By participating in a Campaign from Your Baby Club, you expressly agree that you have read, understand, and agree to these Terms and Conditions.
VALID LEADS AND/OR CLICK-THROUGHS; FRAUD: The parties acknowledge and agree that Your Baby Club in its sole discretion, will determine if actions generated by the campaign hereunder are considered valid and subject to the payment terms as outlined herein (”Actions”). Actions shall not include such events as canceled orders, returned orders, failed credit check, violation of program terms, duplicate orders, and orders for out-of-stock items. Accordingly, Your Baby Club will only pay the Publisher for valid leads as determined at Your Baby Club’s sole discretion.
Your Baby Club actively monitors traffic for fraud. In the event Publisher fraudulently provides invalid Actions and/or inflates Actions through fraudulent Action generation (as determined solely by Your Baby Club), Publisher will forfeit its entire commission for the campaign.
INTELLECTUAL PROPERTY: Your Baby Club owns all Intellectual Property Rights in the Your Baby Club trademarks, trade names, logos, copyrights and in the Your Baby Club website (including, without limitation, its content), in and to the campaign reports, in and to all data and Personal Information collected by Publisher, and any works, drafts, deliverables and Advertising Materials, without limitation, created by or in collaboration with Publisher in providing the services contemplated herein all of which constitute Your Baby Club’s Intellectual Property. Publisher expressly represents and warrants that it will not infringe, bid and/or monetize Your Baby Club’s Intellectual Property, or any variations thereof, except as authorized herein.
ADVERTISING MATERIALS: Publisher acknowledges and agrees that it may not alter or otherwise modify the Advertising Materials without prior approval from Your Baby Club
The agreement provided below is used to set forth the terms and conditions between “You,” the affiliate and “We”, Your Baby Club/FanFinders Ltd. By joining our affiliate program, you agree that you will comply with all conditions outlined below. Any breach of these terms and conditions may result in removal from the program or/and commissions being declined.
PPC Policy
Affiliates must not:
1) Purchase or license any domain names similar to yourbabyclub.com.
2) Bid on the “yourbabyclub” or “yourbabybox” keyword, or any of its misspellings on any search engines that operate web services.
3) Use the keyword “yourbabyclub” or “yourbabybox” to perform search activity across any search engine that operates web services.
4) Use the term “yourbabyclub”, “yourbabybox” or its derivatives in the affiliate’ ad text for driving traffic from competitor’s brand terms to site or the affiliate’s sites.
5) Drive paid or unpaid traffic from search engines directly to “yourbabyclub.com” pages. Affiliates have to use their own sites for traffic from search engines.
6) Please exclude "yourbabyclub" and “yourbabybox” from remarketing efforts.
Email Policy
Affiliates are not permitted to send any unsolicited email (spam) under this affiliate program. If you wish to send out an email campaign on behalf of Your Baby Club, you must seek approval from the Advertiser.
Copy and Creatives
Affiliates should only use creatives provided by the Advertiser or supplied through Awin on our behalf. Any creative obtained through these channels must not be edited or modified unless expressed consent from the Advertiser.
Brand Guidelines Include
Brand bidding along with permutations is not permitted on any search engine.
Affiliates may not use “TM” or “official” in advertisements.
Affiliates may not use the brand “yourbabyclub” or any permutation of it in your URL
Affiliates may not direct link to the Your Baby Club website, if using PPC
Affiliates must use Creative assets provided in the AWIN affiliate program admin. Creative assets and user generated content not found in the program must be approved by Your Baby Club.
The look and feel of webpages must be unique and not mimic Your Baby Club web properties to prevent confusion to the visitor.
The Affiliate cannot own a domain which includes "Your Baby Club" trademark or registered trademark.
