Either you or we may terminate this agreement at any time, with or without cause. As an affiliate, you have already accepted binding terms with the AWIN network. The following agreement is specific to your engagement with Lobster Anywhere.
Breach of these terms could lead to immediate termination from our program without warning, negative feedback on your network profile, and voids in transactions regardless of date or origin.
ADVERTISING
You do NOT have permission to spend money on ads specifically promoting our brand or products, especially in search engines and social media. However, if you want to explore paid ads with our brand, we are open to collaborating. Please reach out to our affiliate management team.
These restrictions include but are not limited to: pay per click, pay per view, pay per impression, media buys on ad networks, social media marketplaces (Facebook, Instagram), offline print publications, billboards, radio, tv, YouTube and others.
We do not allow direct linking, trademark keyword bidding, trademark plus coupon keyword bidding, trademark plus modifier like review or comparison, misspellings of our brands or trademark. We monitor this account daily for violations.
TIMELY RESPONSES AND TRAFFIC TRANSPARENCY
Affiliates must respond to all inquiries from Lobster Anywhere and their affiliate manager within a reasonable time frame which is between one to two business days. All traffic sources must be visible to the affiliate manager, and if the affiliate manager asks about sources, specific examples must be given.
If the affiliate gives vague answers or does not provide the requested information, they can and will be removed from the affiliate program and all commissions will be voided regardless of origin. Link cloaking and traffic cloaking is strictly prohibited. This includes sub-networks and affiliates providing links to third party websites and platforms they do not own. Certain exceptions may be made on a case by case basis and sign off must be made by the CEO of Lobster Anywhere.
All subnetworks must display exactly where all affiliate links are located. If it is determined by the affiliate manager that the website or place the link is placed is not the origin of the traffic, all commissions will be voided and the affiliate may be removed from the program without warning. The affiliate manager may request contact information for the publisher in the sub network if the website in question is found to be in violation of any of the TOS. If not provided, and the website cannot be blocked from access, the subnetwork and affiliate will be removed and all commissions will be reversed.
TRADEMARK
Trademark names and brands include Lobster Anywhere, lobsteranywhere.com, and/or any misspellings or similar alterations of these keywords.
Affiliate agrees not to register or use any URLs, domains or social profiles (pages, groups, forums) which are considered by Lobster Anywhere to be infringing on the Lobster Anywhere name or trademark, including but not limited to any registered trademark and all pending trademarks. Affiliate agrees not to use, purchase or otherwise contract with a third party to exploit any of the Lobster Anywhere marks or registered domain names, or any marks or domain names which may, in Lobster Anywhere reasonable discretion, be confused with Lobster Anywhere marks or registered domain names, including but not limited to misspellings of Lobster Anywhere marks or registered domain names, whether in metatags or otherwise.
DEALS, COUPONS, AND PROMOTIONS
When promoting Lobster Anywhere, find all coupon codes through the AWIN Deals and Coupons Database under the Tools Tab. Read our newsletters for tips, ideas and best practices.
Affiliates are not permitted to use misleading text, images or links that imply any deal that is not expressly authorized through the affiliate channel. Use of exclusive coupon codes by unauthorized affiliates will result in voided transactions. User-submitted coupon codes from other marketing channels such as email are prohibited from use by affiliates. We have the right to void those sales. Expired coupons and deals must be removed or clearly marked as expired immediately.
Affiliates cannot use a click to reveal style display of coupon codes, all codes must be visible without requiring additional action by the user. Affiliates cannot say a coupon is available without a coupon code actually being available “i.e. click to reveal a coupon” and there is no code.
Affiliates cannot create pages that are meant to optimize for SEO or LLMs and AI with the goal of showing up for our brand + coupons, deals, or other modifiers. This includes building pages like url.com/coupons/lobster-anywhere and using keyword phrases on indexable pages like “Lobster Anywhere coupons” in title tags, H1 and H2 tags, and repeating it multiple times throughout the copy.
It is ok to feature phrases like “save on lobsters at lobster anywhere” on non-branded pages where multiple brands are featured. An example would be a page dedicated to saving on seafood or meal kits and is not specific to any one single brand.
LOGO AND CREATIVE USAGE
Affiliates may only use logos, banners and images provided through the AWIN interface can be used. Contact the affiliate management team before using any images from the merchant website or social media.
If the affiliate is sent a product for review, they can use the products within their promotions. The affiliate must submit the creative for review if the Lobster Anywhere logo is being applied to it. The affiliate manager will get an approval within 2 business days on average so the promotion will not be delayed.
VOIDS, TERMINATION, AND COMMISSION REVERSALS
Both Lobster Anywhere and the affiliate can terminate the relationship at any time, for any reason, and without warning. Lobster Anywhere retains the right to void any and all commissions at any time regardless of where they originated if the affiliate is found in violation of any terms from this agreement. Sub-affiliate transactions without referring URLs are subject to voids. We must know who is promoting our products and where the traffic is coming from.
We reserve the right to reverse transactions due to order cancellations, duplicate tracking, returns, credit card fraud, disputed charges or violations of this agreement.
BROWSER EXTENSIONS AND ADWARE
Browser extensions also known as toolbars are strictly prohibited. This includes any form of software that tries to encourage a click, sets an affiliate cookie, intercepts a customer already on the Lobster Anywhere website, over SEO rankings and PPC ads, or that displays an incentive, offer, or coupon on our website or another partner’s website.
Adware is any software that shows or displays an ad on a website the affiliate does not own and includes toolbars, browser extensions, PPV ads, pop ups, pop unders, and interstitial ads.
FTC COMPLIANCE
For more information and suggestions about how to comply with the FTC’s Endorsement Guidelines, please review the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising, the FTC Endorsements website resource and the FTC Dot Com Disclosures. Please note that the FTC guides and resources are only intended to provide guidance. They do not purport to provide legal advice and they do not guarantee that you will be in compliance with FTC regulations if you follow the suggestions presented. You are advised to seek and obtain your own legal advice on how these rules apply to your website or other promotional activities for which you receive compensation.
You are required by Lobster Anywhere to disclose your affiliate relationship on any promotion for this merchant. This includes but is not limited to blog posts, videos, emails, social media, private groups, and website pages. Your audience must understand you could earn commissions if they click your links. This disclosure statement should be clear and concise, stating that Lobster Anywhere is compensating you for your review or endorsement. If you received the product for free from Lobster Anywhere for review, this also must be clearly stated in your disclosure. Disclosures must always appear before the first affiliate link and verbal disclosures must be used in video content before the first brand visual or brand mention.
Some specific examples that our affiliate management team will seek out when providing audits of your endorsements include but are not limited to:
- Disclosures must be made visible and in a clear and conspicuous position from the first affiliate link.
- Disclosures should be placed above the fold; scrolling should not be necessary to find the disclosure. (e.g. Disclosure should be visible before the jump or click).
- For Image-heavy platforms, such as Pinterest, Instagram Stories, Snapchat, etc., #ad should be on the image or the first image in a series. On video platforms, such as YouTube, verbal disclosure within the video before the first brand mention or visual as well as text disclosure in the description before the first affiliate link is sufficient.
- Pop-up disclosures are prohibited.
- Social media posts must include proper disclosure which may include hashtags such as #ad, #advertisement and #sponsored before the text. Hashtags such as #sp, #spon, #affiliate or #aff are NOT acceptable, and neither are disclosures mixed in with other hashtags or at the end of the post. Forms such as Ad, (Ad), //Ad// are acceptable on Facebook, as is natural language disclosure, if it's clear and concise. Eg: This post does contain an affiliate link, which means if you purchase after clicking the link I may receive compensation. All social media disclosures must be at the beginning of the text portion.
Affiliates may not pretend a deal or discount is available if one isn’t, including to incentivize a click as this is misleading to consumers. An example is “use my link to get the best price.” The link has no impact on the price and does not offer a discount.
