Program Terms

The Hemp Division Affiliate Program Terms and Conditions

These Terms and Conditions ("Agreement") govern your participation in The Hemp Division Affiliate Program ("Program"). By applying to or participating in the Program, you ("Affiliate," "you") agree to abide by these terms. “The Hemp Division,” “we,” or “our” refers to The Hemp Division.

1. Enrollment in the Program

To join the Program, you must submit a complete application. We will evaluate your application and may reject it at our sole discretion if your site is deemed unsuitable. This includes sites that:

  • Contain unrelated or inappropriate content
  • Are primarily link or banner farms
  • Promote illegal, obscene, violent, discriminatory, or infringing content
  • Advertise alcohol, tobacco, firearms, or political/religious content
  • Fail to meet basic quality or performance standards

We reserve the right to revoke approval at any time without notice.

2. Use of Tracking Links

Once accepted into the Program, you may use affiliate tracking links ("Tracking Links") provided via Awin. You agree to:

  • Use only authorized tracking links and advertising materials (banners, text links, etc.)
  • Not alter the content or function of any tracking link
  • Not engage in forced clicks, redirects, or traffic interception
  • Not promote using framing, pop-ups, or misleading methods
  • Not collect personally identifiable information (PII) from The Hemp Division customers
  • Not incentivize clicks without written permission
  • Remove discontinued creatives within 48 hours of notice

3. Trademark, Domain & PPC Policy

You may not:

  • Bid on trademarked terms including variations or misspellings (e.g., “The Hemp Division,” “TheHempDivision.com”)
  • Use our trademarks in display URLs or as domains/subdomains
  • Direct-link to our site from paid ads
  • Use our trademarks in print ads without permission
  • You may not create or run Google Shopping or equivalent product listing ads using our brand name or any variation thereof.

You may use our trademarks in ad copy if compliant with the above.

4. Coupons & Promotions

You may only promote coupon codes or discounts made available through the Program. Promoting unauthorized codes (e.g., from emails or other campaigns) is prohibited. You may not bid on combinations like “The Hemp Division coupon” or “The Hemp Division discount.”

5. Email & Social Media Promotion

You may promote The Hemp Division via email only to users who have opted into your list. You may not:

  • Send email promotions on our behalf without consent
  • Use third-party or purchased lists
  • Violate the CAN-SPAM Act

Social media promotion is allowed on personal/business profiles you own. You may not post in groups or forums you do not own or manage.

6. Responsibility for Your Site & Content

You are solely responsible for:

  • Site and social account operations
  • Posting accurate and appropriate content
  • Avoiding infringement of third-party rights
  • Including privacy and data collection disclosures
  • FTC-compliant affiliate disclosures (e.g., stating compensation for reviews)

We disclaim all liability and reserve the right to terminate your participation for violations.

Compliance Audits: We reserve the right to monitor, audit, or request documentation related to your promotional activities to ensure compliance with this Agreement. You agree to cooperate with any reasonable request for data or clarification related to your traffic sources, marketing practices, or tracking implementation.

7. Referral Fees

Commission rates, terms, and payment schedules are governed by the current offer listed in Awin. See The Hemp Division’s Advertiser page on Awin for details.

We reserve the right to withhold or reverse referral fees for any transactions that are suspected to be fraudulent, artificial, or in violation of this Agreement, including but not limited to self-referrals, ad hijacking, forced clicks, or coupon abuse. If we contact you for clarification and you do not provide a timely or satisfactory explanation, we may permanently reverse the commissions in question. Our determination will be made in good faith and is final.

8. Limited License

We grant you a limited, revocable, non-exclusive license to use our logo and other approved creative assets for Program participation. You may not modify these assets except for resizing logos proportionally. All intellectual property remains our sole property.

9. Term and Termination

This Agreement remains in effect until terminated by either party. Termination may occur at any time, with or without cause, by written notice. Upon termination:

  • You must remove all links, logos, and creative assets
  • We may withhold final payments to ensure proper accounting

10. Modifications

We may modify this Agreement at any time by posting an updated version on Awin. Continued participation constitutes acceptance. If you disagree, your sole remedy is to terminate participation.

11. Limitation of Liability & Indemnification

We are not liable for indirect, incidental, or consequential damages. You agree to indemnify The Hemp Division and its affiliates against all third-party claims arising from your actions, site content, or Program participation.

12. No Waiver

Failure to enforce any provision of this Agreement does not constitute a waiver of that or any other provision.

13. Relationship of Parties

This Agreement creates an independent contractor relationship. Nothing in it establishes a partnership, joint venture, employment, or agency relationship. You may not make any claims or representations on our behalf.

14. Notices

Notices must be sent in writing by email, certified mail, or courier to the contact details on file for each party.

15. Arbitration

Disputes shall be resolved through binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association. We may seek injunctive relief for IP violations in any court of competent jurisdiction.

16. Entire Agreement

This Agreement represents the full understanding between the parties and supersedes all prior discussions or communications regarding the Program.
