This Affiliate Agreement("Agreement") contains the complete terms and conditions betweenus, RadioFence.com and you, regarding your applicationto participate as an affiliate of RadioFence.com("Affiliate"), and the establishment of links from your websiteto our website, "RadioFence.com" Execution byyou of this Agreement as set forth below constitutes your acceptance ofthe terms and conditions of this Agreement, and will be a legally bindingagreement between you and us.
Affiliate Program Enrollment. To become a participant in RadioFence.com's Affiliate Program, you will have to submit a complete Affiliate Program Application via our website or one of our partners. We will evaluate your application and notify you of your acceptance or rejection.We may reject your application if we determine, in our sole discretion, that your website is not suitable for the Affiliate Program for any reason, including, but not limited to, inclusion of content that is in any way unlawful, harmful, threatening,defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable, which by way of example only, contains (i) sexually explicit, pornographic or obscene content (whether in text or graphics), (ii) speech or images that are offensive, profane,hateful, threatening, harmful, defamatory, libelous, harassing or discriminatory (whether based on race, ethnicity, creed, religion, gender, sexual orientation, physical disability or otherwise), (iii) graphic violence (which may include certain types of gamesites), (iv) content related to liquor, tobacco, firearms, drugs, gambling, crime or death, (v) politically sensitive or controversial issues (e.g. abortion, capital punishment) or other political content (e.g. lobbyists, political campaigns) or (vi) anyunlawful behavior or conduct. If we reject your application, you are welcome to reapply to the Affiliate Program at any time, provided, you alter your website to delete all offending content.Setting Up Links. We will make available to you banneradvertisements and text links to our website containing the RadioFence.com logo and wordsidentifying RadioFence.com ("Links") which youmay display on your website, provided you abide by the terms andconditions of this Agreement. In using the Links, you agree that you willcooperate fully with us in order to establish and maintain such Links. AllAffiliate websites shall display such graphic images prominentlythroughout your websites as you see fit and with our consent. A Link mayonly be modified and/or expanded with our consent. Each Link connectingusers of your website to our website, will in no way alter the look,feel or functionality of our website. We have the right, in our solediscretion, to monitor your website at any time and from time to time todetermine if you are in compliance with the terms of this Agreement.Order Processing. We will process orders placed bycustomers who follow the Links from your website to the RadioFence.comwebsite. We reserve the right, in our sole discretion, to reject ordersthat do not comply with certain requirements which we may establish fromtime to time. All aspects of order processing and fulfillment, includingorder entry, customer service, shipping, cancellations, returns andpayment processing will be our responsibility. We will track the amount ofsales generated by your website and will make this information availableto you. To permit accurate tracking, reporting, andfee accrual, you must ensure that the Links between your website and ourwebsite are properly formatted.Commissions. We will pay you a commission equal to four(4%) for customer purchases (the "Commission Rate") of theNet Sales to us by users of your website who purchase products on our website, utilizing the Links between your website and ours, for productswhich we ship to such customer and for which we have received fullpayment. Net Sales shall include those amounts received by us for the saleof products less amounts collected by us for sales, use or other taxes,duties, shipping, handling, gift wrapping and similar charges. Acommission will only be paid if the visitor to our website is tracked bythe system from the time of the Link to the time of the sale.PPC (Pay Per Click Advertising). Affiliates MAY NOT bid on RadioFence.com trademark terms (listed below) on any search engine including, but not limited to: Google, Yahoo, Bing and MSN including international versions. Affiliates MAY NOT use www.RadioFence.com or any version of our URL in the display URL at any PPC search engine. Alternative spellings of our domain name are not permitted as well including but not limited to www.RadioFence.net, www.RadioFence.org, etc. Coupon Codes: Affiliates MAY NOT use any Coupon Codes except those expressly provided to the affiliate by RadioFence.com. Only coupon codes or "deals" supplies in our ShareASale account will be valid. Any Affiliate using any other coupon codes or deals will not be eligible for commissions on sales using these codes or on any subsequent sales.Trademark Terms. radiofence, radio fence, radiofence.com, radiofence com, petsafe, petsafe.com. petsafe.net
