Terms and conditions

By applying to become an affiliate of The Bike Insurer, you agree and accept our terms and conditions as set out in the Affiliate Window interface. If you have any difficulty accessing the Affiliate Window interface, please email your account manager.

Clicks through to the The Bike Insurer website and all quotes carried out via the TheBikeInsurer.co.uk website shall be tracked by Affiliate Window and updated to accounts daily. Only sales that meet the merchant’s criteria as a valid sale shall be approved and sales which are deemed false or fraudulent shall be declined. The Bike Insurer reserves all rights to take such action (including, but without limitation, legal action) as is considered necessary in its sole discretion to prevent any fraudulent or otherwise unlawful use of its website or this programme.

Unsuitable Sites

Websites which adopt the following practices or which contain the following content will not be accepted as members of the TheBikeInsurer.co.uk affiliate programme and may be removed from the programme and declined payment of commission:

  • Spamming
  • Adware / Spyware
  • Websites which use unapproved creative or copy or which otherwise infringe the rights including (but without limitation) the intellectual property rights of any third party
  • Obscene content or links to Adult Content
  • Gambling Websites / Gambling Content
  • Websites that appear to be operating under false claims to include money saving websites and cashback and loyalty sites
  • PPC using brand trademarks or terms or those that sound similar
  • websites that publish content that does not conform with The Bike Insurer brand guidelines
  • Websites breaching any law or regulation including but not limited to the Financial Conduct Authority’s (FCA) rules and regulations / ASA
  • Websites which otherwise adopt practices or contain content which damages or brings into disrepute or which may damage or bring into disrepute the reputation or goodwill of The Bike Insurer (as determined by (The Bike Insurer) in its sole discretion).

 

Key Word Bidding Restrictions:

Affiliates will not bid / appear on any brand terms or any substantially similar terms or derivatives, mis-spellings or variations thereof including (but without limitation):

·        thebikeinsurer match negative

·        thebikeinsurer broad match negative

·        thebikeinsurer phrase match negative

If broad matching, affiliates must set brand key words to negative.

Affiliates with also not use paid search to bid on any terms related to insurance included but not limited to broker names and trading names that operate with Vast Visibility 

Commissions will not be paid on traffic that has come through any other marketing channels, inlcuding but not limited to PPC.

Affiliate Display URLs

Affiliates are not permitted to use any The Bike Insurer domain within display URL’s on paid search engines. Affiliates must not refer to The Bike Insurer Domain at the end of their domain within paid search ads.

Affiliates must not refer to the websites belonging to the The Bike Insurer group, including but not limited to TheBikeInsurer.co.uk a subdomain in their URL. 

Creative and Content

  • All creative and content used on publisher sites must be up to date and consistent with The Bike Insurer creative. Affiliates are not permitted to hard code banner creative onto sites.
  • All traffic to The Bike Insurer domains site through affiliate links must direct through your own affiliate site and for the avoidance of doubt The Bike Insurer does not allow direct linking to TheBikeInsurer.co.uk  domain website from browser / search engines.
  • Affiliates wishing to promote via social media sites are only permitted to do so with prior written authorisation from The Bike Insurer. Please contact the account management team should you wish to discuss this matter further.
  • All bespoke ad copy and creative must be submitted to The Bike Insurer for authorisation prior to implementation.
  • Publishers must update offer changes within 48 hours of notification from affiliate networks or cease activity pending implementation of the update.
  • Pre-approved copy and banners should be used. These can be found on the The Bike Insurer domains profile.
  • Requirements outside of standard banners and copy will be dealt with on a case-by-case basis. Please contact The Bike Insurer directly.
  • Unique copy can be written but requires approval by The Bike Insurer. The standard SLA for approval is five days, although this could vary depending on demand. Please contact The Bike Insurer directly.

 

Without prejudice to any of our other rights, affiliates found to be in breach of these terms may be removed from the programme and/or declined payment of commission

MISC

Nothing in these terms is intended to or shall be deemed to establish any partnership or joint venture between the parties, constitute any party the agent of another party or authorise any party to enter any commitments for or on behalf of any other party.

Nothing in these terms is intended to or shall be deemed to convey any title or ownership in any intellectual property rights including (but without limitation) intellectual property rights in relation to trade marks, services marks, logos or designs that are licensed to or the property of The Bike Insurer.

Indemnification

The Affiliate shall keep The Bike Insurer indemnified against any claims for damages or other claims for compensation arising from the contents of the Affiliate's website or any incorrect information given The Bike Insurer by the Affiliate. The Affiliate shall also compensate The Bike Insurer for any other damages or costs caused by the Affiliate's improper, negligent or unauthorised use of the The Bike Insurer services and technical problems or loss of data caused by the Affiliate on The Bike Insurer website or on any website to which the Affiliate is linked by The Bike Insurer

 

Notice

All notices given by you to us must be given to The Bike Insurer at 

customer.services@thebikeinsurer.co.uk. We may give notice to you at the e-mail address you provided to us when registering. Notice will be deemed received and properly served 24 hours after an e-mail is sent. In proving the service of any notice, it will be sufficient to prove in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

 

Events outside our control

 

 The Bike Insurer will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations hereunder that is caused by events outside our reasonable control (a “Force Majeure Event”).

            A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

            (a) strikes, lock-outs or other industrial action;

            (b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

            (c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

            (d) impossibility of the use of public or private telecommunications networks;

            (e) the acts, decrees, legislation, regulations or restrictions of any government.

            Our performance is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these Terms may be performed despite the Force Majeure Event.
