Affiliates are prohibited from using our display URLs ohmibod.com and www.lovelifetoys.com in any ad on any network. This includes all URLs listed under our "Prohibited SEM Display URL Content" in this policy.

NOTE: Any publisher found violating our search policy will have sales associated with this practice reversed.

TOOLBAR POLICY

Notify OhMiBod of the toolbars being used. The toolbar software must meet ALL of the following requirements:

Stands down when it recognizes any publisher links
The software does not automatically drop cookies
Other publishers' cookies are not being overwritten
The DSA does not repeatedly ask the user to "click here to earn points"
The sign to opt in is not larger than the sign to opt out
It easily installs and uninstalls
The software does not significantly change the end user's browsing experience

COUPON GUIDELINES

If you are enrolled in our Program and your website promotes coupon codes, you must adhere to our Coupon Guidelines as follows:

You may ONLY advertise coupon codes that are provided to you through the affiliate program.
Posting any information about how to work around the requirements of a coupon/promotion (i.e. first time customers only) will result in removal from the program.
Coupons must be displayed in their entirety with the full offer, valid expiration date, and code.
You may NOT use any technology that covers up the coupon code and generates the affiliate click by revealing the code(s).
You may NOT advertise coupon codes obtained from any non-affiliate marketing channel, including coupon codes from our email, paid search, or any other non-affiliate advertising campaigns.
You may NOT give the appearance that any ongoing offer requires clicking from your website in order to redeem. For example, if all items on the site have free shipping over $100, you may not turn this into an offer that infers that the customer must click from your site to get this deal.

AGE & ADULT CONTENT COMPLIANCE

Publishers participating in the OhMiBod Affiliate Program must be 18 years of age or older. By joining this program, you confirm that you are of legal age and that your platform, audience, and promotional content are directed exclusively toward adults (18+).

Publishers must not promote OhMiBod products on any platform, channel, website, or social media account where minors are likely to be present or where adult content is prohibited. Publishers are solely responsible for ensuring their promotional activities comply with all applicable local, state, federal, and international laws governing adult content and commerce, including but not limited to obscenity laws in their jurisdiction.

OhMiBod reserves the right to immediately terminate and reverse commissions for any publisher found to be in violation of this policy.

CONTENT STANDARDS & BRAND REPRESENTATION

OhMiBod is a sexual health and wellness brand committed to empowerment, inclusivity, and destigmatizing self-pleasure. Publishers must represent OhMiBod and its products in a manner consistent with these values.

The following content is strictly prohibited in connection with OhMiBod affiliate promotions:

Explicitly pornographic content
Content that is degrading, discriminatory, or harmful toward any gender, sexual orientation, body type, race, religion, or other identity
Content that portrays OhMiBod products in a violent, coercive, or non-consensual context
Content that misrepresents the function, safety, or intended use of OhMiBod products
Promotion on platforms or within content that violates the terms of service of the hosting platform

OhMiBod reserves the right to review any publisher's content at any time and to terminate partnership with any publisher whose content, platform, or audience is deemed inconsistent with OhMiBod's brand values, at OhMiBod's sole discretion. Commissions associated with non-compliant content may be reversed.

SOCIAL MEDIA & INFLUENCER POLICY

Publishers promoting OhMiBod through social media channels, blogs, video platforms, or other digital content must adhere to the following:

All sponsored content, paid partnerships, and affiliate-linked posts must be clearly labeled in accordance with FTC guidelines and the specific requirements of each platform (e.g., #ad, #sponsored, Instagram's "Paid Partnership" tag, YouTube's paid promotion disclosure, etc.)
Publishers must comply with the content policies of each platform on which they promote OhMiBod, including but not limited to Instagram, TikTok, YouTube, Facebook, X (formerly Twitter), Pinterest, and any other channel used
OhMiBod cannot be held responsible for content removed, accounts suspended, or penalties incurred by publishers due to violations of third-party platform policies
Publishers may not use OhMiBod branding, imagery, or product content in any explicitly sexual or pornographic context, regardless of platform
Publishers may not make medical or clinical claims about OhMiBod products beyond what is explicitly provided in OhMiBod's approved marketing materials

FTC DISCLOSURE REQUIREMENTS

You must include a disclosure statement within any and all pages, blog posts, or social media posts where affiliate links for our affiliate program are posted as an endorsement or review, and where it is not clear that the link is a paid advertisement. This disclosure statement should be clear and concise, stating that we are compensating you for your review or endorsement. If you received the product for free from us or from the affiliate management team for review, this also must be clearly stated in your disclosure.

Disclosures must be made at the beginning of the claims and may not appear solely in a "Terms of Use", "Legal", "About Us", or other linked page.
Disclosures should be placed above the fold; scrolling should not be necessary to find the disclosure (e.g. disclosure should be visible before the jump).
Pop-up, hover state, and button disclosures are prohibited.
Disclosure policy applies to all social media, even when space is restricted (e.g., tweets).
Disclosures should be made in the same medium as the claim (e.g. video, text).

COOKIE DURATION & ATTRIBUTION

OhMiBod operates a 60-day cookie window. Publishers will receive credit for any qualifying purchase made within 60 days of the initial tracked click, provided the purchase is not subject to reversal under our Reversal & Communication Policy. In the event of cookie conflicts, the last-click attribution model applies unless otherwise agreed upon in writing with OhMiBod.

DATA PRIVACY & COMPLIANCE

Publishers must comply with all applicable data privacy laws in connection with their affiliate marketing activities, including but not limited to:

The General Data Protection Regulation (GDPR) for publishers operating in or targeting audiences in the European Union
The California Consumer Privacy Act (CCPA) for publishers operating in or targeting audiences in California

Publishers must maintain a privacy policy on their website or platform that accurately discloses their data collection and use practices, including the use of affiliate tracking technologies such as cookies. Given the sensitive nature of OhMiBod's product category, publishers are strongly encouraged to take additional care in handling any user data collected through affiliate activity and must never disclose, sell, or misuse audience data in connection with OhMiBod promotions.

PROGRAM CHANGES & TERMINATION NOTICE

OhMiBod reserves the right to modify commission rates, program terms, or promotional materials at any time. Publishers will be given a minimum of 30 days written notice prior to any reduction in commission rates or material changes to program terms. Notice will be delivered via the Awin platform and/or the email address associated with your publisher account. It is the publisher's responsibility to ensure their contact information is current.

OhMiBod reserves the right to terminate this program or any individual publisher's participation immediately and without notice in the event of a terms violation. Publishers may withdraw from the program at any time by notifying OhMiBod through the Awin platform.

REVERSAL & COMMUNICATION POLICY

OhMiBod reserves the right to reverse orders due to order cancellations, duplicate tracking, returns, disputed charges, and program violations as outlined in these terms and conditions.

Additionally, if we ask you for clarification or more information on any orders or clicks that we suspect may be in violation of our terms and conditions, we expect that you will respond in a timely and honest manner. Below are violations of our communications policy:

You are not forthcoming, intentionally vague, or are found to be misrepresenting the truth.
You are not responsive within a reasonable time period and after multiple attempts to contact with information listed in your network profile.
You cannot substantiate or validate the source of your traffic to our program with clear and demonstrable proof.

If any of the above conditions apply, then we reserve the absolute right to reverse orders, set your commission to 0%, or suspend you from the program for the period or orders in question. We know that many violations are a result of automated processes; however, it is incumbent upon each affiliate to ensure that it has the appropriate checks and balances in place to proactively address these issues and adhere to our program rules.
