This Affiliate Marketing Program Agreement (the “Agreement”) is made by and between The Legacy Companies, LLC (“Omega Juicers”) and you as an Affiliate (“Affiliate”) utilizing the AWIN affiliate marketing program (the “Service”). This Agreement is a legally binding contract between Omega Juicers and Affiliate. Please read this Agreement carefully before registering and/or using the Service as an Affiliate.
By signing up, clicking “I accept” or participating in the Omega Juicers affiliate program, you indicate your acceptance and agree to abide by the terms and conditions contained in this Agreement. Failure to abide by the terms and conditions of this Agreement could result in the suspension of your participation in the Service and a complete forfeit of commissions.
ENROLLMENT
After receiving your application, we will review your website and notify you within a reasonable time of your acceptance or rejection into our Program. We reserve the right to reject any application; however, we encourage you to contact us if you feel we have made an incorrect decision. Please include all websites that you use in your profile as that will help us make a better decision.
ACTIVITIES
- Permitted Activities
You may place our banners anywhere on your site as you see fit, or within non-spam emails.
If you are creating product links, you must take them from the product feed. Links taken from other sources may result in commissions being declined as they are identified as coming from a different channel. You CANNOT take content directly from Omega Juicers, which is not present on the product feed or on the Offer section.
You may place banners or links within your newsletters, in content of your website, or within other web related content.
Any page containing our links, banners, or codes must be written in English.
You cannot link directly to the Omega Juicers’ sites outside of the Affiliate Window platform.
Affiliates are NOT ALLOWED to carry out any PPC search activity sending traffic to omegajuicers.com directly. An Affiliate found to be running PPC activity will be terminated from the Service immediately and any related commissions will be deemed void ab initio and forfeited.
Affiliates are NOT ALLOWED to send traffic through automatic redirects on any website page.
2. Affiliates generating traffic to their own sites must also abide by the following rules:
a. Using the Omega Juicers brand term in the sub folder of the display URL (e.g. www.affiliate.com/omegajuicers) – NOT ALLOWED
b. Using the Omega Juicers brand term in the sub domain of the display URL (e.g. www.omegajuicers.affiliate.com) – NOT ALLOWED
c. Using the Omega Juicers brand in the ad title – NOT ALLOWED
d. Bid on the brand term “Omega Juicers” – NOT ALLOWED
e. Publishers are NOT ALLOWED to do any form of advertising as the Omega Juicers brand, or suggesting or implying that Affiliate is Omega Juicers.
f. Show adverts on competitors’ brands – NOT ALLOWED
3. Discount code / voucher code websites
a. Publishers must not display made up / invented discount codes on their site(s) or display discount codes that were intended for use in other channels or for other online publishers. If you are found doing this, your participation in the Omega Juicers program will be terminated immediately and commissions will be deemed void ab initio and forefeited.
b. Under no circumstances are publishers allowed to surreptitiously use i-frames to set cookies onto a user’s computer.
c. Discount code and deals publishers are accepted in the program as long as do not promote discount codes.
4. Email Marketing
Affiliates must get prior approval from Omega Juicers if they wish to send out any emails about the program. To obtain prior approval of an email, contact affiliates@thelegacycompanies.com.
5. Additional Prohibitions
a. Placing banners on adult, hate, extremist and similar or related sites is NOT ALLOWED. Whether a site meets the criteria under this section shall be within the sole and exclusive discretion of the Omega Juicers.
b. Any placement of creative in a “Desktop” advertising scheme is NOT ALLOWED. This includes any and all 3rd party advertising platforms that use a desktop application to display ads in any form.
c. Any display of a merchant window that isn't the result of a direct click by the end-user is NOT ALLOWED.
CREATIVE
Affiliates may not alter any of the creative made available through the Affiliate Window.com interface. Affiliates are also requested not to hardcode banners into their sites, so updates made to those available through Affiliate Window.com may take immediate effect. If your site requires that banners are hardcoded, please contact the account management team to obtain permission before putting this in place. This will allow us to contact you whenever updates are necessary.
CONTACT BY OMEGA JUICERS
You expressly agree that Omega Juicers and its affiliates have right to send e-mail and text messages to you for the purposes of informing you of applicable changes or additions to the Service or related products and services.
CHANGES TO THE SERVICE
We reserve the right to change, modify, add or remove portions of this Agreement at any time and may add to, change, suspend or discontinue any aspect of the Service at any time. In the event of any material change, we’ll notify you via e-mail, newsletter or at least 30 days prior to any such changes taking effect, at which time you may either agree to such changes or withdraw from the Service.
COOKIES
Omega Juicers operates a 30 day-cookie policy.
PRIVACY POLICY
Omega Juicers will respect the privacy of its users and will not disclose personal information to third parties without the express permission of Affiliate. If you have any questions please contact affiliates@thelegacycompanies.com.
AFFILIATE PAYMENT
Omega Juicers is able to track all transactions/purchases generated from your site through the Awin platform. The affiliate commission will be pre-approved after the order has been placed and confirmed by Omega Juicers and its suppliers. Please note that some products are subject to a confirmation delay as they will require supplier approval. The affiliate commission will be paid only after completion of the purchase of the product. The affiliate commission will not be paid if there has been a refund, charge back or other reversal of payment. If a refunds, charge back or reversal is made after payment of the affiliate commission, it will be deducted from future commissions.
FRAUD
Fraud is a serious offense and will be treated as such. Fraud is defined as any action that intentionally attempts to create sales, leads, or click-throughs using robots, forced clicks, frames, iframes, scripts, or manually “refreshing” of pages, for the sole purpose of creating commissions. ANY ATTEMPTED FRAUD OR FRAUD WILL RESULT IN MEMBERSHIP TERMINATION AND FOREFEITURE OF ALL COMMISSIONS. ANY COMMISSIONS CREATED THROUGH FRAUD ARE DEEMED VOID AB INITIO. In the event of any activity deemed suspicious by Omega Juicers, it may delay the payment of affiliate commissions to verify the relevant transactions. Omega Juicers reserves the right to recalculate, void or disqualify any referrals in the event of fraudulent, deceptive or other illegal activity, or that otherwise violate the terms of this Agreement.
DISCLAIMER
The information contained on the Service is for general information purposes only.
The Company assumes no responsibility for errors or omissions in the contents of the Service.
In no event shall the Company be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice.
