1. Introduction
1.1 By joining the Medela UK affiliate program ("Program"), you agree to comply with these Terms and Conditions ("Agreement"). Medela UK reserves the right to update these Terms at any time. Updates will be available via the AWIN platform and upon request. We will make reasonable efforts to notify affiliates of significant changes.
1.2 To participate, affiliates ("Publishers") must apply through AWIN and receive approval from Medela UK. Approval is at Medela UK’s sole discretion, and we reserve the right to remove any Publisher at any time for non-compliance.
1.3 Publishers must disclose their affiliate relationship with Medela UK as per UK Advertising Standards Authority (ASA) guidelines. Misleading or deceptive advertising, including false claims about Medela UK products, is strictly prohibited.
2. Commission Rates and Terms
2.1 The Program operates on a percentage commission based on the gross transaction value, excluding delivery costs. The current commission structure is:
- Standard Programme Commission Rate: 5%
- Top Performing Partner Commission Rate: 8%
- AOV Commission: Transactions over £125 qualify for a 10% commission.
2.2 Higher commission rates may be granted at Medela UK’s discretion based on individual partner performance.
2.3 Commissions will not be paid if:
- The Publisher violates our Terms and Conditions.
- A transaction is refunded or returned within 30 days of purchase.
- A customer and associated transaction fails a credit check.
- If the order or transaction is duplicated.
- If an item/s is out of stock.
2.4 Commission validation follows a Net 60-day cycle, meaning commissions are reviewed and approved approximately 60 days after a qualifying transaction. Payments are made via AWIN according to its payment schedule.
3. Cookie Policy
3.1 The Program operates on a 30-day cookie period. Publishers must adhere to applicable advertising and data protection laws.
3.2 Fraudulent activity, including self-referrals or cookie stuffing, will result in removal from the programme.
4. Partner Exclusions
4.1 Medela UK maintains a family-friendly brand image. Affiliates will not be accepted if their platform contains adult content, including but not limited to pornography, graphic nudity, or fetish material.
5. Affiliate Partner Type - Specific Terms and Conditions
5.1 Sub-Network Partners
5.1.1 Brand Terms
Publishers must not bid on Medela-related brand terms or misspellings on search engines or other services, including but not limited to:
"Medela"
"Madela"
"Medela UK"
"Medela Breast Pump"
Publishers may not use "Medela" in ad headers or register domains containing the brand name or variations.
The brand name may be used within articles and as a hyperlink directing users to Medela-related content.
5.1.2 Negative Keywords
Publishers must ensure that Medela brand terms do not appear alongside inappropriate content.
Medela’s proprietary URL must be included as a negative keyword.
Publishers should routinely review search queries to filter inappropriate terms.
5.1.3 Outreach & Communication
Publishers must represent Medela UK responsibly and avoid spam-like promotional tactics.
Submitting Medela product feeds to Google Product Search is not permitted.
5.2 Voucher Code, Cashback & Discounting Partners
5.2.1 Cashback will be denied if used alongside a voucher code.
5.2.2 Commission will not be paid if traffic is driven outside the specified promotional period.
5.2.3 Affiliates promoting unauthorized discount codes will forfeit their commission.
5.2.4 Vouchers must include clear T&Cs and an expiration date.
5.2.5 Sites must not use click-to-reveal functionality where no valid discount code exists.
5.3 Content, Blogger, Influencer, and Editorial Partners
5.3.1 Publishers must operate an active digital platform, such as a website, blog, or social media account, relevant to Medela’s audience.
5.3.2 All promotions must comply with advertising and data protection laws.
5.3.3 Publishers must represent Medela UK in a manner consistent with its brand values.
5.3.4 Misleading, offensive, or inappropriate content is prohibited.
6. Brand and Creatives
6.1 Approved marketing materials, including logos and banners, are available in the AWIN "Creatives" section.
6.2 Custom creative materials may be provided upon request at Medela UK’s discretion.
6.3 Publishers may not alter Medela UK branding or use its assets to imply direct endorsement without prior written approval.
7. Compliance and Termination
7.1 Publishers must comply with all relevant laws, including GDPR, ASA guidelines, and AWIN policies.
7.2 Medela UK reserves the right to terminate participation without notice if a Publisher breaches these terms.
7.3 Upon termination, Publishers must immediately remove all affiliate links and promotional materials.
8. Liability and Indemnification
8.1 Medela UK is not liable for indirect damages, loss of revenue, or technical failures related to Program participation.
8.2 Publishers agree to indemnify and hold Medela UK harmless against any claims resulting from their participation in the Program.
9. Amendments
9.1 Medela UK may modify these Terms at any time. Changes will be communicated via AWIN.
9.2 Continued participation in the Program constitutes acceptance of the updated Terms.
