ABSC Organics Affiliate Program Terms & Conditions
By participating in the ABSC Organics Affiliate Program through Awin, you agree to be bound by these Terms and Conditions, as well as all applicable Awin publisher policies and U.S. laws and regulations.
1. Program Overview
The ABSC Organics Affiliate Program permits approved publishers to earn commissions by promoting ABSC Organics products utilizing authorized affiliate links provided through the Awin platform. Commissions are awarded solely on valid, tracked, and approved purchases that adhere to these terms.
2. Eligibility and Approval
Participation is subject to approval by ABSC Organics and Awin. ABSC Organics reserves the right to:
- Accept or reject any affiliate application at its sole discretion.
- Suspend or remove any affiliate at any time for violations of these terms, Awin policies, or applicable law.
Affiliates bear responsibility for ensuring all promotional activities are lawful and compliant.
3. Commission Structure
The standard commission rate is 20 percent of net sales unless otherwise specified in writing. Commissions are calculated based on the order subtotal, excluding taxes, shipping, refunds, chargebacks, and discounts. All commissions are subject to Awin's tracking, validation, and approval processes. ABSC Organics may alter commission rates or incentives with notice through Awin.
4. Payment Terms
Payments are processed exclusively via Awin. Affiliates must maintain accurate and complete payment information. ABSC Organics disclaims liability for payment delays caused by Awin, financial institutions, or incomplete publisher details. Reversed, refunded, or fraudulent transactions are ineligible for commissions.
5. FTC Endorsement and Disclosure Compliance
Affiliates are required to comply with all relevant U.S. Federal Trade Commission regulations concerning endorsements and advertising, including but not limited to the FTC Guides on Endorsements and Testimonials. They must:
- Clearly and conspicuously disclose their affiliate relationships in all promotional content.
- Place disclosures near endorsements or links, ensuring they are not hidden or implied.
- Use plain language such as “I may earn a commission” or “This is an affiliate link.”
Disclosures should be visible across all platforms, including websites, blogs, social media, videos, emails, and live content. Failure to adequately disclose may lead to immediate termination and forfeiture of commissions.
6. CBD Regulatory Compliance
Affiliates acknowledge that ABSC Organics products contain hemp-derived CBD and are regulated by federal and state laws. They must not:
- Make claims regarding disease treatment, cure, or prevention.
- State or imply FDA approval unless explicitly stated by ABSC Organics.
- Claim that products diagnose, treat, mitigate, or cure any disease.
- Present products as substitutes for medical or veterinary care.
Permitted language includes non-definitive statements such as “Supports general wellness,” “Designed to help maintain balance,” or “May assist with everyday stress or comfort.” Affiliates must adhere to all applicable laws governing CBD advertising, marketing, and sales within the U.S. ABSC Organics reserves the right to request modifications or removal of content that poses regulatory risks.
7. Promotional Restrictions
Affiliates shall not:
- Provide medical or veterinary advice.
- Present themselves as healthcare or veterinary professionals.
- Use misleading, exaggerated, or unsubstantiated claims.
- Employ fear-based or emotionally manipulative messaging.
- Use before-and-after imagery or guarantees of results.
All promotional activities must align with ABSC Organics’ brand guidelines and compliance standards.
8. Prohibited Activities
Activities strictly forbidden include:
- Spam or unsolicited communications.
- Cookie stuffing, forced clicks, or deceptive tracking practices.
- Unauthorized discount codes or promotions.
- Trademark infringement or brand impersonation.
- Bidding on ABSC Organics-branded keywords without written permission.
- Using offensive, illegal, or inappropriate content related to ABSC Organics.
Violations may result in immediate termination and loss of commissions.
9. Intellectual Property
Affiliates are granted a limited, revocable, non-exclusive license to utilize approved ABSC Organics trademarks and marketing materials solely for promotional purposes. All rights to intellectual property remain with ABSC Organics. Unauthorized use or modification of brand assets is prohibited.
10. Termination and Clawback
ABSC Organics retains the right to suspend or terminate participation at its sole discretion, at any time. Upon termination:
- All licenses granted under these terms immediately cease.
- ABSC Organics may withhold or recover commissions related to non-compliant, misleading, or unlawful activities.
11. Limitation of Liability
ABSC Organics shall not be liable for:
- Indirect or consequential damages.
- Losses of revenue, data, or profits.
- Tracking errors or failures of third-party platforms.
Participation in the affiliate program is at the sole risk of the affiliate.
12. Modifications
ABSC Organics may revise these Terms and Conditions at any time. Changes will be communicated via the Awin platform. Continued participation signifies acceptance of the updated terms.
13. Governing Law
These Terms and Conditions are governed by applicable U.S. laws, without regard to conflict of law principles.
