Flower Knows Affiliate Terms & Conditions
This Affiliate Terms and Conditions (“Terms”) constitutes a legally binding agreement made between you, whether personally or on behalf of an entity, and Flower Knows Trading INC. (“Flower Knows”) and its affiliated companies. Please read our Terms carefully before you join our program or begin marketing our program. These Terms are written in plain language to ensure they may be clearly understood and followed by affiliates. Adherence to the Terms provides that our Flower Knows affiliate program is sustainable and profitable for both Flower Knows and our affiliates.
DEFINITIONS
As used in these Terms:
“We,” “us,” or “our” refers to Flower Knows.
“You” or “your” refers to the Affiliate.
“Our website” refers to the Flower Knows website located at www.flowerknows.co.
“Your website” refers to any websites that you will link to our website.
“Program” refers to the Flower Knows Affiliate Program.
TERMINATION
Flower Knows reserves the right to terminate your participation in the Program at any time, with or without cause, upon providing written notice. Grounds for termination may include, but are not limited to:
Breach of any provisions outlined in these Terms.
Engaging in fraudulent or unethical activities.
Non-compliance with applicable laws and regulations.
Upon termination, you will cease all promotional activities and remove any content associated with Flower Knows from your platforms.
COMMISSIONS
Flower Knows uses advanced attribution rules in the Affiliate Program. Commission levels vary based on the type of referral site and customer. For questions about commission rates, please contact our team at media@flowerknows.co.
PROMOTIONAL CONTENT
Your promotional content on your website shall not involve any violence based on race, ethnicity, national origin, sex, gender, gender identity, sexual orientation, religious affiliation, disabilities, or diseases. Content must not depict violence or be sexually explicit or suggestive. Breaching this section may result in removal from the Program.
COUPON GUIDELINES
Affiliates may generate coupon codes directly through the Awin platform or contact Flower Knows to obtain exclusive coupon codes.
You may ONLY advertise coupon codes that are provided through the Program or network.
Affiliates are prohibited from using coupon codes obtained via non-affiliate advertising, customer emails, paid search, or other campaigns.
In cases where affiliates use scraping, bots, or other methods to misuse coupon codes belonging to other publishers, Flower Knows reserves the right to:
Deduplicate repeat orders.
Withhold commissions for affected transactions.
Terminate cooperation with publishers engaging in repeated violations.
PPC ADVERTISING
Affiliates are NOT permitted to conduct any Pay-Per-Click (PPC) advertising to promote Flower Knows products. This includes bidding on trademark-related terms, using redirects, or direct linking to the Flower Knows website.
INTELLECTUAL PROPERTY RIGHTS
All Flower Knows graphics, logos, designs, page headers, button icons, scripts, and names are registered trademarks, common law trademarks, or trade dress of Flower Knows in the United States and/or other countries. These trademarks and trade dress may not be copied, imitated, or used, in whole or in part, without prior written permission from Flower Knows.
SOCIAL MEDIA
Affiliates may not use Flower Knows’ trademark or trademark-related terms, including variations or misspellings, to create pages or accounts on any social media platform, such as Facebook, YouTube, Twitter, Reddit, or Instagram.
DOMAIN NAMES
Using Flower Knows’ trademark or related terms, including misspellings, as part of your domain name is strictly prohibited. Examples: “www.flowerknows-coupons.com.”
ADVERTISING & PUBLICITY
You may not create, publish, distribute, or print any written material referring to the Program without prior written consent from Flower Knows. If promoting the Program via email campaigns, you must:
Abide by the CAN-SPAM Act of 2003 (Public Law No. 108-187).
Send emails on your behalf and not imply they are sent by Flower Knows.
Submit emails for approval prior to distribution.
FTC COMPLIANCE
Affiliates must disclose their relationship with Flower Knows in all promotional materials, including blog posts, videos, emails, social media, and website pages. Disclosures should clearly state that commissions may be earned from the links provided. If products were received for free, this must also be disclosed. For more guidance, refer to the FTC’s Endorsement Guidelines and Dot Com Disclosures.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Flower Knows, its subsidiaries, affiliates, and their respective officers, agents, partners, and employees from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your participation in the Program.
In return, Flower Knows agrees to ensure that all materials, guidance, and data provided to affiliates are accurate, lawful, and free from third-party claims. Flower Knows will cooperate in addressing any such claims arising from its provided resources.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in [state or district].
