Spinfire Sport Affiliate Program Terms and Conditions
1. AGREEMENT OVERVIEW
These Affiliate Program Terms and Conditions (“Agreement”) apply to your participation in the Spinfire Sport Affiliate Program (“Program”), operated via the Awin network. By joining the Program, you (“Affiliate”, “Publisher”) agree to comply with the terms set out in this Agreement.
2. PROGRAM ELIGIBILITY AND RESTRICTIONS
2.1 Eligible Sales
Commissions are payable only on sales that are: Made via www.spinfiresport.com, and Successfully tracked through valid affiliate links. Sales via other websites, platforms, or sales channels are not eligible. Tracking must begin and conclude on www.spinfiresport.com.
2.2 Geographic Limitations
Spinfire Sport only processes online orders from countries not served by exclusive distributors. Commissions are not payable on sales: Originating from, or shipping to, countries where Spinfire Sport has an official distributor. Where checkout has been blocked due to territorial restrictions. Currently, this includes (but is not limited to) the United States, much of Europe, and other specific regions. Affiliates are encouraged to refer only traffic from eligible countries. Contact us for a list of supported countries.
3. COMMISSION STRUCTURE
3.1 Commissionable Value
Commission is calculated on the net product price excluding: GST and all taxes, Shipping or delivery costs, Payment processing or credit card fees, Gift wrapping or insurance fees, Any service or handling charges.
3.2 Commission Validation Period
All commissions are subject to a 30-day validation period after order date. Commission is approved only after: Successful payment has been received, and The return period has expired without cancellation or return. High-value orders may be subject to extended validation at our discretion. 3.3 Non-Commissionable Transactions
No commission will be paid on: Orders that are cancelled prior to fulfillment, Full or partial returns, Re-purchases of previously returned items by the same customer, Gift cards or vouchers, Purchases using staff discount codes, Employee or internal purchases, Duplicate or fraudulent orders, Orders shipped to restricted regions, Sales not tracked through www.spinfiresport.com.
4. PROHIBITED PROMOTIONAL ACTIVITIES
4.1 Paid Search and PPC Restrictions
Affiliates must not: Bid on “Spinfire”, “Spinfire Sport”, “spinfiresport.com” or misspellings, Use our brand name in ad copy, display URLs, or titles, Directly link paid search ads to www.spinfiresport.com, Bid on our product brand names or trademarks, Engage in tactics that cause brand confusion.
4.2 Content and Behaviour Restrictions
Affiliates must not: Replicate or closely mimic the look or feel of www.spinfiresport.com, Make false or misleading claims about our products, Publish content in breach of Australian Consumer Law, Use forced clicks, cookie stuffing, or browser hijacking, Promote through unsolicited emails or spam, Operate cashback or reward sites without prior approval.
5. COMMISSION DISQUALIFICATION CRITERIA
We reserve the right to reject or reverse commissions if any of the following occur: Order is cancelled or payment fails, Order is returned in part or full, Re-purchase of previously returned item by same customer, Purchase violates territorial restrictions, Order made using invalid or unauthorised promo codes, Duplicate, fraudulent, or self-referral purchases, Breach of any clause in this Agreement.
6. TRADEMARK AND BRAND USAGE
All Spinfire Sport trademarks, logos, and brand assets remain our exclusive property. A limited license is granted to Affiliates for use in approved promotional activities only. Domain names containing “Spinfire” or close variants are strictly prohibited. Affiliates must use only approved,
up-to-date creative assets. Website screenshots must be unaltered and current.
7. LEGAL AND REGULATORY COMPLIANCE
7.1 Obligations
Affiliates must comply with: Australian Consumer Law, ACCC advertising and promotional guidelines, The Privacy Act 1988 (Cth) and the Australian Privacy Principles, The Spam Act 2003, Any other applicable federal, state or international law.
7.2 Disclosure Requirements
Affiliates must: Clearly disclose their affiliate relationship when promoting our products, Include disclosures like “Ad”, “Sponsored”, or “Affiliate Link” where required, Avoid making unsubstantiated health, performance, or therapeutic claims.
8. COOKIE POLICY
Cookie validity: 30 days from last click. Attribution model: Last click wins. Affiliates must not artificially manipulate or extend cookies.
9. PAYMENT TERMS
All payments are processed via the Awin network. Minimum payout thresholds apply as per Awin’s policies. Commissions are paid in AUD unless otherwise agreed. Affiliates are responsible for their own tax reporting obligations.
10. TERMINATION
Spinfire Sport may terminate an affiliate’s participation immediately for: Breach of any clause in this Agreement, Illegal, deceptive, or fraudulent activity, Activity that harms Spinfire Sport’s brand or reputation, 6 months of consecutive inactivity. Either party may terminate participation with 7 days written notice via Awin.
11. LIMITATION OF LIABILITY
Spinfire Sport’s maximum liability under this Program is limited to unpaid, validated commissions at the time of claim. We are not liable for indirect, consequential, or punitive damages. We make no guarantees of uninterrupted tracking, reporting, or uptime.
12. MODIFICATIONS
We reserve the right to modify these Terms and Conditions at any time with 14 days’ notice via Awin. Continued participation after the notice period constitutes acceptance of the revised terms.
13. ENTIRE AGREEMENT
This Agreement, in conjunction with Awin’s terms, constitutes the entire understanding between the parties and supersedes all prior proposals, representations, or communications.
14. GOVERNING LAW
This Agreement is governed by the laws of Victoria, Australia. All disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
