Luxe Noir Affiliate Program Terms and Conditions (for ShareASale)
1. Introduction
*These Terms and Conditions (“Agreement”) govern your participation in the Luxe Noir Affiliate Program (“Program”) through ShareASale. By joining, you (“Affiliate”) agree to comply with all the terms set forth below in addition to the policies of ShareASale. Luxe Noir (“Company”, also “we”, “us”, or “our”) reserves the right to update or change these terms at any time.
2. Enrollment and Acceptance
*Affiliates must apply through ShareASale.
*We reserve the right to accept or reject applications at our sole discretion for any reason,including but not limited to website content misalignment or previous violations of policies
3. Promotional Guidelines
*Affiliates may use provided links, banners, and promotional assets; any other material must be pre-approved.
*Affiliates must not promote Luxe Noir using misleading claims, spam, or channels violating applicable laws.
*No bidding on Luxe Noir brand keywords or any variation thereof in search advertising isallowed.
*Affiliates must disclose their affiliate relationship in all related content in accordance with FTC regulations
4. Commissions and Payments
*Commission Rate: 8% of referred sales (excluding returns, chargebacks, or fraudulent sales)
*Cookie Duration: 30 days from the date a user clicks the affiliate link
*Minimum Payout Threshold: Determined by ShareASale’s policies.
*Payment Schedule: Payouts are processed by ShareASale in accordance with their schedule and policies, after transaction validation and any pending/lock period to account for returns or cancellations
*No commission will be earned on self-referrals or for purchases by the affiliate themselves.
5. Order Validation and Reversals
*Sales are reviewed and may be reversed due to returns, cancellations, or suspected fraud within the lock/pending period specified by ShareASale
*Once the lock date passes, commissions are finalized and reversals are no longer permitted.
6. Restrictions and Prohibited Activities
*Affiliates may not represent themselves as Luxe Noir, engage in cookie stuffing, or artificially inflate transactions.
*Affiliates must not use any method to generate leads or sales through unsolicited email(spam), incentivized clicks, or other questionable practices.
*Violation of brand guidelines, using unapproved creative, or promoting via explicit, hateful,or illegal content is grounds for immediate removal and forfeiture of commissions
7. Termination
*Either party may terminate participation in the Program at any time, for any reason, with or without notice.
*Luxe Noir reserves the right to terminate accounts for inactivity, policy violation, or actions that may harm our brand or customers
8. Changes to the Agreement
*Luxe Noir may modify these terms at any time. Affiliates will be notified via ShareASale oremail, and continued participation indicates acceptance of changes
9. Disclaimer and Limitation of Liability
*The Program is provided “as is.” Luxe Noir is not liable for indirect, incidental, or consequential damages from affiliate participation, including lost profits.
10. Governing Law
*This Agreement is governed by the laws of the jurisdiction where Luxe Noir operates unless otherwise required by ShareASale.
11. Miscellaneous
*Participation is non-exclusive.
*All content and intellectual property provided remains the property of Luxe Noir.
*If any provision is found unenforceable, the remaining terms still apply.
