This document constitutes the complete Affiliate Program Agreement ("Agreement") for participation in the ECBlend Affiliate Program offered exclusively through the Awin Network. This Agreement applies solely to activities conducted via www.ECBlendFlavors.com and does not cover links or activities outside this domain. To enroll, Affiliates must be at least 21 years of age. ECBlend reserves the right to review all applications and may accept or reject any application at its sole discretion. If an application is rejected, the applicant may reapply after ensuring their website complies with the requirements outlined below.
All Affiliates representing ECBlend must adhere to this Agreement. Non-compliance will result in immediate termination from the Program. Affiliates must also comply with applicable laws and regulations, including but not limited to U.S. Food and Drug Administration (FDA) regulations, U.S. Federal Trade Commission (FTC) regulations, and the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising ("FTC Endorsement Guides"). Violations of these regulations may result in liability for both the Affiliate and ECBlend. Affiliates must also adhere to federal and state copyright and trademark laws.
Eligibility Requirements
To be eligible for the ECBlend Affiliate Program, your website must:
Possess a top-level domain name.
Be fully operational, with no "under construction" pages.
Maintain a professional and aesthetically pleasing design, free of excessive affiliate links or banner farms.
Be marketed exclusively to individuals aged 21 and older.
Prohibited Websites and Activities
Applications from the following types of websites or Affiliates will be rejected:
Sites containing adult content, pornography, or links to such material.
Sites with explicit, vulgar, or obscene language.
Sites promoting racial, ethnic, political, hate-mongering, or otherwise objectionable content.
Sites promoting illegal activities, including but not limited to online gambling, instructions for building explosives, counterfeiting, or illegal drug use.
Sites engaging in software piracy, password sharing, or other illegal activities.
Sites using browser helper objects, software generating automatic clicks, pop-ups on third-party sites, or unauthorized tracking methods.
Sites that automatically redirect users to another website.
Sites sending unsolicited emails (spam).
Sites with questionable or controversial content are deemed inappropriate by ECBlend.
Sites offering incentives (e.g., cash, points, prizes) to encourage clicks on ads or links.
Sites participating in traffic exchanges or similar programs.
Sites with software downloads that could divert commissions from other Affiliates, as determined by ECBlend.
Linking and Intellectual Property Rights
Upon approval, ECBlend grants Affiliates a revocable, non-exclusive, non-transferable, limited license to use ECBlend’s name, logo, URL, and trademarks solely for promoting the Affiliate Program on their website. All rights, title, and interest in ECBlend’s intellectual property remain with ECBlend. Affiliates may not modify any provided banners or images. Affiliates are responsible for ensuring all linking code and promotional materials comply with this Agreement and are subject to ECBlend’s approval.
ECBlend monitors Affiliate traffic and websites for compliance. Non-compliant Affiliates may be notified via email, and their account may be deactivated pending investigation. Affiliates are responsible for maintaining compliance with this Agreement.
Affiliates must not:
Use automated methods or "bots" to enroll or participate in the Program.
Engage in activities that diminish or tarnish ECBlend’s reputation or brand.
Use ECBlend’s name, logo, URL, or trademarks in a disparaging or negative manner.
Issue press releases or make representations about ECBlend or its products without prior written approval.
Frame the www.ECBlendFlavors.com website without prior written approval.
Copy or spider content from www.ECBlendFlavors.com for use on their site.
Design their site to resemble www.ECBlendFlavors.com or imply they are ECBlend.
Affiliates may only use promotional materials provided through the Awin Network. Sending unsolicited emails (spam) containing ECBlend links or content, or posting specific promotional messages in newsgroups, chat rooms, or bulletin boards without prior written approval, is prohibited. Generic posts that do not mention specific ECBlend offers are permitted, provided they comply with this Agreement.
Fraudulent activities, such as generating fake leads or clicks, forced clicks, or cookie stuffing, will result in immediate termination and forfeiture of all commissions. Affiliates bear the burden of proving they are not engaging in fraudulent activity. Payments may be held in "Pending Status" until compliance is verified. Termination notices will be sent via email and take effect immediately.
Advertising Content, Materials, and Standards
All advertising and promotional materials, including but not limited to internet content, social media posts, email marketing, billboards, and radio/TV advertisements, must comply with the following guidelines:
Nicotine Addiction Warning
All advertisements, including those with visual components (e.g., websites, social media posts, emails), must include the FDA-required nicotine addiction warning: "WARNING: This product contains nicotine. Nicotine is an addictive chemical."
The warning must appear in a rectangular box occupying at least 20% of the advertisement’s area, placed at the top of the advertisement or post.
The warning statement must be centered within the box, aligned with the orientation of other text in the advertisement, and fill the designated warning area appropriately.
Prohibited Advertising Practices
No Smoking Cessation Claims: Affiliates may not market ECBlend products as smoking cessation aids or suggest they help quit smoking.
No Health or Safety Claims: Affiliates may not claim ECBlend products are safe, healthy, or free of secondhand health effects.
No Modified Risk Claims: Affiliates may not market ECBlend products as "light," "low," "mild," ash-free, smoke-free, tar-free, less harmful, or containing reduced/zero harmful ingredients.
No Marketing to Minors: No marketing channel may be used if more than 15% of its audience consists of individuals under 21.
No Improper Trademark Use: Affiliates may not use ECBlend’s trademarks, modified or otherwise, or mimic trademarks/tradenames of products marketed to minors.
No Health Professional Endorsements: Affiliates may not use health professionals to endorse ECBlend products.
Adult-Targeted Marketing: All promotional materials must be tailored to adults, using personalization strategies relevant to adult audiences.
Model and Depiction Guidelines:
Use models who appear at least 27 years old and reflect the attributes, beliefs, and interests of adult vapers (e.g., vaping privately while engaging in adult activities like reading or browsing the internet).
Depict realistic, relatable situations without appealing to youth.
Prohibited Imagery:
Avoid childish images, cartoons, mascots, or designs that appeal to minors.
Do not imitate packaging of youth-oriented products (e.g., cereal, soda) or feature kid-friendly characters (e.g., unicorns).
When using images for food-flavored products, include an upper banner stating: "Images are for reference only – Product is E-liquid." Avoid images of food products targeted at youth (e.g., candy, children’s cereal).
Pay-Per-Click (PPC) Advertising
Affiliates may not bid on ECBlend, ECBlend Flavors, or related e-liquid/e-cigarette keywords in PPC advertising on Google, Yahoo, Bing, or similar platforms without prior written permission from ECBlend.
Commissions
Affiliates earn a 20% commission on eligible sales of E-Liquid through the Awin Program, provided:
The sale is made by a customer who used the Affiliate’s link and has not previously ordered from ECBlend.
The order is paid in full and not canceled, fraudulent, charged back, returned, or subject to taxes/shipping fees.
The sale occurs within the 30-day cookie life, unless the customer clicks another Affiliate’s link or an ECBlend advertisement.
Commissions are calculated and paid monthly by Awin for qualifying sales from the previous month. ECBlend is not responsible for direct payment of commissions or resolving disputes related to commission calculations, which must be addressed with Awin. Commission rates may change at ECBlend’s discretion, with reasonable efforts to notify Affiliates.
Affiliates are responsible for all costs, expenses, taxes, fees, or charges incurred in connection with their participation in the Program. ECBlend reserves the right to deduct commissions for fraudulent or miscalculated sales. Commissions are only payable for trackable referrals using the Affiliate’s ID, and tracking requires customer acceptance of cookies.
Coupon Policy
Affiliates may only promote coupons and promotions provided through Awin. Coupon codes or promotions must be displayed on the Affiliate’s site, and "Click to Reveal" methods or implications of discounts for clicking links are prohibited.
Term and Termination
Either party may terminate this Agreement at any time with written notice. ECBlend will notify Affiliates via email, and Affiliates are responsible for providing a valid email address. Upon termination due to non-compliance or objectionable content, outstanding commissions will not be paid. Affiliates must remove all ECBlend content from their websites and accounts upon termination.
Agreement Modifications
ECBlend may modify this Agreement at its discretion. Updated terms or notices will be posted on the Awin platform, and continued participation 48 hours after such changes constitutes acceptance of the new terms. Affiliates who disagree with modified terms may terminate the Agreement as outlined above.
Affiliate Responsibilities
Affiliates guarantee that all content, products, and services on their website are legal and that they own or have the right to use any copyrighted material. Affiliates agree to indemnify and hold harmless ECBlend, its employees, agents, and affiliates from any claims, losses, or liabilities arising from the Affiliate’s website, including copyright, slander, libel, or trademark violations.
All confidential information disclosed during the term of this Agreement remains the property of the disclosing party and may not be used or disclosed without written permission. Affiliates are independent contractors, and this Agreement does not establish a partnership, joint venture, franchise, or employment relationship with ECBlend.
ECBlend, its affiliates, agents, or employees are not liable for any direct, indirect, incidental, special, punitive, or consequential damages related to the Program. Any liability under this Agreement shall not exceed the total unpaid fees at the time of any error or omission.
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions remain in effect.
