Sister Sister Jewelry Affiliate Program Agreement
Effective Date: August 26, 2024
1. Introduction This Affiliate Program Agreement ("Agreement") is made by and between Sister Sister Jewelry ("Company") and the individual or entity ("Affiliate") applying to participate in the Sister Sister Jewelry Affiliate Program ("Program"). By signing up for the Program, the Affiliate agrees to the terms and conditions outlined in this Agreement.
2. Enrollment in the Program To enroll, the Affiliate must submit an application through our affiliate platform. We will review the application and notify the Affiliate of acceptance or rejection. Participation in the Program is at the sole discretion of Sister Sister Jewelry.
3. Affiliate Responsibilities
Promotion: The Affiliate agrees to promote Sister Sister Jewelry’s products using links, banners, and promotional materials provided by the Company.
Compliance: The Affiliate agrees to comply with all applicable laws, regulations, and guidelines, including the Federal Trade Commission (FTC) disclosure requirements.
Accurate Representation: The Affiliate must represent Sister Sister Jewelry and its products accurately and refrain from making false claims.
4. Commissions
Commission Rate: The Affiliate will earn a commission of 10% on qualifying purchases made through their affiliate links.
Payment: Sister Sister Jewelry offers a 10% commission on all validated sales, with a minimum payout threshold of $20. Payouts are made in alignment with ShareASale’s terms.
Special Commission Rules: Certain products, promotions, or campaigns may have different commission rates or structures, which will be communicated to the Affiliate in advance.
5. Trademark Regulations
The Affiliate is not permitted to use Sister Sister Jewelry’s trademarks, logos, or brand name in any way that could mislead customers or damage the reputation of the Company. Any unauthorized use of these materials may result in termination from the Program.
6. Email Marketing Policy
The Affiliate must comply with all applicable email marketing laws, including CAN-SPAM regulations.
Email campaigns promoting Sister Sister Jewelry must receive prior approval from the Company.
Emails should include a clear opt-out mechanism for recipients.
7. Social Media Policy
Affiliates may promote Sister Sister Jewelry on social media platforms, but must clearly disclose their affiliate relationship (e.g., using hashtags like #ad or #affiliate). Posts must comply with the terms of service of the respective platforms and any applicable FTC guidelines.
8. Coupons and Deals Policy
Affiliates may only use coupons, promo codes, and deals that are explicitly provided by Sister Sister Jewelry for the Program. Any unauthorized use of coupons may result in the withholding of commissions or termination from the Program.
9. Pay-Per-Click (PPC) Bidding Rules
Affiliates are prohibited from bidding on any pay-per-click (PPC) advertising, including but not limited to Google Ads, using the Sister Sister Jewelry brand name, trademarks, or variations thereof. Violations of this policy may lead to termination from the Program.
10. Termination
Grounds for Termination:
Sister Sister Jewelry reserves the right to terminate the Affiliate's participation in the Program at any time for violations of this Agreement, unethical practices, or any action that may harm the reputation of the Company.
Notice: Either party may terminate this Agreement with [30 days] written notice.
11. FTC Disclosure Requirements
Affiliates must include clear and conspicuous disclosures on any websites, social media posts, or other communications that contain affiliate links, in accordance with FTC guidelines. The disclosure must inform consumers that the Affiliate may receive a commission for purchases made through the link.
12. Limitation of Liability
Sister Sister Jewelry will not be liable for any indirect, incidental, or consequential damages arising in connection with the Program, including but not limited to loss of revenue or data.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of laws principles.
14. Modification
Sister Sister Jewelry reserves the right to modify the terms of this Agreement at any time. Any changes will be communicated to the Affiliate, and continued participation in the Program constitutes acceptance of the revised terms.
15. Acceptance
By participating in the Sister Sister Jewelry Affiliate Program, the Affiliate acknowledges that they have read and agree to the terms and conditions outlined in this Agreement.
