Sales tax and government regulation
- If you are planning to do affiliate marketing with our company, you must be compliant will all local and state regulations in the area you are doing the marketing in. If your marketing will be taking place in a state that requires sales tax to be collected on affiliate marketing and they have a “nexus’ law we will need to collect a document, and a signature, from each of you for a “nexus” State declaring that they do not perform any solicitation activities in that State that would cause nexus.
- Affiliate marketers must disclose in a clear and conspicuous manner in an affiliate disclaimer on the site or area that they will be conduction the affiliate marking, that you are an affiliate to our company in order to comply fully with the FTC regulations.
- Affiliate marketers promoting on behalf of our company are required to have a clearly stated and easily found privacy policy on the site they are doing the marketing on, it must show what kind of data they are collecting from their customers and how they are using that data. Must be compliant will all local and international laws.
- Since we provide sales of electronic cigarettes and accessories NO marketing may be promoting goods or services to any individuals whose age is younger that what their local laws allow, and all affiliate marketers must comply with the FTC’s Children's Online Privacy Protection Act (COPPA)
- All affiliate marketing done on behalf of our company must engage in ethical marketing and must be honest in your advertising, do not make claims that can’t be verified as true, it is your responsibility to:
o Use only images and content to which you have the rights to.
o Not siphon traffic from other affiliates.
o Adhere to keyword bidding rules.
o Use a merchant’s brand in compliance with your affiliate agreement.
- Affiliate marketers marketing on behalf of our company are not allowed to spam and must comply with the CAN-SPAM act in your marketing campaigns, permissions are required in any way where the law requires the customers permission prior to sending any marketing campaigns too.
- Violating these rules or going against the terms of your contract with our company could result in losing your affiliate income, being targeted with a lawsuit or having to pay hefty fines.
