MYCHWAY Affiliate Agreement

1. Definitions
Company / Us / We / Our: MYCHWAY and its employees or legal agents.
You / Your / Affiliate: The individual or entity entering this Agreement.
Parties: Refers collectively to the Company and the Affiliate.
Affiliate Program: The program governed by this Agreement.
Affiliate Application: The form submitted to join the Program.

2. Assent & Acceptance
By submitting an application, you confirm you've read, understood, and agreed to the terms.
If you disagree, do not apply or participate.
3. Age Restriction
You must be 18 years or older to participate.
4. Program Sign-Up
Apply through the designated Affiliate Application link (not provided in document).
Acceptance is not guaranteed; MYCHWAY may reject any application without explanation.
Rejected applicants cannot reapply.
Additional verification steps may be requested.
5. Non-Exclusivity
You may work with other affiliate programs.
MYCHWAY may engage with other affiliates as well.
6. Affiliate Program Structure
Clicks
You will receive personalized Click Links for promotion.
Qualified Clicks are those that:
Originate from your approved site or social media
Come from human users (no bots)
Are tracked via your assigned link
Sales
You will also receive Sales Links tied to product sales.
You earn 8% commission on Qualified Purchases.
7. Qualified Clicks and Purchases
Qualified Clicks must:
Come through approved and correctly formatted links
Be from your approved website or social media page
Come from a single, real user
Qualified Purchases must:
Be through your unique link
Not be referred by other partners/affiliates
Not be self-purchases by other partners/affiliates
Be made after your official program entry
Be compliant with Company terms
Not involve unauthorized discounts
Be non-fraudulent
8. Payout Information
Commission Rate: 8% per qualified sale
Payout Threshold: $0
Payout Platform: AWIN
Required Documentation: W8/W9 forms, current address, payment account
Payout Timing: Paid the following period after commission accrues
Disputes: Must be reported within 30 days of receiving a payout
9. Reports
Login access to real-time dashboard for performance tracking.
Reports may be adjusted prior to final payouts.
10. Termination & Suspension
Either party may terminate the agreement at any time.
Payouts earned before termination are still owed unless terminated for breach.
Breaches (e.g., fraud, policy violations) result in forfeiture of unpaid commissions.
11. Intellectual Property (IP)
You’re granted a limited, revocable license to use MYCHWAY’s IP for promotional purposes only.
You must not:
Modify MYCHWAY IP
Use IP in domains, ads, or metatags without approval
MYCHWAY may use your name/trademarks to advertise your participation.
12. Modifications
MYCHWAY may update the Agreement at any time.
Updates are effective immediately upon posting.
You are responsible for reviewing the Agreement and staying updated.
13. Relationship of the Parties
Independent contractor relationship only.
No partnership, employment, or franchise relationship is formed.
14. Acceptable Use Policy
You must not use the program to:
Harass, threaten, or abuse others
Violate IP rights
Spread malware or viruses
Commit fraud
Promote illegal gambling or pyramid schemes
Share hate speech or discriminatory content
Collect private information unlawfully
15. Affiliate Obligations & FTC Compliance
You are responsible for:
Maintaining your site and links
Ensuring content accuracy
Disclosing affiliate relationships clearly (FTC requirement)
Following all data privacy regulations (e.g., GDPR, US laws)
We engage in affiliate marketing and may receive commissions from purchases made through links on this site. This complies with FTC and other advertising laws.
16. Reverse Engineering & Security
You must not:
Reverse engineer MYCHWAY’s software
Breach website security or data protections
17. Data Loss
You assume responsibility for data security and system usage.
18. Indemnification
You will defend and indemnify MYCHWAY against any legal claims related to your actions or content.
19. Spam Policy
Strictly no spamming. This includes:
Mass commercial emails
Unsolicited data gathering
20. Entire Agreement
This document is the entire agreement between you and MYCHWAY.
Supersedes all prior agreements.
21. Service Interruptions
MYCHWAY is not liable for any downtime or service unavailability.
22. No Warranties
The Affiliate Program is provided “as is.”
No guarantees are made about service reliability, profitability, or system security.
23. Limitation of Liability
MYCHWAY’s maximum liability is capped at $100 USD.
They are not responsible for lost profits or indirect damages.
24. General Provisions
a) Language:
All communication must be in English.
b) Jurisdiction & Venue:
All disputes will be governed by California law. Legal disputes are to be settled in California.
c) Arbitration Clause:
Mandatory binding arbitration for most disputes
Exceptions: IP claims may go to court
Arbitration to be held in California
No class actions or punitive damages
d) Assignment:
You may not transfer or assign your rights under this Agreement.
e) Severability:
If a part is found unenforceable, the rest remains valid.
f) No Waiver:
Failure to enforce a term doesn’t waive future enforcement.
g) Headings:
Headings are for convenience and do not affect interpretation.
h) Force Majeure:
MYCHWAY is not liable for delays due to events outside its control.
i) Electronic Communications:
Emails and faxes are acceptable forms of notice.
