InstantHeadshots.ai Affiliate Program Terms and Conditions

Welcome to the InstantHeadshots.ai Affiliate Program (“Program”), administered through Awin. These Terms and Conditions (“Terms”) govern your participation as an affiliate (“Affiliate,” “you,” or “your”) promoting InstantHeadshots.ai (“InstantHeadshots,” “we,” “us,” or “our”). By accepting or promoting our program via Awin, you agree to comply with these Terms, all applicable laws, and the Awin Publisher Agreement and Policies.

1.1 All Affiliates must apply through the Awin platform.
1.2 Approval is based on content quality, audience relevance, traffic integrity, and brand alignment.
1.3 Approval does not guarantee ongoing participation; we may periodically review accounts for compliance.
1.4 We may approve, reject, or remove any Affiliate at our discretion, including for:

Non-compliance with these Terms or Awin policies

Low-quality, misleading, or fraudulent traffic

Misrepresentation of the brand or product

2.1 Compliance and Conduct

You must comply with all applicable laws and advertising guidelines (including FTC endorsement rules, CAN-SPAM, and data/privacy regulations), and all Awin network policies.
Clear and prominent FTC disclosure is required on all promotional materials (e.g., “This post contains affiliate links. I may earn a commission.”).

2.2 Prohibited Practices

Affiliates may not:

Engage in cookie stuffing, click manipulation, click injection, or use unauthorized adware, toolbars, or browser extensions.

Bid on branded search terms such as “Instant Headshots,” “InstantHeadshots.ai,” or close variations/misspellings, or use them in domains, subdomains, social handles, or URLs.

Use unapproved coupon/rebate/cashback/incentivized traffic models or promote unlisted/expired coupons.

Make misleading claims about results, image quality, delivery speed, guarantees, or outcomes beyond what is stated on InstantHeadshots.ai.

Promote on sites or channels containing hate speech, explicit content, deceptive content, or unsafe/abusive material.

2.3 AI-Generated & Synthetic Traffic

Affiliates may not generate or inflate traffic, clicks, sign-ups, or conversions through bots, automated scripts, traffic exchanges, fabricated personas, click farms, or synthetic “engagement” systems.
AI tools may assist with content creation only if the content is original, accurate, for human audiences, and not used to simulate engagement or manipulate attribution.
Detected artificial activity may result in immediate removal, commission reversals, and forfeiture of pending payments.

Tracking: All clicks, conversions, and commission events are tracked solely via Awin tracking links, pixels, and (where applicable) the Awin MasterTag.

Attribution: Standard last-click attribution within the cookie window shown in your Awin dashboard or offer terms.

Qualified Actions: Commissions are earned when a referred customer completes a valid purchase through the approved checkout process, as defined in the Awin program settings.

Reversals: Commissions may be reversed for refunds, chargebacks, cancellations, duplicate/fraudulent transactions, or policy violations.

Payment: Payouts are processed by Awin in accordance with its validation and payment schedule, once the minimum threshold is met.

4.1 All brand assets, logos, product imagery, and promotional materials remain the property of InstantHeadshots.ai.
4.2 Affiliates receive a limited, non-transferable, revocable license to use Awin-provided or pre-approved materials solely for this Program.
4.3 Affiliates may not edit, recolor, distort, or create derivative versions of brand logos or imagery without prior written approval.
4.4 Use of InstantHeadshots branding in social handles, domains, impersonation formats, or paid ads (brand bidding) is prohibited.
4.5 Custom placements or promotional campaigns require prior written approval.

You participate as an independent contractor. Nothing here creates a partnership, joint venture, employment, franchise, or agency relationship. You have no authority to bind InstantHeadshots.

All non-public information (including commission rates, performance data, communications, and materials shared via Awin or directly) is confidential and may not be disclosed or used outside this Program without our written consent.

Either party may terminate participation at any time through Awin.

We may suspend or terminate immediately for any violation of these Terms or Awin policies.

Upon termination, Affiliate must cease using InstantHeadshots assets and Awin tracking links, and all licenses granted herein automatically expire.

If terminated for cause, unpaid and pending commissions may be forfeited.

We may modify these Terms or Program details at any time. Notice will be provided through Awin or email. Continued participation constitutes acceptance of the modified Terms.

InstantHeadshots.ai will not be liable for indirect, incidental, consequential, punitive, or special damages, including lost revenue or business opportunities.

Our total liability shall not exceed the total commissions paid to you in the preceding six (6) months.

You agree to indemnify, defend, and hold harmless InstantHeadshots.ai and its officers, employees, and agents from claims, damages, losses, or expenses arising from your promotional activities or breach of these Terms.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Any disputes shall be brought in the state or federal courts located in Delaware.
