SOMNEE SLEEP AFFILIATE PROGRAM AGREEMENT
1. Trademark Regulations:Affiliates must not use Somnee Sleep’s trademarks, including the brand name and product names, in any paid search activity, including but not limited to AdWords or Facebook Ads. This includes any variations or misspellings of our trademarks.
2. Email Marketing Policy:All email marketing activities by affiliates must be compliant with the CAN-SPAM Act. Affiliates must obtain Somnee Sleep’s prior approval for any email campaign featuring our products.
3. FTC Disclosure Requirements:Affiliates must disclose their relationship with Somnee Sleep in a clear and conspicuous manner on all promotional channels as per the Federal Trade Commission guidelines.
4. Social Media Policy:Affiliates are encouraged to promote Somnee Sleep on social media but must not engage in any advertising that could be interpreted as spam or violating any social platform's terms of service.
5. Coupons and Deals Policy:Distribution of unauthorized coupon codes or deals is not permitted. Affiliates may only promote coupon codes that are provided through the affiliate program.
6. Special Commission Rules:Affiliates will earn up to a 10% commission for each qualifying sale. Special commission rates or incentives must be agreed upon in writing by Somnee Sleep.
7. Pay Per Click Bidding Rules:Affiliates are not allowed to engage in PPC bidding that directly competes with Somnee Sleep’s own campaigns. This includes bidding on brand names or variations thereof.
8. FDA Compliance:Affiliates must not make any claims about our products that are not consistent with Somnee Sleep’s marketing. Please note that while the current product is not FDA approved, an FDA-approved version is anticipated around 2026. Until FDA approval is obtained, affiliates must refrain from using any language that suggests the product is FDA-approved.
9. HIPAA Compliance:As a HIPAA compliant company, affiliates must ensure they do not disclose any protected health information (PHI) in their marketing efforts.This agreement is subject to change, and it is the responsibility of the affiliate to stay updated on any changes to these terms. Affiliates are also bound by the ShareASale Terms of Service, which must be adhered to in conjunction with this agreement.10. Grounds for Termination:Violation of any terms in this agreement, engagement in any fraudulent activity, or any activity that violates the HIPAA privacy rule will result in immediate termination and forfeiture of any pending commissions.
