Program Terms

TideWe Affiliate Agreement

These terms (“the Agreement”) govern your participation in the TideWe Affiliate Program (“the program”). By registering, you acknowledge and agree to be bound by this Agreement, forming a legal contract between TideWe and you, the registered affiliate (“you”).

If you are registering on behalf of another individual, you are responsible for ensuring they understand and accept these terms. By completing the registration, you confirm that you have made them aware of this Agreement and that they have accepted it.

1. Affiliate Requirements

1.1 Admittance
Your registration grants you participation in this program. All additional costs (including travel and marketing expenses) are your responsibility. TideWe is not liable for these costs.

1.2 Use of Likeness
By participating, you grant TideWe the right to record, photograph, or capture your likeness in any media, now or later developed. TideWe may use and distribute such media worldwide, in perpetuity, without compensation, including the right to edit or combine it with other material.

1.3 Program Content
TideWe may modify any aspects of the program at its sole discretion, including name, themes, content, marketing, coupons, and structure.

1.4 Age Requirement
Participants must be at least 21 years of age.

1.5 Affiliate Role
You must clearly state that you are a TideWe affiliate partner, not an employee of TideWe.

2. Prohibited Conduct

2.1 Complimentary Product Use
Complimentary codes may not be sold, traded, transferred, or shared. Violations may result in commission forfeiture, cancellation from the program, and future bans.

2.2 Disruptive Behavior
TideWe may remove you from the program if your behavior is deemed disruptive or harmful.

2.3 Misuse of Trademark or Likeness
Improper use of TideWe’s brand, trademark, or likeness may constitute theft, fraud, or trespassing and may be reported to authorities.

2.4 Unethical Marketing
TideWe may deny or revoke participation if you engage in unethical or non-compliant marketing practices.

2.5 Future Exclusion
Any violation of this section may result in future disqualification from the program.

3. Privacy Policy

3.1 Affiliate Protection
TideWe will not rent, sell, or share your personal information with third parties. Your privacy is respected and protected.

4. Intellectual Property

4.1 Usage Rights
All intellectual property related to the program is owned by TideWe. You may not reproduce or use TideWe trademarks or content without written permission.

4.2 No Transfer of Rights
This Agreement does not grant you rights or licenses to TideWe’s trademarks or intellectual property.

5. Disclaimers & Limitations

5.1 Warranties
The program is provided “as-is.” TideWe disclaims all implied warranties, including merchantability, accuracy, and fitness for a particular purpose.

5.2 Liability for Damages
TideWe is not liable for indirect, special, incidental, or consequential damages resulting from participation.

5.3 Liability Cap
TideWe’s maximum liability is limited to the total amount paid to you under this Agreement.

6. Coupon Compliance

If a coupon code is assigned to you, you may promote it according to the stated terms.
Affiliates without assigned codes may not promote coupons.

7. Commission Fee Accrual & Payments

If an order is registered under two affiliate systems, the commission will be split equally.
No commission will be paid on returns or non-qualified orders.

Adjustments may be made for fraud, chargebacks, cancellations, or bad debt.
Commissions are valid only when tracked from your referral link through purchase completion.

8. Paid Search Terms

Permitted:
Generic keyword use for SEO and advertising.

Prohibited (unless explicitly approved):

Bidding on trademarked terms (e.g., “TideWe,” “TideWe.com”).

Using TideWe trademarks in ad display URLs.

Creating ads that appear to be official TideWe ads or websites.

Using redirects to TideWe.com in paid advertisements.

Violations may result in reversed commissions.
Add TideWe-related keywords as negative keywords to avoid accidental bidding.

Trademarked terms include but are not limited to:
TideWe, TideWe.com, www.TideWe.com, TideWe boots, TideWe waders, TideWe hunting backpack, and any misspellings or variations.

9. FTC Endorsement Guidelines

Affiliates must clearly disclose compensation before any tracking link or banner.
Footer disclaimers are not sufficient.

Social content must begin with “AD:” when promoting TideWe.

Non-compliance may result in removal and forfeiture of commissions.

10. Miscellaneous

Failure by TideWe to enforce any provision does not waive future rights.

TideWe is not responsible for delays or failures caused by forces outside its control.

If any provision is found invalid, it will be limited or removed, and the remainder of the agreement will remain in effect.

This agreement may not be assigned or transferred without TideWe’s written consent.

The prevailing party in any legal dispute may recover legal fees.

This Agreement constitutes the entire agreement between the parties and supersedes prior agreements.
No employer-employee, agency, or joint venture relationship is created by this Agreement.
