CandyRetailer.com Affiliate Program Agreement
This Affiliate Program Agreement ("Agreement") outlines the terms and conditions between CandyRetailer.com ("Merchant," "we," "us") and you ("Affiliate") regarding your participation in our affiliate program. By joining the CandyRetailer.com affiliate program, you agree to be bound by the terms of this Agreement.
1. Program Participation
To participate, you must submit an affiliate application and be approved by CandyRetailer.com.
We reserve the right to reject any affiliate application at our sole discretion.
You agree to promote CandyRetailer.com products and services through approved marketing channels, which may include your website, blog, social media, email, or other methods.
2. Commissions and Payments
You will earn a 6% commission on all eligible sales referred from your affiliate links.
A "sale" is defined as a purchase made on CandyRetailer.com by a customer who clicked through an approved affiliate link within the 30-day cookie duration.
Commissions are calculated on the net sales amount, excluding shipping, taxes, returns, and canceled orders.

We reserve the right to withhold or reverse commissions for any fraudulent or suspicious activity.
3. Promotional Materials
We will provide approved marketing materials, including banners, text links, and promotional codes. You can create your own as long as it is relevant and not misleading.

4. Restrictions
You may not engage in any false, misleading, or deceptive advertising practices.
You may not use "cookie stuffing" or other techniques to artificially inflate sales.
You may not offer incentives or rewards in exchange for clicks or purchases through your affiliate links, unless expressly approved by CandyRetailer.com.
You may not promote CandyRetailer.com on websites or platforms that contain illegal, offensive, or infringing content.
You must comply with all applicable laws and regulations, including those related to advertising, consumer privacy, and intellectual property.
5. Intellectual Property
You understand that any of CandyRetailer.com's trademarks, service marks, logos, and other intellectual property remain our sole property.
You may only use our intellectual property in accordance with the guidelines provided by CandyRetailer.com.
6. Termination
Either party may terminate this Agreement at any time with written notice.
Upon termination, you must immediately cease all use of CandyRetailer.com promotional materials and remove all affiliate links from your website and marketing channels.
7. Limitation of Liability
CandyRetailer.com will not be liable for any indirect, incidental, or consequential damages arising from your participation in the affiliate program, even if we are advised of the potential for such damages.
8. Relationship of Parties
You and CandyRetailer.com are independent contractors, and nothing in this Agreement creates a partnership, joint venture, agency, franchise, or employment relationship.
9. Governing Law
This Agreement will be governed by and construed in accordance with the laws of the State of Kentucky.
10. Changes to Agreement
We may update or modify the terms of this Agreement from time to time. We will notify you of any material changes.
By submitting an application to join the CandyRetailer.com Affiliate Program, you acknowledge and agree to the terms and conditions set forth in this Agreement.
