THE PIG Hotels – AWIN Affiliate Programme Terms & Conditions
These Terms & Conditions (“Terms”) set out the legally binding terms under which you, the affiliate (“you”, “your”, “Affiliate”) participate in THE PIG’s affiliate programme through the AWIN network (“Programme”), managed by Home Grown Hotels Ltd (“THE PIG”, “we”, “us”, “our”).
By applying to, and being accepted into the Programme, you agree to comply with these Terms.
1. Programme Overview
1.1 The Programme enables approved affiliates to promote THE PIG Hotels and earn commission on qualifying transactions (as detailed at clause 4.1, below) through the AWIN affiliate marketing platform.
1.2 Participation is open to individuals and businesses with relevant marketing platforms (e.g., websites, blogs, email marketing, social media, etc.).
1.3 Participation in this Programme is subject to approval and ongoing compliance with these Terms and the terms of the AWIN Affiliate Network.
1.4 This Agreement incorporates the terms of the AWIN platform. In case of conflict, our Terms will prevail with respect to your relationship with THE PIG.
2. Eligibility
2.1 Affiliates must apply through AWIN and provide accurate and complete information.
2.2 We reserve the right to reject any application for any reason, including but not limited to:
2.2.1 websites promoting inappropriate, offensive, or misleading content;
2.2.2 lack of a legitimate promotional platform or relevant audience;
2.2.3 previous violations of affiliate programme terms (ours or others').
2.3 Acceptance into the Programme does not imply any exclusive relationship or entitlement to future campaigns.
3. Affiliate Responsibilities
3.1 You must:
3.1.1 Act in good faith and promote THE PIG Hotels and THE PIG brand in a responsible, brand-safe manner, and in accordance with any brand guidelines communicated to you from time to time.
3.1.2 Comply with all disclosure guidelines for affiliate marketing and all applicable laws and regulations (including GDPR, ASA, CAP Code).
3.1.3 Clearly disclose your Affiliate relationship in accordance with UK advertising standards.
3.2 You must not:
3.2.1 Misrepresent our products, prices, or availability.
3.2.2 Use voucher or discount codes not explicitly provided for affiliate use.
3.2.3 Bid on THE PIG brand terms (including misspellings) in PPC/paid search advertising.
3.2.4 Employ any form of automatic cookie dropping, cookie stuffing, forced clicks, or other unethical tracking methods.
3.2.5 Misrepresent your relationship with THE PIG.
4. Commission
4.1 Commission is earned on eligible bookings, defined as:
4.1.1 A valid hotel reservation made through an AWIN-trackable link;
4.1.2 The customer completes the stay;
4.1.3 The booking is not cancelled, refunded, no-showed, or charged back; and
4.1.4 The transaction is not fraudulent or made by the Affiliate.
4.2 Commission structure is detailed within the AWIN interface and may be updated at any time.
4.3 We reserve the right to:
4.3.1 Modify commission rates;
4.3.2 Exclude certain hotels, promotional rates, or booking types from commission eligibility with prior notice via AWIN.
4.4 Transactions are subject to validation and may be reversed in cases of cancellation, fraud, or breach of these Terms.
5. Tracking, Attribution, and Cookie Window
5.1 All referrals are tracked using the AWIN platform’s tracking technologies. It is your responsibility to ensure proper implementation of tracking links.
5.2 The standard cookie duration for tracking is 30 days unless otherwise stated in AWIN.
5.3 In the event of a multi-affiliate referral, the last-click attribution model will apply.
5.4 We are not liable for any failure to track due to:
5.4.1 The user deleting cookies;
5.4.2 Improper implementation of Affiliate links;
5.4.3 Technical errors, browser restrictions, or tracking conflicts.
6. Payments
6.1 Commission will be processed and paid by AWIN in accordance with their payment schedule and policies.
6.2 There is no separate payment mechanism offered by THE PIG.
7. Content and Branding
7.1 We grant you a limited, non-exclusive, revocable license to use our approved marketing assets, including banners, logos, text links, images and other promotional materials provided in the AWIN interface (“Brand Assets”) solely for the purpose of participating in the Affiliate Programme and driving legitimate traffic to our website. You must not:
7.1.1 Modify, adapt, distort or alter any of our Brand Assets without our prior written permission;
7.1.2 Use Brand Assets in a way that implies any official partnership, endorsement, employment, or representation beyond the affiliate relationship;
7.1.3 Create websites or social media profiles that mimic or impersonate THE PIG;
7.1.4 Register or use domain names incorporating our trademarks;
7.1.5 Reproduce or republish our website content, including hotel descriptions, images, or guest reviews, without permission unless provided specifically for affiliate use; or
7.1.6 Use any content that could damage THE PIG’s brand and/or reputation.
7.2 We reserve the right to review and audit your use of our Brand Assets at any time and may require immediate removal or correction of any non-compliant use. Failure to comply may result in suspension or termination from the Programme.
7.3 All rights, title, and interest in and to our Brand Assets remain the exclusive property of THE PIG. Nothing in this Agreement grants you any ownership rights in our intellectual property.
8. Termination
8.1 We reserve the right to suspend or terminate your participation in the Programme at any time, by giving written notice if:
8.1.1 You commit a breach these Terms;
8.1.2 You commit or we suspect you of committing fraudulent activity; or
8.1.3 We determine your activity is not aligned with our brand and has resulted in, or is likely to give rise to reputational damage suffered by THE PIG.
8.2 Upon termination, you must:
8.2.1 Remove all links and creatives associated with THE PIG; and
8.2.2 Cease all promotional activity related to the Programme.
9. Confidentiality
9.1 Any information disclosed to you as part of the Programme that is not publicly available, including commission structures, performance data, and campaign strategies, is considered confidential and must not be shared or disclosed.
10. Limitation of Liability
10.1 We shall not be liable for indirect, incidental, or consequential damages or any loss of revenue, profits, or data in connection with the Programme.
10.2 You agree to indemnify and hold harmless THE PIG, its affiliates, and its agents from any third-party claims resulting from your breach of this Agreement.
11. Data Protection and Privacy
11.1 The Affiliate agrees to conduct all marketing and promotional activities in full compliance with the UK GDPR as enacted in the Data Protection Act 2018, the Privacy and Electronic Communications Regulations (PECR) 2003, and any other data protection laws relevant to the Affiliate’s jurisdiction or the location of the data subject.
11.2 The Affiliate must only process personal data where there is a lawful basis under Article 6 of the UK GDPR (such as consent or contractual necessity), and ensure that any data collected is done with explicit, informed, and freely given consent where required. Unsolicited marketing communications, including email or SMS, must not be sent unless recipients have provided verifiable opt-in consent.
11.3 The Affiliate is required to implement appropriate technical and organisational measures to protect personal data from unauthorised access, loss, or destruction.
11.4 The Affiliate agrees to: (i) maintain records of consents and marketing preferences where applicable; (ii) promptly comply with any data subject access request (DSAR) involving THE PIG, as advised; (iii) notify THE PIG within 24 hours of discovering any actual or suspected data breach related to the Programme; (iv) and fully cooperate with THE PIG in investigating and resolving any complaints, regulatory inquiries, or investigations concerning data processing under this Agreement.
11.5 The parties acknowledge that each acts as an independent data controller in relation to the processing of any personal data associated with the Programme, unless otherwise agreed in writing.
11.6 The Affiliate warrants that it has implemented and maintains a valid privacy policy compliant with GDPR and PECR, which clearly outlines the legal basis for processing personal data, the types of data collected (including via cookies, forms, or behavioural tracking), the names or categories of third-party processors such as AWIN, as well as data retention practices and the rights of data subjects.
11.7 Where the Affiliate engages third-party service providers (sub-processors), the Affiliate must ensure that such parties are contractually bound to comply with equivalent data protection obligations.
11.8 THE PIG shall not be liable for any fines, penalties, or claims arising out of the Affiliate’s breach of applicable data protection laws, and the Affiliate shall indemnify THE PIG in full for any such costs.
12. Changes to Terms
12.1 We may update these Terms at any time. Continued participation in the Programme after changes constitutes your acceptance of the new Terms.
13. Dispute Resolution
13.1 In the event of a dispute between you and us relating to commissions or programme terms, you agree to first attempt resolution through the AWIN platform.
13.2 If resolution is not achieved, disputes shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of English courts.
14. General Provisions
14.1 These Terms and/or the relationship governed by them does not create a partnership, joint venture, or employment relationship.
14.2 You may not assign your rights or obligations under these Terms without our written consent.
14.3 If any clause of these Terms is found to be unenforceable, the remaining terms will remain valid and enforceable.
