Affiliate Program Terms and Conditions

1. Introduction
Welcome to the Brooks Avenue Affiliate Program (“Program”). These Terms and Conditions govern your participation as an affiliate (“Publisher”) in promoting Brooks Avenue products and services via the AWIN platform.
By joining and participating in the Program, you agree to comply with these Terms and all applicable laws, regulations, and policies.
2. Eligibility
Participation is open to Publishers with websites, media publications, influencer platforms, or content channels that comply with our brand and legal standards. We reserve the right to approve or reject any applicant.
3. Promotional Guidelines
Affiliates must only use approved branding assets and follow the Brooks Avenue Affiliate Branding Guidelines (available on AWIN or upon request).
Unauthorized use of logos, trademarks, or brand names is strictly prohibited.
Affiliates may not bid on Brooks Avenue or brand-related keywords in paid search (PPC) campaigns unless explicitly approved in writing.
Use of the brand name in display URLs, ad titles, or descriptions in paid search is prohibited without prior approval.
Shopping ads (Google Shopping, CSS) linking directly to Brooks Avenue websites require written approval and tracking via a dedicated publisher account.
Email marketing, behavioral retargeting, and media broker activities require prior consent.
Affiliates must not place promotional content on inappropriate or non-brand-safe websites or platforms.
4. Commission and Payment
Commissions are calculated on the net transaction value, excluding VAT/sales tax, delivery charges, credit card fees, gift wrapping, or other service fees.
Commissions are not paid on sales where orders are canceled, items returned, customers fail credit checks, orders are duplicates, or program terms are breached.
Certain product categories may be excluded from commissions; details are available in the Program documentation.
Commissions will be paid according to AWIN’s payment schedule and thresholds.
5. Deduplication and Attribution
To maintain fair attribution, commissions will be deduplicated against sales generated via:
PPC Brand campaigns
PPC Generic campaigns (optional)
Email Advertising (optional)
Display Advertising (optional)
Direct Partnerships
Price Comparison platforms
In-house Publisher programs
Other affiliate networks
Only one channel will be credited per sale.
6. Restricted Publisher Types
Allowed promotional types: Content publishers, community sites, media brokers (with approval), influencer platforms.
Restricted or disallowed types: Cashback, coupon, loyalty, generic paid search, and unapproved email or retargeting campaigns.
We reserve the right to restrict or remove any publisher not aligning with our brand standards or promotional policies.
7. Compliance and Monitoring
Publishers must comply with all applicable laws, including GDPR, CAN-SPAM, and advertising standards.
We reserve the right to monitor promotional activity and audit affiliate traffic sources.
Non-compliant publishers risk suspension or termination from the Program and withholding of commissions.
8. Termination
Either party may terminate participation at any time with written notice.
Upon termination, all outstanding valid commissions will be paid according to schedule.
Any breach of these Terms may result in immediate removal and forfeiture of commissions.
9. Liability and Indemnity
Affiliates agree to indemnify and hold harmless [Brand Name] and its affiliates from claims, damages, or expenses arising from breach of these Terms or unlawful promotion.

11. Amendments
Brooks Avenue reserves the right to update or modify these Terms at any time. Affiliates will be notified via AWIN messaging or email.
