Penguin CBD Affiliate Terms & ConditionsA Guide for Penguin Affiliates Last Updated: February 3, 2024Please read our affiliate terms and conditions carefully before you join our program or begin marketing of our program. These terms and conditions are written in plain terms intentionally avoiding legalese to ensure that they may be clearly understood and followed by affiliates. Adherence to the terms and conditions provides that our Penguin CBD affiliate program is sustainable and beneficial for both Penguin CBD and our affiliates. DEFINITIONSAs used in the below Terms: (i) “We”, “us”, or “our” refers to Penguin CBD; (ii) “you” or “your” refers to the Affiliate; (iii) “our website” refers to the Penguin CBD website located at www.penguincbd.com; (iv) “your website” refers to any websites that you will link to our website; (v) “Program” refers to the Penguin CBD Affiliate Program. “Affiliate” means any Person, including but not limited to any third-party marketer, who participates in an Affiliate Program. “Affiliate Network” means any Person who provides another Person with Affiliates for an Affiliate Program or with whom any Person contracts as an Affiliate to promote any product, service, or program. “Affiliate Program” means any arrangement under which any Penguin pays, or offers to pay, or provides, or offers to provide, any form of consideration to any third party, either directly or through an Affiliate Network (a) to provide any Penguin with, or refer to any Penguin, potential or actual customers; or (b) otherwise to market, advertise, or offer for sale any product, service, or program on behalf of Penguin.COMMISSIONS We use advance attribution rules in the Penguin CBD Affiliate Program. Commission levels are based on the type of referral site, new vs existing customer, affiliate partner performance, and volume of sales. If you have questions about commission rates please contact our team. Commissions are subject to change with notice. COUPON GUIDELINESIf you are enrolled in our Program and your Website promotes coupon codes, you must adhere to our Coupon Guidelines as follows: You may ONLY advertise coupon codes that are provided to you through the affiliate program or network. You may NOT advertise coupon codes obtained from our non-affiliate advertising, customer emails, paid search, or any other campaign. Violation of these terms may result in removal from the Penguin CBD affiliate program, reversal of sales, or reduction in commissions.PPC GUIDELINESIf you are enrolled in our Program and participate in PPC advertising, you must adhere to our PPC guidelines as follows: You may not bid on any of our trademarked terms, including any variations or misspellings thereof for search or content based campaigns on Google, Bing, Yahoo or any other network. These trademark terms include Penguin CBD and similar terms without express written permission. You may not use our trademark terms in sequence with any other keyword (e.g “Penguin CBD Coupons”) without express written permission. You may not direct link to our website from any Pay-Per-Click ad or use redirects that yield the same result. Affiliates must be directed to an actual page on your website. You may not use our URL (www.penguincbd.com) as your Display URLIf you automate your PPC campaigns, the responsibility is yours to exclude our trademark terms from your program and we strongly suggest you add our trademarked terms as negative keywords. If you violate these PPC guidelines your current and past commission will be set to 0% without warning. Trademarked Terms: Penguin CBD Violation of these terms may result in removal from the Penguin CBD affiliate program, reversal of sales, or reduction in commissions. SOCIAL MEDIA: Affiliates are not permitted to use TM, TM+terms or any variation or misspelling to create pages or accounts on Facebook/Youtube/Twitter/TikTok, Reddit/Instagram, etc., including but not limited to Penguin CBD DOMAIN NAMES:Use of any of our trademarked terms or misspellings as part of the domain for your website is strictly prohibited. (e.g. www.penguincbd-coupons.com). ADVERTISING & PUBLICITYYou shall not create, publish, distribute, or print any written material that makes reference to our Program without first submitting such material to us and receiving our prior written consent. If you intend to promote our Program via email campaigns, you must adhere to the following:1. Abide by the CAN-SPAM Act of 2003 (Public Law No. 108-187) with respect to our Program. 2. Email must be sent on your behalf and must not imply that the email is being sent on behalf of Penguin CBD. 3. Emails must first be submitted to us for approval prior to being sent. FTC COMPLIANCEYou are required by Penguin CBD to disclose your affiliate relationship on any promotion for this merchant. This includes but is not limited to blog posts, videos, emails, social media and website pages. Your audience must understand you may earn commissions if they click your links. This disclosure statement should be clear and concise, stating that Penguin CBD is compensating you for your review or endorsement. If you received the product for free from Penguin CBD for review, this also must be clearly stated in your disclosure. All affiliate program advertisements must be truthful and not misleading. All affiliate program disclosures must be clear and conspicuous.Do:Place disclosure with the ad message itselfUse simple and clear languageSimple explanations like “Affiliate Relationship with Penguin” are often enough if placed in a way that is hard to miss. So are terms like “advertisement,” “ad,” and “sponsored” including “Penguin Sponsored,” “Penguin Partner,” or “Penguin Affiliate” The disclosure should be in the same language as the endorsement itself If the endorsement is in a picture on a platform like Snapchat and Instagram Stories, superimpose the disclosure over the picture and make sure viewers have enough time to notice and read itIf making an endorsement in a live stream, the disclosure should be repeated periodically so viewers who only see part of the stream will get the disclosureIf making an endorsement in a video, the disclosure should be in the video and not just in the description uploaded with the video.Talk about an experience personally hadAlways use your affiliate code or linkAlways tell your audience how and where to buy Penguin?Don’t:Assume consumers know about the affiliate program and Penguin’s relationship to the affiliate Mix your disclosure into a group of hashtags or linksIf making an endorsement in a video, the disclosure should not be just in the description uploaded with the video.Use vague or confusing terms like “sp,” “spon,” or “collab,” or stand-alone terms like “thanks” or “ambassador,” and stay away from other abbreviations and shorthand.Make up claims about a product that would require proof that Penguin doesn’t have – such as scientific proof that a product can treat a health condition.
