1. Introduction

At Ergonofis, we value our affiliate partners and are committed to creating strong, long-term partnerships that drive results for both sides. This Affiliate Program Agreement (“Agreement”) outlines the terms and conditions governing your participation in our affiliate program (the “Program”) through the AWIN network.

2. Program Overview

This Agreement allows approved affiliates (“you,” “your”) to promote ergonofis (“we,” “us,” “our”) products via HTML links, banners, and other approved creatives, earning commissions on qualifying purchases generated through your tracked links.

3. Enrollment and Approval

All affiliate applications are reviewed and subject to our approval at our sole discretion.

We reserve the right to reject or revoke participation if your site, content, or promotional methods are deemed inappropriate, including but not limited to:
-Promoting sexually explicit, violent, discriminatory, or illegal content.
-Infringing on intellectual property rights.
-Misleading, harmful, or defamatory material.
-Domain names containing “ergonofis” or variations/misspellings.

Auto-approval does not guarantee ongoing participation; we may review your activity at any time.

4. Affiliate Responsibilities

Use only tracking links, creatives, and materials provided or approved by ergonofis.

Maintain and update your site or promotional channels to ensure accuracy and compliance.

Follow all applicable laws, including intellectual property, advertising, and privacy regulations.

Do not design your site or materials in a way that could mislead users into believing they are interacting with ergonofis directly.

5. Branding & Promotion Guidelines

Strictly prohibited:

-Direct linking to our site from paid search ads.
-Trademark bidding on terms such as “ergonofis,” “ergonofis.com,” or variations/misspellings.
-Use of “coupon,” “discount,” or similar in conjunction with our brand in paid search.

Promotional content must align with our brand guidelines.

6. Prohibited Practices

Your participation will be suspended or terminated if you engage in:

-Spamming (unsolicited emails, forum posts, mass newsgroup postings).
-False claims or misleading promotions.
-Offering rebates, kickbacks, or incentives from your commissions.
-Self-referrals or fraudulent transactions.
-Using “Parasiteware™,” toolbars, adware, pop-ups/unders, or any method that overwrites cookies without user consent.

7. Payment

Tracking, reporting, and commission payments are managed via AWIN.

Please refer to AWIN’s payment terms for schedules and minimum payout thresholds.

8. License Grant

We grant you a limited, non-exclusive, revocable license to use our name, logos, and provided creatives solely for Program participation. This license ends upon termination of the Agreement.

9. No guarantee clause

We do not guarantee uninterrupted tracking, error-free operation, or specific earnings from your participation in the Program, but we will always do our best to ensure accurate tracking, timely payments, and a positive affiliate experience.

10. Termination

Either party may terminate this Agreement at any time, with or without cause, by providing written notice (email is acceptable). We may terminate immediately if you breach these terms. Upon termination, you must remove all ergonofis materials and cease using our brand in any form.

11. General Provisions

You are an independent contractor; no partnership or employment relationship is created by this Agreement.

This Agreement is governed by the laws of the Province of Quebec, Canada.

This document constitutes the entire agreement between the parties and supersedes all prior communications.
