Promotional Activity
Affiliates must not use any Brand Terms in conducting Promotional Activity unless and until the precise instance of such use has been approved by Pod Point or by the Counterparty acting in accordance with Pod Point’s formal written instructions. Where any use by any Affiliate of any Pod Point Brand Term is approved, the Affiliate must seek further approval should any new use, or change to the approved use, of that Brand Term (or any other Brand Term) be proposed, for example, this includes email marketing activity; copy must be signed off before doing the mail drop.
Offline
Please note that face-to-face/door-to-door selling is strictly forbidden. Please ensure you do not partake in such activity. If any affiliate is found doing so they will be removed from the programme without warning.
Validations
Sales will be validated and paid 30-days after an order is placed by a customer. If in this 30-day period any order is cancelled by Pod Point (for e.g. technical reasons) or by a customer, or a refund is requested by a customer, Pod Point will not validate the order.
Only sales to customers without an existing Pod Point order will be validated.
Please note that we regularly review the conversion rate of affiliates from point of validation through to installation. If any affiliates have a pattern of suspicious activity, including whereby their drop-out rate is unusually high between validation and installation, Pod Point reserves the right to remove the affiliate from the programme without warning.
Note that referrals will be paid only for any products, including chargers and accessories, purchased via Pod Point’s homecharge checkout on Pod Point’s website.
Compliance
Affiliates shall in all matters connected with the promotional activity observe and comply with, at their sole expense, the following (to the extent applicable):
- all applicable statutes, statutory instruments, bylaws and other regulations of any local and other statutory/government authority or public body having jurisdiction (including all EU Directives) in force from time to time;
- the constitution and bylaws of the Institute of Practitioners in Advertising (whether or not the Service Provider is a member);
- the rulings of the Advertising Standards Authority;
- the British Code of Advertising Practice and the British Code of Sales Promotion Practice;
- the ITC Code of Advertising Standards and Practice and the ITC Sponsorship Code;
- the Department for Food, Environment and Rural Affairs’ ‘Green Claims Code’ and any other guidance issued by the UK Government in relation to environmental marketing and/or advertising claims;
- all guidance published by the Office for Zero Electric Vehicles (or any successor thereto) in relation to electric vehicle chargepoints
Terms
Affiliates shall indemnify Pod Point from all costs and losses incurred by, and claims made against Pod Point which arise as a result of any failure or breach by any Affiliate of any of the above provisions.
