AFFILIATE COMPLIANCE AGREEMENT
This Affiliate Compliance Agreement (the "Agreement") is made by and between Ellisi Gifts ("ellisigifts.com"), and you, as an Affiliate utilizing the Awin service ("You", "Your", "Affiliate").
You must agree to abide by the terms and conditions contained in this Agreement in order to be an Ellisi Gifts affiliate. Please read this Agreement carefully before applying for and becoming an affiliate of Ellisi Gifts. By becoming an Ellisi Gifts affiliate, you indicate Your acceptance of this Agreement and its terms and conditions.
Affiliate Service Agreement
You must agree to abide by the terms and conditions contained in the Affiliate Service Agreement, which is made by and between Awin, and you, as an Affiliate utilizing the Awin service ("You", "Your", "Affiliate").
PPC Compliance (Pay Per Click)
Unless otherwise noted, all brands related to Ellisi Gifts, including but not limited to trademarks, company name, domain names, etc., are the property of Ellisi Gifts and protected by U.S. and international copyright laws and trademark laws, any using and brand bidding (including but not limited to bidding on "Keyword" and "Ad Text") are strictly prohibited. Any and all brand bidding (trademarks, company name, domain names – and any variant spellings and misspellings) must get the permission and authorization from Ellisi Gifts.
Coupon Compliance
Unless otherwise noted, coupon PPC bids (including not limited to the words such as "Your Brand Coupons", "Brand Coupons", "Your Coupons of Brand", "Coupons of Brand", and any variant spellings and misspellings. Brand is all brands related to Ellisi Gifts including but not limited to trademarks, company name, domain names, etc.) are strictly prohibited. Any and all coupon brand bidding (including not limited to the words such as "Your Brand Coupons", "Brand Coupons", "Your Coupons of Brand", "Coupons of Brand", and any variant spellings and misspellings. Brand is all brands related to Ellisi Gifts including but not limited to trademarks, company name, domain names, etc.) must get the permission and authorization from Ellisi Gifts.
It is disallowed that an Affiliate to utilize SEO tactics centered around Brand name (including not limited to the words such as "Your Brand Coupons", "Brand Coupons", "Your Coupons of Brand", "Coupons of Brand", and any variant spellings and misspellings. Brand is all brands related to Ellisi Gifts including but not limited to trademarks, company name, domain names, etc.). Any and all SEO tactics centered around Brand name (including not limited to the words such as "Your Brand Coupons", "Brand Coupons", "Your Coupons of Brand", "Coupons of Brand", and any variant spellings and misspellings. Brand is all brands related to Ellisi Gifts including but not limited to trademarks, company name, domain names, etc.) must get the permission and authorization from Ellisi Gifts.
In the case that one Affiliate sends the traffic, such as a blog or product review, but the consumer they sent goes off to find a coupon and use a coupon code, that means the sale doesn't originate at a coupon site, thus the commission will be given to the blogger.
It's allowed that a coupon site to utilize common tactics such as a "Click to Reveal Coupon Code" strategy, designed to drive up clicks on their ads for our Brand (Brand is all brands related to Ellisi Gifts including but not limited to trademarks, company name, domain names, etc.). We reserve the right to make changes to this compliance at any time.
Sales Tax and Government Regulation
New York State, in 2008, enacted a law saying that any online retailer, regardless of location (in the United States) was required to collect sales tax on all purchases to New York consumers if they had Affiliate Marketers operating in New York. Since that time, anywhere from 10-15 States have enacted similar laws. We don't accept the affiliates from certain states who have passed this law (Such as New York, North Carolina, etc…)
