FORK & MELON Affiliate Program – Terms & Conditions
These Terms & Conditions (“Terms”) govern participation in the FORK & MELON Affiliate Program (“Program”) operated through Awin. By joining and participating in the Program, you (“Affiliate”) agree to the following:
1. Enrollment & Approval
All affiliate applications are subject to review and approval by FORK & MELON.
We reserve the right to reject any application at our sole discretion, including but not limited to websites, social channels, or marketing practices that conflict with our brand values or appear fraudulent.
Participation may be terminated at any time if the Affiliate is found in violation of these Terms.
2. Commissions & Payment
Affiliates will earn commissions on eligible sales generated through properly tracked links provided by Awin.
Commissions are calculated based on net sales value, excluding shipping, taxes, discounts, or returns.
Payments are processed by Awin in accordance with their schedule and policies.
We reserve the right to reverse commissions for returned, canceled, or fraudulent orders, or for violations of these Terms.
3. Promotional Guidelines
Affiliates may only promote FORK & MELON using approved creatives, links, and product information provided by us or displayed on our official website.
Affiliates may not:
Modify or misrepresent our brand or products.
Use unauthorized discounts, coupon codes, or incentives.
Engage in spamming, unsolicited email campaigns, adware, or cookie stuffing.
Bid on or purchase search engine keywords, ads, or domain names that include our trademarks (“FORK & MELON,” “SOAP AF,” “LOTION AF,” or variations/misspellings).
Represent themselves as FORK & MELON or imply an official partnership beyond this Program.
4. Content & Brand Representation
Affiliates must present FORK & MELON products in a professional manner that aligns with our brand values: clean, elevated, and fashion-forward.
Affiliates may not promote our products on websites or platforms that:
Contain illegal, offensive, discriminatory, or adult content.
Infringe on intellectual property rights.
Otherwise harm the reputation of FORK & MELON.
5. Intellectual Property
Affiliates are granted a limited, non-exclusive, revocable right to use our trademarks, logos, and creative assets solely for the purpose of promoting our products under this Program.
Affiliates may not alter, misuse, or register any of our intellectual property.
6. Termination
We may suspend or terminate an Affiliate’s participation in the Program at any time, with or without cause or notice.
Upon termination, all rights to use FORK & MELON assets and links must immediately cease.
7. Limitation of Liability
FORK & MELON will not be liable for indirect, incidental, or consequential damages (including lost revenue or profits) arising from participation in the Program.
Our aggregate liability shall not exceed the total commissions paid to the Affiliate in the three months preceding the claim.
8. Modification of Terms
We reserve the right to update, modify, or replace these Terms at any time.
Continued participation in the Program constitutes acceptance of any changes.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions.
10. Email Marketing Restrictions
Affiliates are prohibited from sending emails that imply they are FORK & MELON or that are designed to mislead recipients about their relationship with our brand.
Affiliates may not include FORK & MELON in their email marketing without our prior written approval.
All affiliate emails must comply with applicable anti-spam laws (including CAN-SPAM in the U.S. and GDPR in the EU).
Any violation of this section will result in immediate termination from the Program and forfeiture of pending commissions.
