Important note: This document is a business-ready affiliate program policy draft for use in the Awin advertiser profile or as an uploaded program document. It should be reviewed by TEMOK.com management and legal counsel before publication.

1. Agreement Overview

These Terms and Conditions govern participation in the TEMOK.com affiliate program operated through the Awin platform. By applying to, joining, or continuing to participate in the program, the publisher, affiliate, partner, sub-publisher, or promotional partner agrees to comply with these Terms, Awin's applicable platform rules, and all instructions made available through TEMOK.com or Awin.

In this Agreement, “TEMOK.com,” “we,” “us,” and “our” refer to Temok IT Services DMCC, DBA TEMOK.com. “Affiliate,” “publisher,” “partner,” “you,” and “your” refer to the approved participant promoting TEMOK.com through Awin. “Program” refers to the TEMOK.com affiliate program on Awin.

2. Program Purpose

The purpose of the Program is to allow approved affiliates to promote TEMOK.com services through valid Awin tracking links, banners, text links, content placements, coupon placements, and other approved promotional methods. TEMOK.com offers web hosting, cloud hosting, VPS hosting, dedicated servers, domain registration, managed cloud services, AI Hosting, and Acronis Cyber Protect Cloud solutions.

3. Enrollment, Approval, and Ongoing Review

Affiliates must apply through Awin and provide accurate, complete, and current account, website, traffic, and promotional information. Approval does not prevent TEMOK.com from reviewing an affiliate later. TEMOK.com may approve, reject, suspend, or remove any affiliate from the Program at its discretion.

TEMOK.com may reject or remove affiliates whose websites, traffic sources, content, or promotional methods:

Promote illegal, misleading, fraudulent, harmful, defamatory, obscene, violent, discriminatory, or sexually explicit material.
Infringe or appear to infringe intellectual property, privacy, publicity, or other third-party rights.
Use malware, spyware, adware, browser extensions, toolbars, forced clicks, cookie stuffing, hidden frames, pop-ups, pop-unders, misleading redirects, or similar methods.
Misrepresent their relationship with TEMOK.com or imply they are TEMOK.com, an official TEMOK.com department, or an authorized sales office unless expressly approved in writing.
Fail to disclose material traffic sources, paid media activity, sub-affiliate activity, coupon activity, cashback activity, or other promotional methods when requested.

4. Awin Platform, Tracking, and Reporting

Affiliates must use the links, creatives, tracking URLs, promotional assets, and reporting tools made available through Awin or otherwise approved by TEMOK.com in writing. Sales, leads, or other actions will only be considered for commission when properly tracked through Awin and validated by TEMOK.com.

TEMOK.com is not responsible for missed commissions caused by incorrect link formatting, deleted cookies, browser restrictions, tracking blockers, non-Awin links, unauthorized redirects, technical changes made by the affiliate, or failure to use approved Awin tracking links. Awin reporting will be used as the primary source for tracked clicks, transactions, validation status, and commission reporting.

5. Commission Eligibility

Commissions are payable only on qualifying, tracked, approved, and paid customer orders for eligible TEMOK.com services. Eligibility may vary by product, plan, promotion, customer type, country, campaign, or commission group shown in Awin.

Unless TEMOK.com states otherwise in Awin, commissions are not payable on:

Fraudulent, cancelled, refunded, charged back, unpaid, duplicate, test, or suspicious orders.
Orders placed by the affiliate for their own account, related accounts, employees, family members, controlled entities, or accounts created primarily to earn commission.
Orders generated through misleading claims, unauthorized coupons, forced clicks, cookie stuffing, ad hijacking, brand impersonation, or prohibited paid search activity.
Renewals, upgrades, add-ons, taxes, setup fees, domain registry premium fees, third-party pass-through charges, or non-commissionable services unless expressly listed as commissionable in Awin.
Orders from existing customers, reseller accounts, wholesale accounts, enterprise contracts, offline orders, manually created invoices, or orders not tracked through Awin unless TEMOK.com approves them in writing.

TEMOK.com reserves the right to validate, decline, adjust, reverse, or withhold commission where a transaction does not meet Program rules, Awin rules, or fraud and abuse checks. Commission rates, eligible products, cookie periods, and validation windows are controlled through Awin and may be updated in accordance with the applicable notice requirements.

6. Payment

Tracking, validation, reporting, and publisher payment are handled through Awin according to Awin's applicable publisher payment processes and platform terms. TEMOK.com validates eligible transactions in Awin. Affiliates are responsible for maintaining their Awin account, payment details, tax information, and compliance documents so that Awin can process any approved payments.

7. Permitted Promotional Methods

Subject to the restrictions in these Terms, approved affiliates may promote TEMOK.com through:

Content websites, blogs, comparison articles, reviews, tutorials, hosting guides, and technology resource pages.
Approved coupon, deal, loyalty, cashback, and rewards websites where the affiliate clearly follows the coupon and cashback rules below.
Email marketing to opted-in subscribers where the affiliate complies with all applicable anti-spam, privacy, and consent laws.
Social media, video platforms, newsletters, communities, and paid placements that are transparent, lawful, and not misleading.
Other promotional methods disclosed to and approved by TEMOK.com or allowed under the affiliate's Awin publisher profile.

8. Paid Search, Trademark, and Brand Bidding Rules

Affiliates are not permitted to bid on, purchase, target, or otherwise use TEMOK.com brand terms in paid search, paid social, display advertising, shopping ads, retargeting, or similar paid media without prior written approval from TEMOK.com.

Restricted brand terms include, without limitation:

TEMOK, TEMOK.com, www.temok.com, Temok hosting, Temok coupon, Temok promo code, Temok VPS, Temok dedicated server, Temok cloud hosting, and any misspellings, variations, hyphenations, capitalizations, or confusingly similar terms.
Combinations of TEMOK.com brand terms with coupon, discount, promo, review, hosting, cloud, VPS, dedicated server, AI Hosting, Acronis, or similar commercial intent keywords.

Affiliates must not:

Direct link paid advertisements to TEMOK.com using Awin links unless TEMOK.com gives written approval.
Use TEMOK.com brand terms in ad titles, ad copy, display URLs, final URLs, path fields, sitelinks, callouts, or extensions in a way that implies the affiliate is TEMOK.com.
Imitate, replace, outrank, or hijack TEMOK.com's own ads or mislead users into believing an affiliate advertisement is an official TEMOK.com advertisement.
Use negative or misleading advertising against TEMOK.com, its services, or its competitors to generate affiliate commission.

9. Coupon, Voucher, Deal, and Cashback Rules

Affiliates may promote only coupon codes, vouchers, deals, or promotions that are issued by TEMOK.com, listed in Awin, or provided directly to the affiliate in writing by TEMOK.com. Affiliates must remove expired, inaccurate, unauthorized, or misleading offers immediately when requested.

The following coupon and deal practices are prohibited:

Publishing fake, expired, guessed, scraped, leaked, private, customer-specific, employee-only, or unauthorized coupon codes.
Claiming that a discount is exclusive, verified, guaranteed, or the best available unless TEMOK.com has approved that claim in writing.
Using click-to-reveal, false scarcity, misleading countdowns, or forced-click mechanics that set tracking cookies before the customer has made a genuine click decision.
Promoting codes assigned to another affiliate, campaign, influencer, partner, customer, or channel unless TEMOK.com authorizes such use.

Cashback, loyalty, reward, and incentive affiliates must clearly disclose the nature of the incentive to users and must not encourage fraudulent orders, cancellations, chargebacks, self-referrals, or artificial transactions. TEMOK.com may decline commission where a cashback or incentive transaction is cancelled, refunded, unpaid, fraudulent, or otherwise invalid.

10. Content, Claims, and Disclosure Requirements

Affiliates must ensure that all statements about TEMOK.com, its products, pricing, promotions, features, uptime, support, security, backups, AI Hosting, Acronis Cyber Protect Cloud, cloud hosting, VPS hosting, dedicated servers, and domain services are accurate, current, and not misleading.

Affiliates must not:

Make unsupported claims about guaranteed income, guaranteed uptime, security, ranking improvements, unlimited resources, data recovery, legal compliance, or business outcomes.
Use TEMOK.com logos, trademarks, screenshots, pricing, customer reviews, awards, or service descriptions in a misleading or outdated manner.
Create fake reviews, fake testimonials, fake comparisons, fake scarcity, fake endorsements, or content that suggests TEMOK.com has approved the affiliate's content when it has not.
Fail to include legally required affiliate disclosures, sponsored-content notices, advertising labels, or material connection disclosures.

11. Email, Messaging, and Community Promotion

Affiliates may promote TEMOK.com by email, messaging, or community posts only where the recipient has lawfully opted in or where the channel clearly permits commercial messages. Affiliates must comply with all applicable anti-spam, privacy, data protection, and advertising laws, including unsubscribe and sender identification requirements.

Unsolicited commercial email, bulk spam, scraped lists, purchased lists, misleading sender identities, deceptive subject lines, unauthorized newsgroup/forum posting, and automated community spam are prohibited and may result in immediate removal from the Program and reversal of unpaid commission.

12. Software, Browser Extensions, and Technical Restrictions

Affiliates may not use applications, browser extensions, adware, malware, spyware, toolbars, shopping assistants, pop-ups, pop-unders, hidden frames, automatic redirects, cookie stuffing, link interception, forced clicks, or similar technologies that overwrite, intercept, replace, or manipulate affiliate tracking without a clear user-initiated click.

Affiliates may not place TEMOK.com pages in hidden iframes, open TEMOK.com pages automatically, intercept search engine traffic, replace another affiliate's tracking, or interfere with Awin tracking, TEMOK.com tracking, customer navigation, or another publisher's valid referral.

13. Sub-Affiliates and Networks

Affiliates using sub-affiliate networks, influencer networks, media buying partners, agencies, or subcontractors are responsible for all activity generated by those parties. TEMOK.com may require disclosure of sub-affiliate sources, traffic details, referring URLs, campaign screenshots, or other evidence needed to verify compliance.

TEMOK.com may decline transactions, suspend activity, or remove an affiliate where sub-affiliate traffic is undisclosed, unverifiable, non-compliant, fraudulent, or harmful to the TEMOK.com brand.

14. Intellectual Property and License

TEMOK.com grants approved affiliates a limited, non-exclusive, non-transferable, revocable license to use approved TEMOK.com links, logos, banners, trademarks, and creative materials solely for lawful participation in the Program. Affiliates may use TEMOK.com brand assets only as provided through Awin or approved by TEMOK.com in writing.

Affiliates must not register domain names, social handles, apps, paid search accounts, advertising accounts, or business names that contain TEMOK.com trademarks, confusingly similar names, or misspellings. All goodwill arising from use of TEMOK.com marks belongs exclusively to TEMOK.com.

15. Monitoring, Validation, and Audit Rights

TEMOK.com may monitor affiliate websites, ads, content, traffic sources, coupon activity, order quality, cancellation rates, refund rates, chargeback rates, and other Program activity to verify compliance. Affiliates must provide reasonable information requested by TEMOK.com or Awin to investigate compliance, fraud, attribution, or transaction quality.

Failure to respond to a compliance request, removal request, audit request, or fraud investigation may result in suspension, removal from the Program, or reversal of pending commission.

16. Termination and Suspension

Either party may end participation in the Program at any time by written notice or through the Awin platform. TEMOK.com may immediately suspend or terminate an affiliate for fraud, abuse, prohibited advertising, brand misuse, illegal activity, policy violations, non-response to compliance requests, or conduct that may harm TEMOK.com, customers, partners, or the Awin network.

Upon termination, the affiliate must immediately stop using TEMOK.com links, creatives, logos, coupon codes, trademarks, and promotional materials. TEMOK.com may decline unpaid commission connected to fraudulent, non-compliant, invalid, or post-termination activity.

17. Changes to Program Terms

TEMOK.com may update these Terms, commission rates, eligible products, promotional rules, validation rules, or Program policies from time to time. Where Awin requires notice for changes, TEMOK.com will provide notice through Awin or another appropriate communication channel. Continued participation after the effective date of a change means the affiliate accepts the updated terms.

18. Confidentiality

Non-public business, technical, financial, customer, commission, conversion, fraud, account, or Program information disclosed by TEMOK.com or Awin must be treated as confidential unless it is already public through no fault of the affiliate. Affiliates must not disclose confidential information without written permission.

19. Compliance with Laws

Affiliates are responsible for complying with all laws, regulations, platform policies, advertising rules, tax requirements, privacy laws, data protection rules, consumer protection rules, and disclosure requirements that apply to their promotional activity and location. This includes any rules related to affiliate disclosures, email consent, cookies, tracking, paid advertising, reviews, endorsements, and personal data.

20. Disclaimers and Limitation of Liability

TEMOK.com makes no guarantee that the Program, Awin tracking, TEMOK.com websites, products, services, links, creatives, or promotional materials will be uninterrupted, error-free, or available at all times. To the fullest extent permitted by law, TEMOK.com is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of revenue, profits, data, goodwill, or business opportunity.

To the fullest extent permitted by law, TEMOK.com's cumulative liability related to the Program will not exceed the total approved commission paid to the affiliate under the Program during the period giving rise to the claim.

21. Indemnification

The affiliate agrees to indemnify and hold harmless TEMOK.com, its affiliates, directors, officers, employees, agents, shareholders, partners, members, and representatives from any claims, losses, liabilities, damages, settlements, costs, and expenses, including reasonable attorneys' fees, arising from the affiliate's promotional activity, website, content, traffic sources, legal violations, intellectual property violations, data privacy violations, breach of these Terms, or misuse of TEMOK.com or Awin systems.

22. Independent Contractor Relationship

Affiliates are independent contractors. Nothing in these Terms creates an employment, agency, partnership, franchise, joint venture, sales representative, or exclusive relationship between the affiliate and TEMOK.com. Affiliates have no authority to make offers, warranties, commitments, refunds, discounts, service promises, or representations on behalf of TEMOK.com unless TEMOK.com gives written authorization.

23. Governing Law and General Terms

These Terms are governed by the laws stated in TEMOK.com's applicable merchant, advertiser, or service agreements, unless another governing law is required by applicable law or agreed in writing. If any provision is held invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision will be limited or modified to the minimum extent necessary to preserve the intent of the Terms.

These Terms, together with Awin's applicable platform terms and any Program details published in Awin, represent the Program rules for TEMOK.com affiliates and replace prior ShareASale-specific affiliate program wording for purposes of the TEMOK.com Awin program.
