Welcome to the Affiliate Marketing Program for Gigatech Gaming. This agreement outlines the terms and conditions for participation in the Program. By enrolling and participating in the Program, you agree to comply with the terms and conditions set forth in this agreement, as well as the ShareASale Terms of Use.
**Eligibility**
To participate in the Program, you must:
1. Be at least 18 years old.
2. Have a valid ShareASale account.
3. Own and operate a website, blog, or social media profile that complies with all applicable laws and regulations.
**Enrollment**
To enroll in the Program, you must complete and submit the online application form. We reserve the right to approve or reject any application at our sole discretion. Reasons for rejection may include, but are not limited to, websites that:
- Promote violence or discrimination.
- Contain sexually explicit material.
- Advocate illegal activities.
- Are unsuitable for any other reason at our sole discretion.
**Affiliate Responsibilities**
As an affiliate, you agree to:
1. Actively promote Gigatech Gaming through ethical and legal means.
2. Use only approved marketing materials provided by us.
3. Comply with all applicable laws, including but not limited to the Federal Trade Commission (FTC) guidelines on endorsements and testimonials.
4. Not engage in any fraudulent or deceptive practices, including cookie stuffing, false advertising, or misrepresenting the products or services offered by Gigatech Gaming.
**Prohibited Activities**
Affiliates are prohibited from:
1. Using any automated means, including but not limited to bots or scripts, to artificially inflate traffic or sales.
2. Spamming any platform to promote Gigatech Gaming.
3. Engaging in any activities that may harm the reputation or credibility of Gigatech Gaming.
**Commissions and Payments**
Affiliates will earn a commission on qualifying sales generated through their unique affiliate links. The commission structure is as follows:
- 5% Commission before any seasonal or performance increases.
Commissions will be paid on a consistent basis depending on the platform.
**Termination**
We reserve the right to terminate your participation in the Program at any time and for any reason, including but not limited to:
1. Violation of any terms or conditions of this agreement.
2. Engagement in any prohibited activities.
3. Failure to comply with applicable laws and regulations.
Upon termination, you will forfeit any pending commissions and must immediately cease using any promotional materials related to Gigatech Gaming.
**Modification**
We reserve the right to modify the terms and conditions of this agreement at any time. Any modifications will be effective immediately upon posting the updated agreement on our website. It is your responsibility to review the agreement regularly. Continued participation in the Program after any modifications constitutes your acceptance of the updated terms and conditions.
**Limitation of Liability**
We will not be liable for any indirect, incidental, special, or consequential damages arising in connection with this agreement or the Program, including loss of revenue or profits, even if we have been advised of the possibility of such damages.
**Governing Law**
This agreement shall be governed by and construed in accordance with the laws of the US, without regard to its conflict of laws principles.
