Oufer Affiliate Program Agreement
INTRODUCTION
This Agreement sets forth the complete terms and conditions for your participation as an affiliate in the Oufer Affiliate Program. The purpose of this Agreement is to facilitate linking between your website and the Oufer website through the Awin affiliate network. Throughout this Agreement, “we,” “us,” and “our” refer to Oufer, while “you,” “your,” and “yours” refer to the affiliate.
1. ACCEPTANCE OF TERMS
By submitting an application to join the Oufer Affiliate Program, you acknowledge that you have read, understand, and agree to be bound by the terms and conditions of this Agreement.
We reserve the right to modify these terms at any time, at our sole discretion, by posting a notice on the Awin program page or sending you an email. Modifications are effective immediately upon posting or notice. Your continued participation in the program after such notice constitutes acceptance of the updated terms.
2. AFFILIATE OBLIGATIONS
2.1. To enroll, you must complete and submit the application through the Awin.com platform. Approval is at Oufer’s sole discretion. We reserve the right to review and reject or remove affiliates at any time if we deem the site or promotion method unsuitable, including but not limited to content that:
Promotes sexually explicit or violent content.
Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
Promotes illegal activity.
Infringes intellectual property or violates applicable laws.
Misuses the “Oufer” brand name in domains, subdomains, or search engine ads.
Contains harmful, defamatory, obscene, or objectionable material.
2.2. Affiliates must use the tracking links, banners, and promotional materials provided through Awin to ensure proper tracking of sales.
2.3. Affiliates may not mislead users into believing their website is operated by Oufer.
2.4. Affiliates are solely responsible for their content and compliance with all laws, regulations, and intellectual property rights.
3. OUFER RIGHTS AND OBLIGATIONS
3.1. We reserve the right to monitor your promotional activities to ensure compliance with this Agreement.
3.2. We may terminate this Agreement immediately and without notice if fraudulent activity, misuse, or abuse is detected. In such cases, commissions will not be paid.
3.3. This Agreement begins upon our acceptance of your application and continues until terminated as outlined below.
4. COMMISSIONS AND PAYMENT TERMS
4.1. Affiliates will earn a 15% commission on the net sale value of each Qualified Sale generated through affiliate links.
4.2. A “Qualified Sale” is defined as a completed purchase of Oufer products by a customer referred through your link, not returned or canceled within the return window.
4.3. Commissions are tracked and processed by Awin in accordance with their payment policies.
4.4. 45-Day Cookie Tracking applies—sales completed within 45 days of the click will be credited to the referring affiliate.
4.5. Oufer may offer exclusive bonus tiers or extra rewards for high-performing publishers.
5. TERM AND TERMINATION
Either party may terminate this Agreement at any time, with or without cause, by written notice (email is acceptable).
This Agreement will also terminate immediately upon any breach of terms by the affiliate.
6. DISCLAIMER OF WARRANTIES
Oufer disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
7. LIMITATION OF LIABILITY
We shall not be liable for indirect, incidental, consequential, or exemplary damages (including lost revenue or profits) arising out of this Agreement. Our maximum liability under this Agreement shall not exceed the total commissions paid to you in the 12 months prior to the claim.
8. INDEMNIFICATION
You agree to indemnify and hold Oufer harmless from all claims, damages, liabilities, costs, and expenses (including legal fees) arising from your participation in the program, your promotional activities, or breach of this Agreement.
9. MISCELLANEOUS
9.1. This Agreement constitutes the entire agreement between Oufer and you regarding the affiliate program.
9.2. You agree to comply with all applicable laws, advertising guidelines, and Awin network policies.
9.3. This Agreement shall be governed by and construed in accordance with the laws of the State of California, USA.
