Piscifun Affiliate Program Agreement
This document outlines the terms and conditions ("Agreement") for your participation in the Piscifun Affiliate Program ("Program"). By registering, you agree to abide by these terms, forming a binding contract between you and Piscifun.
1. Affiliate Requirements
1.1 Admittance: Registration grants access to the Program. You are responsible for your own expenses (e.g., travel, marketing).
1.2 Use of Likeness: By participating, you allow Piscifun to use your image or likeness in any media globally, in perpetuity, without compensation.
1.3 Program Changes: Piscifun may change any aspect of the Program (e.g., content, coupons, themes) at any time.
1.4 Age Requirement: You must be at least 21 years old to participate.
1.5 Affiliate Status: You must disclose you are an affiliate partner, not an employee of Piscifun.
2. Prohibited Conduct
2.1 Complimentary Code Misuse: Complimentary codes must not be sold, traded, or shared. Violations may result in removal, forfeiture of commissions, or legal action.
2.2 Disruptive Conduct: Piscifun reserves the right to remove any participant whose conduct disrupts the Program.
2.3 Trademark Misuse: Unauthorized use of Piscifun's brand or likeness is prohibited.
2.4 Unethical Marketing: Participants using unethical or non-compliant marketing practices may be removed.
2.5 Future Exclusion: Piscifun reserves the right to exclude any individual from future programs.
3. Privacy Policy
3.1 Information Protection: Piscifun protects affiliate information and does not sell or share it with third parties.
4. Intellectual Property
4.1 Ownership: All intellectual property related to the Program belongs to Piscifun. Affiliates must not use or reproduce any trademarks or materials without written permission.
4.2 No Rights Granted: This Agreement does not grant any rights or licenses to Piscifun's intellectual property.
5. Warranties and Liability
5.1 Disclaimer: The Program and related materials are provided "as is" with no warranties.
5.2 Limitation of Liability: Piscifun is not liable for any damages related to your participation.
5.3 Maximum Liability: Piscifun's liability is limited to the amount you have paid (if any) to participate.
6. Coupon Compliance
6.1 Affiliates may only promote coupon codes assigned to them.
7. Commission & Payment Terms
7.1 Order Tracking: Commissions are only paid on tracked sales.
7.2 Returns & Fraud: No commissions for returned items, fraud, or chargebacks.
7.3 Split Commission: If multiple programs track an order, commission is split evenly.
8. Paid Search Terms
8.1 Trademark Usage: Do not bid on or use Piscifun trademarked terms in paid search ads.
8.2 Redirects: Do not redirect to Piscifun's site. Use your own domain.
8.3 Non-Compliance: Violations may result in commission reversal.
9. FTC Guidelines
9.1 Disclosure: Affiliates must disclose paid promotions clearly before affiliate links.
9.2 Social Media: Posts must include "AD:" at the beginning. End-of-post disclaimers are insufficient.
10. Miscellaneous
10.1 No Waiver: Failure to enforce any part of this Agreement is not a waiver of rights.
10.2 Force Majeure: Piscifun is not responsible for events beyond its control.
10.3 Severability: If any part of this Agreement is invalid, the rest remains in effect.
10.4 Entire Agreement: This is the complete agreement. No other statements or promises apply.
10.5 No Authority: This Agreement does not create a partnership or employment relationship.
By participating in the Piscifun Affiliate Program, you agree to all of the above terms.
