Modern Pets Affiliate Program Terms & Conditions
Modern Pets asks all affiliates to read and understand these terms and conditions prior to joining the program or starting any marketing initiatives. Our intent is to keep them plain and simple and if there are any questions please contact your Affiliate manager for clarification or permissions FIRST.
DEFINITIONS for the terms used below:
1. “Our”, “Us”, and/or “We”, as well as “Merchant” or “Advertiser” refers to Modern Pets. Modern Pets refers to both Modern Dog Inc. and Modern Cat Inc.
2. “Our Website” refers to the Modern Pets’ web properties and any associated subdomains of www.moderndogmagazine.com and www.moderncat.com
3. “You”, “Your”, as well as “Affiliate” or “Publisher” refers to the Affiliate
4. “Your Website” can mean any publishing platform owned and operated by you, including but not limited to your web domain (e.g. ‘www.yourdomain.com’) Facebook page, Instagram or Twitter account, Email List, Newsletter, etc.
5. “Program” refers to the Modern Pets Affiliate Program.
6. “Network” refers to the ShareASale Affiliate Management platform.
Fundamentally, it is our expectation that all advertisements and promotions are truthful and accurate.
PAID SEARCH (PPC) GUIDELINES
We welcome working closely with Affiliates experienced in paid search and are always open to discussing unique and innovative opportunities. That said, here are the standard rules: You may not bid on any of our trademarked terms, including variations and misspellings, or bid on any trademarked terms in sequence with another keyword without express written permission from us. Our trademarked terms cannot be used in the display URL, and no ad title or ad copy may give the impression that Your site is Modern Pets’ web properties. Any ads must link directly to Your own site, and automatic redirects to Modern Pets’ web properties are not allowed.
COUPON GUIDELINES
We will periodically make coupons available and only those issued directly to Affiliates through the Network may be used by Affiliates. Any additional coupons used outside of those issued through this Network will result in termination of the affiliate relationship. Below are the terms that apply for any Affiliate who is considering the promotion of our products in relation to a deal or coupon:
• Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the Program immediately.
• User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
• Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the Merchant site.
FTC COMPLIANCE
All Affiliates must adhere to the rules and regulations set forth by the Federal Trade Commission, specifically regarding disclaimers about any paid compensation for the content or links referring to Modern Pets’ services and products. Violations of these terms and guidelines is at the sole discretion of Modern Pets and may result in the reversal of any or all commissions. We do not take these actions lightly and will make every attempt to contact affiliates and discuss any issues prior to issuing a reversal. Exceptions to this include any quick-cancels prior to receipt of purchase.
TERMINATION
Your Affiliate application and status in the Program may be suspended or terminated for any of the following reasons:
• Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
• Spamming (mass email, mass newsgroup posting, etc.).
• Advertising on sites containing inappropriate material such as pornography or promoting illegal activities.
• Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
• Self referrals, fraudulent transactions, suspected Affiliate fraud.
• Modern Pets will not approve, or will immediately terminate affiliate relations with any Affiliates with websites that offer animals for sale, including breeder websites, animal fur or products made from animal fur, or products that are deemed, in Modern Pets’ sole discretion, to cause harm to animals.
In addition to the foregoing, Modern Pets reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement for any, or no reason. We reserve the right to approve or reject ANY Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of Your Affiliate Program application.
RELATIONSHIP OF PARTIES
Nothing contained within this Agreement shall be construed to form any partnership, joint venture, agency, franchise, or employment relationship. You are an independent contractor of the Company and will remain so at all times.
JURISDICTIONAL ISSUES
These Terms & Conditions will be governed by the laws of the Province of British Columbia, Canada. The exclusive forum for any actions brought in connection with these Terms and Conditions will be in the courts of Vancouver, British Columbia, Canada and You consent to such jurisdiction.
