Terms and Restrictions:
1. Brand Term Bidding: We do not allow bidding on the terms EMS, EMS.com, Eastern Mountain Sports, or related derivatives or misspellings that imply a customer query for the Eastern Mountain Sports business and/or web site.
2. Restrictions specific to Affiliate Advertisement of products from The North Face:
Your site representation:
An Affiliate must not state or imply that it has a direct relationship with The North Face.
You may not:
(a) use The North Face trademarks or product names in your URL,
(b) use The North Face trademarks, copyrighted images, graphics or text, or
(c) otherwise represents that your site is directly associated with The North Face.
(d) copy or resemble the look and feel of thenorthface.com.
Paid Search / PPC Bidding:
Affiliates must not bid on, purchase or use the search terms "The North Face",
"thenorthface.com", "North Face", "Northface", or other trademarks, product names (e.g., Denali, Nuptse) or any misspelling or variant thereof on websites, search engines, search portals, or like websites.
Pricing: All Affiliates must update Product price and inventory data at least once a week. Redirects:
The customer must be redirected to EMS.com to make final purchase of the merchandise.
Affiliates must not overuse or keyword stuff Eastern Mountain Sports (EMS) trademarks, name brands, domain names and variations for SEO purposes.
This includes the Eastern Mountain Sports name in the meta tags on your Website, excessive use of the Eastern Mountain Sports name on your Website for the purposes of advanced placement in organic search.
Affiliates are not permitted to bid on or use any Trademark, Domain or Variations of the Eastern Mountain Sports name or brand with their pay per click (PPC) search string. This applies, but is not limited, to the following Eastern Mountain trademarks and brand names and variations of the following: Eeastern Mountain Sports, EMS, ems.com.
Affiliates are, however, allowed to perform direct to merchant (DTM) PPC marketing as long as they follow the trademark and brand bidding rules.
Software and BHOs: We do not permit any Browser Helper Object affiliates or affiliates who use software which overwrites or sets cookies without a click from the end user. If the affiliate wishes to join the EMS program, they must remove cookies being set by software as well as only set cookies directly from people clicking on their website, email, PPC or other non software, downloadable and toolbar marketing methods.
Gift Card Addendum:
Any transaction with a gift card or gift certificate sale that was paid for using a gift card or gift certificate will not be a commissionable transaction. Any commission paid as a result of this type of transaction will be reversed by the Merchant.
Additional Guidelines:
Eastern Mountain Sports does not allow commissions to be paid on wholesale orders.
We reserve the right to remove any publisher from our program or adjust commissions at our sole discretion if we find any publisher activities or content to go against Eastern Mountain Sports brand guidelines.
Publishers who violate our Terms & Conditions risk removal from our program.
We do value our affiliate relationships and always encourage our partners to reach out to us about any questions, concerns or optimization opportunities.
