Bandicam Affiliate Agreement
This Agreement is entered by and between Bandicam Company ("Bandicam") and Affiliate, and describes the terms and conditions for participation in the Bandicam Affiliate Program.
1. Approval or Rejection
We reserve the right to approve or reject any affiliate program application in our sole and absolute discretion. We may cancel your application if we determine that your site is unsuitable for our Program.
The following types of sites and affiliates will be rejected:
1) Contain adult content or pornography, promote sex services or links to such sites
2) Racial, ethnic, political, hate-mongering, or otherwise objectionable content
3) Promotion of illegal substances or activities such as illegal online gambling, illegal drugs, etc.
4) Software piracy, list passwords, software cracking, warez or any other illegal activity
5) Browser helper objects, software that generates clicks or pop-ups on other sites or attempts to set a cookie or tracking without the user’s knowledge
6) Links that automatically redirect users to another site
7) Sites that offer incentives, including cash, points, contest entries, list of coupons, prizes, or rewards, in exchange for clicking on ads or links
8) Sites that have software downloads that, in our sole discretion, can potentially divert commissions from other affiliates
2. Commissions
We pay affiliates that follow guidelines a commission of 15-20% for each sale paid for by a customer who makes a purchase through Affiliate’s referral link. Commission rates for Coupon sites are evaluated on an individual basis and may be subject to change. Commissions are paid as a one-time payment per order, excluding fraudulent transactions, Bitcoin payments, chargebacks, returns, and any taxes we are required to collect by law. Commissions are capped at $100 per sale. Commissions will only be paid on the first purchase made by the referred customer. Subsequent purchases, including upgrades or renewals, are not eligible for commission. Commissions will only be paid on sales that are made when the customer clicks through properly structured and qualified Affiliate links. Affiliates are not eligible for duplicate commissions from both ShareASale and 2Checkout (Avangate) affiliate programs simultaneously. Ensuring proper link coding is Affiliate's responsibility.
3. Advertising
1) Affiliates are not allowed to bid on Bandicam's trademarks, brand names, and any misspellings or variations of the Bandicam brands.
2) Affiliates are not allowed to redistribute Bandicam Products in any way without a written permission from us.
3) Affiliates are not allowed to submit Bandicam products to other websites by changing the product name or even using the same name of our products.
4) Affiliates are not allowed to sell Bandicam products on online stores or sites related to auction, including but not limited to eBay, Amazon, etc.
5) Affiliates may not use downloadable toolbars, adware, spyware, forced click (cookie stuffing), or any other malicious strategies to earn unfair commission payouts.
4. Site Content
Affiliates are not allowed to use the following protected keywords as part of their domain name, including but not limited to “Bandicam”, “Bandicut”, etc.
Bandicam reserves the right to void Affiliate's commission or even suspend Affiliate's partnership in the program.
5. Coupon
Affiliates are not allowed to offer additional coupons, bonuses, or incentives to the customer. Bandicam reserves the right to remove any affiliate and/or withhold commission payouts at their own discretion based on the affiliate’s behavior and compliance with our terms of service.
6. Fraud
Affiliates shall not, either directly or indirectly, act or allow others to act, in any fraudulent way. Fraudulent activities include, but are not limited to, the use of spyware or stealware, the act of coercing or misleading customers, and the use of any other deceptive acts or click-fraud. If you fraudulently add leads or clicks and/or inflate leads or clicks by fraudulent traffic generation, as determined solely by us, you will forfeit your entire commission for all programs with us and your account will be terminated.
7. Limitation of Liability
In no event shall Bandicam be liable for any indirect, special, incidental, or consequential damages or loss of profits arising out of or in connection with this agreement, even if Affiliate shall have been advised of the possibility of such potential loss or damage.
The aggregate liability of Bandicam to Affiliate for claims, damages, or obligations arising out of or in connection with this agreement shall not exceed the amount actually paid by Affiliate to Bandicam under this agreement during the six-month period immediately prior to any such claim.
8. Termination
Bandicam may terminate this agreement immediately for any reason which it deems appropriate, with or without prior notice to Affiliate by disabling Affiliate's specific program. Affiliate may terminate its participation in the Bandicam Affiliate Program at any time by removing all links from its media and deleting all copies of the links.
Amounts earned, whether invoiced or not prior to termination, shall accrue up to the date of termination and be paid in accordance with the other provisions of this Agreement.
By applying to the Bandicam Affiliate Program, Affiliate confirms and acknowledges that it has read this Agreement in its entirety and agrees to be bound by all of its terms and conditions.
