Program Terms

TideWe Affiliate Agreement

These are the terms (the “Agreement”) governing your participation in the TideWe Affiliate Program (“this program”). By registering, you agree to these terms, which form a binding legal contract between TideWe and the registered affiliate (“you”).

If you are registering on behalf of another individual, you are responsible for ensuring that the person is aware of and accepts these terms. By completing the registration, you warrant that you have made the participant aware of these terms and that they have accepted them.

1. Affiliate Requirements

1.1 Admittance
Your registration entitles you to participate in this program. All other costs (including, but not limited to, travel and marketing expenses) are your responsibility. TideWe is not liable for such costs.

1.2 Use of Likeness
By participating, you grant TideWe the right to record, photograph, or capture your likeness in any media now or hereafter developed. TideWe may use, broadcast, or distribute such media globally, in perpetuity, without further approval or compensation. This includes the right to edit or combine such media with other content.

1.3 Program Content
TideWe reserves the right to change any and all aspects of the program at its sole discretion, including but not limited to the name, themes, content, marketing, coupons, and structure.

1.4 Age Requirement
Participants must be at least 21 years of age.

1.5 Affiliate Role
You must always clearly state that you are a TideWe affiliate partner, not an employee.

2. Prohibited Conduct

2.1 Complimentary Product Use
You may not sell, trade, transfer, or share complimentary codes. Violation may result in cancellation, forfeiture of commissions, and future bans.

2.2 Disruptive Behavior
TideWe reserves the right to remove you from the program if your conduct is deemed disruptive or detrimental.

2.3 Misuse of Trademark or Likeness
Improper use of TideWe’s brand, trademark, or likeness may be considered theft, fraud, or trespassing, and may be reported to authorities.

2.4 Unethical Marketing
TideWe may deny or revoke participation to those engaged in unethical or non-compliant marketing.

2.5 Future Exclusion
TideWe may bar future participation based on violations of any part of this section.

3. Privacy Policy

3.1 Affiliate Protection
TideWe will not rent, sell, or share your personal information with third parties. Your privacy is respected and protected.

4. Intellectual Property

4.1 Usage Rights
All intellectual property rights related to the program, content, and materials are owned by TideWe. You may not reproduce or use any TideWe trademarks or content without written permission.

4.2 No Transfer of Rights
This Agreement does not grant you any rights or licenses to TideWe’s trademarks or intellectual property.

5. Disclaimers & Limitations

5.1 Warranties
This program is provided “as-is.” TideWe disclaims all implied warranties, including but not limited to merchantability, accuracy, or fitness for a particular purpose.

5.2 Liability for Damages
TideWe is not liable for any indirect, special, incidental, or consequential damages arising from participation.

5.3 Liability Cap
TideWe’s maximum liability shall not exceed the amount paid to you under this agreement.

6. Coupon Compliance

If assigned a coupon code, you may promote it according to the terms provided. Affiliates without an assigned code may not promote coupons.

7. Commission Fee Accrual & Payments

If an order appears in two affiliate systems, the commission will be split equally (e.g., $100 → $50 each).

No commission will be paid on returned products or non-qualified orders.

Adjustments may be made for fraud, chargebacks, bad debt, or order cancellations.

Commissions are only valid if tracked from your referral link through to purchase.

8. Paid Search Terms

Permitted: Generic keyword use for SEO and advertising.

Prohibited (unless approved):

Bidding on trademarked terms (e.g., “TideWe,” “TideWe.com”).

Using our trademark in your ad’s display URL.

Creating ads that appear as official TideWe sites.

Using redirects to TideWe.com in paid ads.

Violations may result in reversed commissions. Add TideWe-related keywords as negative keywords to prevent accidental violations.

Trademarked terms include:
TideWe, TideWe.com, TideWe supplies, and any misspellings or variations.

9. FTC Endorsement Guidelines

Affiliates must disclose compensation before any tracking link or banner, clearly stating that they are compensated.

Footer disclaimers are not sufficient.

Social posts must begin with “AD:” if promoting TideWe offers.

Non-compliance may result in removal from the program and loss of commissions.

10. Miscellaneous

TideWe’s failure to enforce any right does not waive future rights.

TideWe is not liable for delays or failures due to forces beyond its control.

Any invalid provision will be limited or removed to preserve the rest of the agreement.

This agreement is not transferable without TideWe’s written permission.

The prevailing party in a legal dispute may recover legal fees.

This is the complete agreement, overriding all previous agreements or understandings.

This agreement does not create an employer-employee, agency, or joint venture relationship.
