking, and use of “trademark + coupon” terms.

Permitted with approval: Non-trademark and long-tail terms, if pre-approved by the affiliate manager.

Trademarks: Equinavia, Equinavia.com, Equinavia Equestrian, Equinavia Webshop, Finntack USA, B Vertigo, and variations/misspellings.

Affiliates may not register or use infringing domains or URLs.

Permitted use: Equinavia in subdomains/paths (e.g., yourwebsite.com/equinavia), provided the page contains only Equinavia offers and no competitor content.

Use only logos, banners, and images provided via the affiliate network.

Intellectual Property Usage:

Copyrighted images, videos, and promotional materials provided by Equinavia may only be used as instructed.

All leads belong to Equinavia.

Content you create to promote Equinavia (e.g., reviews, blogs, videos) remains your property, but Equinavia may use it for program-related marketing.

 

4. Promotions

Affiliates may only promote authorized deals/coupons provided through the affiliate channel.

Misleading promotions or unauthorized coupon use will result in voided transactions.

Expired promotions must be removed immediately.

Prohibited: spyware, adware, parasiteware, browser help objects, cookie stuffing, or unauthorized toolbars.

All sub-affiliate traffic must include referring URLs; otherwise, transactions may be voided.

Paid media placements require coordination with the affiliate manager.

 

5. Limitation of Liability & Indemnification

Limitation of Liability: Equinavia is not liable for indirect, incidental, or consequential damages related to this Agreement or your participation in the program.

Indemnification: You agree to indemnify and hold Equinavia harmless from any claims, damages, or expenses resulting from your actions, including false advertising, breach of contract, or violation of law.

 

6. FTC Rules & Data Privacy

Affiliates must comply with FTC Endorsement Guidelines.

On Twitter/X and Facebook, posts with affiliate links must include #ad before the link. Disclosure is not required for links to blog posts.

Affiliates must comply with applicable data protection laws, including GDPR (for EU affiliates) and other privacy regulations. While Awin supports compliance, affiliates are responsible for handling personal data appropriately.

 

7. Jurisdiction & Dispute Resolution

This Agreement is governed by the laws of the State of Connecticut, USA. Any disputes will be resolved in the courts of Connecticut.

 

8. Definitions

Affiliate: The independent contractor participating in the Equinavia Affiliate Program.
Brand/Equinavia: Equinavia, the program operator.
Affiliate Network: The third-party platform (e.g., Awin) administering tracking, payments, and compliance.
Commissions: Payments earned by affiliates as outlined in this Agreement.
Intellectual Property: Equinavia trademarks, copyrighted content, promotional assets, and related materials.
