General Terms & Conditions
Scope/Subject of Contract:
The Terms & Conditions set out apply to the Zinga Entertainment affiliate program and govern the collaboration with our affiliates.
Registration:
We require all affiliates we work with to be at least 18 years old with full rights to work. We reserve the right to reject any affiliate applications if we believe that the affiliates website or social pages are not suitable for our affiliate program.
Duties of the Affiliate:
If you are using a website, it must be live and fully operational. Any inappropriate content cannot be displayed alongside Zinga Entertainment products or promotional material. The following is deemed inappropriate:
Religious or political content
Gambling or lotteries
Firearms
Alcohol, tobacco or drugs
Pornograghic, offensive, violent or radical content
Please note that this list is not exhaustive and Zinga Entertainment reserve the right to terminate our partnership with any affiliate’s website which is found to be inappropriate at any time without notice.
The following activities are forbidden without permission from Zinga Entertainment:
Sending unsolicited emails containing advertising or promotional materials which requires the agreement of the recipient
Retargeting ads
SMS and MMS as advertising media
The affiliate site may not give the impression of being a legal representative of Zinga Entertainment
The Affiliate must comply with all legal regulations and data-protection legislation.
Promotion via search engine marketing is prohibited. This also includes: pop-ups, layer ads, adware and force click advertising formats.
Discount Codes Policy:
If any of our affiliates require unique discount codes, please contact us for more details. Affiliates can only use/promote discount codes that are provided through the affiliate program or directly given to the affiliate by a member of our team. If any affiliate is found to be promoting unauthorised discount codes they may have their commission reduced for sales that used this discount code or the affiliate may be removed from our program.
Where voucher codes are issued with an expiry date this should be clearly displayed, and codes should be removed or explicitly marked as expired after this date unless you are advised otherwise. Any affiliates displaying expired codes without marking them as being expired may be suspended from the programme. Please also ensure that you observe the IAB voucher code best practice guidelines.
Commission Structure:
The Affiliate shall receive commission for each purchase made. We offer a flat commission rate of 5% across all products on our website with the opportunity for bonuses during promotions/sales.
Zinga Entertainment retains the right to change the value of the commission.
If the purchase is partially or completely cancelled, the respective commission will be cancelled or reduced.
Our standard cookie duration is 7 days
Zinga Entertainment is entitled to withhold all affiliate-related services if we suspect there have been violations of the terms and conditions by the Affiliate.
PPC Guidelines:
Commissions will not be paid where there is evidence of any paid search activity on brand terms without prior authorisation. This includes permutations, misspellings and broad matches containing brand terms. We do not authorise any PPC advertising.
De-Duplication Policy:
All affiliate sales are de-duplicated against other online advertising channels using a local cookie on the merchant platform. De-duplication channels may include:
• PPC Brand
• PPC Generic
• Email Advertising
• Direct Partnerships
• Price Comparison Services
• Display & retargeting advertising
• Other Affiliate Networks
Contract Duration:
The Contract between Zinga Entertainment and the Affiliate shall be concluded for an unlimited period of time. The Contract may be terminated by either Party at any time with 7 days’ notice. After the Contract has ended, the Affiliate must immediately delete the advertising material and information which was provided to them.
Cookies:
We use Cookies on our website to optimise the experience for our customers and other visitors. Cookies are small text files that are sent from our servers to the visitor’s browser and stored on their device. Cookies do not contain viruses, Trojans or other harmful software. They do not cause damage to the visitor's device.
A Cookie contains information in connection with the specific end device used. Cookies are primarily used to improve and optimise the use of websites and other online offerings. We only use Cookies within the framework of the applicable data protection laws. By using our website, the user agrees to the use of Cookies.
Data Protection Guidelines:
We are committed to protecting our users' data and respecting their privacy. This policy is the basis on which we process all personal information we have collected or that has been provided to us.
Zinga Entertainment stores data in accordance with legal requirements. In addition, Zinga Entertainment will take all necessary technical and organisational security measures to protect data against loss, unauthorised access or other misuse.
Social Content Creators:
If affiliates wish to use affiliate links within their social media posts, you will need to use ‘#AD’ or ‘AD’. These are the only valid identifiers that comply with ASA. The placement of this identifier should be clear to the viewer before the viewer watches the content or at the beginning of the content.

Final Provisions:
Zinga Entertainment has the right to change these T&Cs at any time. The Affiliate will be informed of any changes by email. The Affiliate may reject these changes in writing within 30 days and terminate this Agreement. If neither a rejection of the changes or a termination occurs within this deadline, the T&Cs will be considered to have been accepted.
