MO&Co. Affiliate Program Terms & Conditions
1. Program Participation & Approval
1.1. By submitting your application through the AWIN platform, you agree to comply with these Terms & Conditions and the AWIN Network Terms & Conditions.
1.2. MO&Co. reserves the right, at its sole discretion, to approve or reject any application without providing a reason. Approval to participate does not constitute a guarantee of any ongoing partnership.
1.3. MO&Co. may suspend or terminate your participation in the Program at any time for any reason, including but not limited to a violation of these terms, without prior notice.
2. Promotion Guidelines & Channel Suitability
2.1. Your promotional channels (website, social media, email lists, etc.) must not contain or link to content that is: pornographic, violent, discriminatory, promotes illegal activities, or infringes upon any third-party intellectual property rights.
2.2. Your promotion must not damage the reputation of the MO&Co. brand or mimic our official website in a way that causes confusion.
2.3. Strict Prohibitions on Brand Terms:
* Domain/Subdomain Use: You are prohibited from registering, purchasing, or using domains or subdomains that include "MO&Co.", "MOCO", or any misspellings or variations thereof (e.g., moco.yoursite.com).
* Paid Search & Comparison Shopping (PPC): Strictly prohibit bidding on our brand terms, their misspellings, variations, or combinations (e.g., "MO&Co. discount", "MOCO coupon") in any paid search advertising (e.g., Google Ads, Microsoft Advertising). This prohibition explicitly extends to Comparison Shopping Services (CSS) like Google Shopping.
* Social Media Handles: You may not register account names/handles on social media platforms that incorporate our brand names or variations.
3. Compliance & Link Usage
3.1. You must use only the official tracking links and marketing creatives provided through your AWIN account.
3.2. Any form of fraudulent activity to generate commissions (e.g., cookie stuffing, false pop-ups, malware) is strictly prohibited.
3.3. Disclosure: You must clearly disclose your affiliate relationship in your content where required by law (e.g., using hashtags like #ad or #affiliate in social media posts).
3.4. Coupon Policy: You may only promote official discount codes provided to you via the AWIN platform or your account manager. Promoting unauthorized codes may result in commission withholding.
4. Commissions, Orders & Payments
4.1. Commissions are earned on "paid and not returned" qualified sales generated through your valid affiliate link. The current base commission rate is 8%.
4.2. The tracking cookie duration is 30 days. If a user applies a MO&Co. internal referral code within 30 minutes of clicking your affiliate link, the sale will be attributed to the internal referral program.
4.3. Sale Validation & Returns: All sales are subject to a validation period. Commissions for sales that result in a return, refund, cancellation, or are identified as fraudulent will be reversed.
4.4. Last-Click Attribution & Deduplication: The AWIN platform employs a last-click attribution model. Sales are deduplicated against our other marketing channels (e.g., email marketing) to ensure correct attribution.
4.5. Payments: Commission payments are processed through the AWIN platform in accordance with AWIN's payment terms, thresholds, and schedules.
5. Intellectual Property & Data Privacy
5.1. MO&Co. retains all intellectual property rights in its trademarks, logos, and marketing materials provided to you. You are granted a limited, non-exclusive license to use these materials solely for the purpose of promoting MO&Co. within this Program and must not modify them without prior written consent.
5.2. You agree to comply with all applicable data privacy and protection laws (e.g., GDPR, CCPA). You must not collect, store, or misuse any personal customer data obtained through your participation in this Program.
6. Limitation of Liability & Modifications
6.1. To the fullest extent permitted by law, MO&Co. shall not be liable for any indirect, incidental, or consequential damages arising from your participation in the Program.
6.2. MO&Co. reserves the right to modify these Terms & Conditions at any time. Notice of changes will be provided via the AWIN platform or email. Your continued participation in the Program constitutes acceptance of the revised terms.
