FinalPress Affiliate Program Terms and Conditions1. Agreement Overview
By participating in the FinalPress Affiliate Program ("Program"), you ("Affiliate") agree to be bound by these terms and conditions ("Terms"). FinalPress reserves the right to modify these Terms at any time.
2. Enrollment and Eligibility
2.1. Enrollment in the Program is subject to approval by FinalPress.
2.2. Affiliates must be at least 18 years old and have a valid website or social media presence.
2.3. FinalPress reserves the right to reject any application or terminate any affiliate relationship at its sole discretion.
3. Commission Structure
3.1. Affiliates will earn a 15% commission on all qualifying sales.
3.2. Commissions are earned only on completed sales that are not later cancelled or returned.
3.3. The cookie duration for tracking sales is 30 days.
4. Payment Terms
4.1. Payments will be made through AWIN's payment system.
4.2. The minimum payout threshold is $50.
4.3. Payments will be made within 30 days after the end of each calendar month.
5. Affiliate Responsibilities
5.1. Affiliates must comply with all applicable laws and regulations, including those governing advertising and marketing.
5.2. Affiliates must not engage in any deceptive or misleading practices.
5.3. Affiliates must not bid on FinalPress trademarks in search engine advertising.
5.4. Affiliates must clearly disclose their affiliate relationship with FinalPress in accordance with FTC guidelines.
6. Prohibited Activities
Affiliates are prohibited from:
6.1. Using any spam or unauthorized advertising methods.
6.2. Offering rebates, coupons, or other forms of promised kickbacks from your commission without our prior written consent.
6.3. Attempting to artificially inflate commissions through any means, including click fraud or cookie stuffing.
6.4. Promoting FinalPress on any website that contains libelous, defamatory, obscene, illegal, or otherwise offensive content.
7. Intellectual Property
7.1. FinalPress grants Affiliates a limited, non-exclusive right to use FinalPress trademarks and materials solely for the promotion of FinalPress products through the Program.
7.2. Affiliates must not modify FinalPress materials without prior written consent.
8. Termination
8.1. Either party may terminate this agreement at any time, with or without cause.
8.2. Upon termination, the Affiliate must remove all FinalPress links and materials from their website.
8.3. FinalPress reserves the right to withhold final payment for up to 90 days to ensure all transactions are finalized.
9. Limitation of Liability
FinalPress shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from participation in the Program.
10. Indemnification
Affiliate agrees to indemnify and hold FinalPress harmless from any claim, damage, or loss incurred as a result of Affiliate's breach of these Terms or participation in the Program.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
12. Modifications
FinalPress reserves the right to modify any of the terms and conditions contained in this Agreement at any time and in our sole discretion. Modifications may include, but are not limited to, changes in the payment procedures and FinalPress's Affiliate Program rules. If any modification is unacceptable to you, your only option is to terminate your participation in the Program. Your continued participation in the Program following the posting of the change notice or new Agreement on our site will indicate your agreement to the changes.
By participating in the FinalPress Affiliate Program, you acknowledge that you have read these Terms and agree to be bound by them.
