KORARU Affiliate Program: Terms & Conditions

Welcome to the KORARU Affiliate Program on the Awin network. This document outlines the terms and conditions of our partnership. Please read it carefully to ensure you understand your responsibilities.

By submitting your application to our program, you confirm that you have read, understood, and agree to be legally bound by all the terms outlined in this agreement. We have written this agreement in plain language to ensure clarity. As an affiliate, you are responsible for ensuring your employees, agents, and contractors comply with these terms.

Definitions
  • "We," "us," or "our" refers to the KORARU brand and our website, koraru.co.
  • "You" or "your" refers to you, the affiliate partner.
  • "Our website" refers to the KORARU website located at https://www.koraru.co/.
  • "Your website" refers to any websites or platforms you use to link to our website.
  • "Program" refers to the KORARU Affiliate Program hosted on the Awin platform.

 

 

Affiliate Obligations

1. Enrollment in the Program

To join, please complete and submit the application through the Awin platform. We will review your application and notify you of our decision. While many applications are approved quickly, we may re-evaluate your application at any time.

We reserve the right to reject any application. However, if you believe our decision was incorrect, we encourage you to contact us. Providing a complete and accurate profile, including all websites you plan to use for promotion, helps us make a fair assessment.

2. Website & Content Restrictions

As a partner in our program, your website(s) and promotional content must not:

  • Infringe on our or any third party's intellectual property, privacy, or other rights.
  • Violate any applicable laws, rules, or regulations.
  • Contain any material that is threatening, defamatory, obscene, harmful to minors, or sexually explicit.
  • Host or distribute viruses, Trojan horses, worms, or other malicious computer programming routines.
  • Use software or technology designed to intercept, divert, or redirect internet traffic or affiliate commissions from another website. This includes, but is not limited to, toolbars, browser plug-ins, extensions, and add-ons.

3. Linking to Our Website

Upon your acceptance into the Program, you will gain access to linking tools through the Awin interface. You are responsible for using these tools correctly and adhering to the following guidelines:

  • Use Provided Links: You must use the HTML code, banner creatives, and tracking links provided through the Awin platform without alteration.
  • Placement Approval: We reserve the right to review your link placements and may require you to make changes to ensure compliance with our brand guidelines.
  • Domain Listing: All domains where you use your affiliate links must be listed in your Awin profile.
  • Brand Representation: Your website may not copy or imitate the look and feel of our website. You may not frame our website or create the impression that your website is part of our official site.
  • Prohibited Practices: You are forbidden from engaging in cookie stuffing or using pop-ups and misleading links. You must not attempt to mask or hide the referring URL information.
  • Link Cloaking: Using redirects to hide the original source of a click is prohibited. If you are found to be cloaking links, any related commissions will be voided, and your commission rate may be set to 0%. This does not apply to standard "out" redirects from the same domain where the affiliate link is placed.

4. Pay-Per-Click (PPC) Advertising Guidelines

If you use PPC advertising, you must follow these rules:

  • Trademark Bidding: You may not bid on any of our trademarked terms, including variations or misspellings, on any search engine or social media platform (e.g., Google, Bing, Facebook) without our prior written permission.
  • Keyword Usage: You may not use our trademarked terms in sequence with other keywords (e.g., "KORARU coupons," "KORARU sale").
  • Ad Copy: You may not use our trademarked terms in your ad title, ad copy, display name, or display URL.
  • Direct Linking: You are prohibited from linking directly to our website from any PPC ad. Clicks must land on a page on your website first.
  • Bidding Position: You may not appear in a higher ad position than us (positions 1-5) for any search term in an auction-style PPC program.
  • Negative Keywords: If you use automated PPC campaigns, you must add our trademarked terms as negative keywords. We have a zero-tolerance policy for trademark bidding. Violations will result in a request to remove the ad within 24 hours. Failure to comply will lead to removal from the Program, and all associated commissions will be reversed.

5. Trademarked Terms

This is a non-exhaustive list of our trademarked terms that are prohibited in PPC campaigns: KORARU, KÕRARU, KŌRARU, Õ , Koraru.com, www.Koraru.com, Koraru.co, www.Koraru.co, Koraru coupon, Koraru discount, Koraru promo code, Koraru sale, Koraru deal.

6. Coupon & Deal Promotion Guidelines

If your website promotes coupons or deals, you must adhere to the following:

  • Approved Codes Only: You may only advertise coupon codes provided to you directly through the Awin platform (e.g., newsletters, Awin's offer database).
  • No Workarounds: You must not post information on how to circumvent the terms of a promotion (e.g., for first-time customer offers).
  • Accurate Display: Coupons must be displayed with the full offer details, a valid expiration date, and the correct code.
  • No Click-to-Reveal: You may not use technology that hides a coupon code and requires a click to reveal it, as this can generate an unearned affiliate click.
  • No External Sourcing: You are prohibited from advertising codes obtained from our other marketing channels, such as customer emails or paid search ads.
  • Commission Structure for Coupon Sites: If your website's primary function is to list coupons and it ranks highly for our brand name plus "coupon" (or similar terms), we may offer a different commission rate to reflect the nature of the sale.

7. Sub-Affiliate Networks

Promoting KORARU through a sub-affiliate network is allowed, but you must be transparent about the origin of your traffic. You are responsible for ensuring all your sub-affiliates comply with our Program terms. This includes all restrictions on PPC campaigns and coupon promotions. Failure to ensure compliance may result in the loss or reduction of commissions.

8. Domain Names

You are strictly prohibited from using our trademarked terms as part of a domain or sub-domain name. For example, koraru-coupons.com or koraru.yourwebsite.com are not permitted.

9. Social Media Promotion

You are welcome to promote KORARU on your own social media channels (e.g., Facebook, Instagram, Twitter, YouTube) by sharing offers with your followers. However, you are prohibited from:

  • Posting your affiliate links on KORARU’s official social media pages.
  • Running paid ads on social media platforms that use our trademarked company name.
  • Creating a social media page or username that includes our trademarks.

10. FTC Disclosure Requirements

You must include a clear and conspicuous disclosure statement on any page, blog post, or social media post where you place an affiliate link. The disclosure should state that you may be compensated for your endorsement or review. This disclosure must be placed "above the fold" where it is visible without requiring the user to scroll.

11. Termination

Either you or we may terminate this agreement at any time, with or without cause, by using the account closure function on the Awin platform. Your participation in the Program will also terminate immediately if you breach any of these terms. Upon termination, you must immediately cease using and remove all links, logos, and other materials related to our Program from your site.

You are eligible to earn commissions on qualifying sales that occur during the term. Commissions earned up to the date of termination will be paid, provided the orders are not later canceled or returned. We may withhold your final payment for a reasonable period to ensure the correct amount is paid.

12. Modification of Terms

We may modify these terms and conditions at our discretion. You will be notified of any changes via email. Your continued participation in the Program after a notification of change constitutes your acceptance of the new terms. If any modification is unacceptable, your only recourse is to terminate your participation.

13. Reversals & Communication

We reserve the right to reverse commissions for orders that are canceled, returned, or result from duplicate tracking, disputed charges, or violations of these terms.

We expect timely and honest communication. If we request information about traffic or sales that we suspect may violate our terms, you must respond promptly. We reserve the right to reverse commissions, set your commission rate to 0%, or suspend or terminate you from the Program if you are unresponsive, dishonest, or cannot validate your traffic sources.

14. Grant of License

We grant you a non-exclusive, non-transferable, revocable right to access our site through the provided links and use our logos, trade names, and trademarks ("Licensed Materials") solely for the purpose of your participation in this Program. You agree that all use of our Licensed Materials benefits KORARU, and you will not take any action inconsistent with our ownership. This license is valid only while you are a member in good standing of the Program.

15. Disclaimer

KORARU makes no express or implied warranties regarding our Program or the products and services provided. We do not guarantee that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

16. Limitation of Liability

We will not be liable for any indirect, incidental, special, or exemplary damages (including loss of revenue or goodwill) arising in connection with this agreement. Furthermore, KORARU’s total liability arising from this agreement will not exceed the total commission fees paid to you under this agreement.

17. Indemnification

You agree to indemnify and hold harmless KORARU, its directors, officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys' fees) that arise from (i) claims that your content infringes on a third party's intellectual property rights, (ii) your breach of this agreement, or (iii) any claim related to your site.

18. Miscellaneous

  • Independent Contractor: This agreement does not create any partnership, joint venture, agency, or employment relationship between you and KORARU. You are an independent contractor.
  • Governing Law: This Agreement shall be governed by the laws of the State of New York and the United States.
  • Entire Agreement: This document represents the entire agreement between you and us and supersedes all prior agreements.
