Terms and conditions

Please read these terms and conditions carefully. In consideration of becoming a member of AYM’s affiliate programme (the “Programme”), you agree to adhere to these terms and conditions and linked documents. Failure to comply with these terms and conditions may result in your immediate removal from the Program. Unless you agree to these terms and conditions, please do not become a member of the Programme.
Your website
Your website shall not contain:
- Any false, inaccurate, libellous, misleading or disparaging representations or statements regarding AYM, its partners, the providers of any of its products or any of AYM’s products; or
- Any negligent, unlawful, harassing, libellous or otherwise objectionable or illegal content or content that infringes the rights of any other person.
- You shall remove from your website any materials or copy on AYM’s request.
AYM Keyword Policy (paid and natural search)
Whilst we encourage affiliates to bid on generic terms within all search engines, we are very protective of our brand. You must not, therefore, engage in any sponsored search activity that involves bidding on any electronic search engine in respect of the search words “AYM any search word or phrase containing the words “AYM” and/or any search word or phrase that contains, is a derivative, shortening or misspelling of, and/or directly relates to any brand names of AYM or any other website owned or administered by AYM. This includes search engines such as Yahoo (YSM), MSN (aka Bing), Google, and other paid for listings or pay per click providers.
The only exception to this is when an affiliate is expressly and specifically authorised, with a formal contract in place, to carry out this activity by AYM.
Linking
You must not link directly to www.aym-studio.com or apply re-directs for any products offered via the Affiliate Network from any paid (own generic ads) or natural search listings. All links must clearly identify the affiliate relationship by landing the consumer on the affiliate site prior to clicking through to the AYM site.
Email/Other marketing
You may not send emails or produce any other marketing material that reference any AYM products without the prior written consent of both AYM and this Affiliate programme. We will not pay commission for any sales/leads generated by these alternative means and any affiliates found to be in breach of this will be subject to removal from the programme. If you are interested in being an email affiliate for AYM, please let us know and we will be happy to provide further information.
Reward, incentive and cashback
AYM is currently running a restricted policy on the use of Reward, incentive and cashback sites (sites whereby the consumer is incentivised to apply for a product in return for cash, member points or other tangible items) If you are a Reward, incentive or cashback site and wish to join the Program, please contact Affiliate Window to discuss your site and intentions. All applications will be considered on an individual basis.
Graphical elements and copy
You must use the graphical elements and text links provided by Awin and must not create any of your own links or copy. If you require any custom links or copy, please contact Awin who will be glad to pass on your request.
In addition, you must only use the most recent AYM creative and copy supplied by the network. This ensures, amongst other things, that the products you are promoting are current and that the tracking links are up to date and fully functioning. This will also ensure that copy (text) and creative (Images. Logos or banners) relating to financial services products (such as insurance, lending and savings) are compliant with Financial Services Authority regulations and other relevant associations. Affiliates must therefore ensure that all AYM creative and copy supplied through the network portal as may be updated from time to time and used on their site complies with the network portal. Any updates to the creative and copy on the network portal will be displayed within 24 hours on the affiliate site.
Audits will be undertaken on a regular basis to ensure affiliates are displaying the correct version, content and imagery at all times. In the event that any affiliate site has been identified as not displaying the correct information or to not be complying with the network portal will be a serious breach of these terms and conditions.
Affiliates must dynamically link creative from the network to ensure it is always the latest version. Please contact us immediately if for any reason you feel you cannot work with dynamic links. Any affiliates found to be hard-coding links or creative will be subject to their account being paused pending a full audit.
Warranty
You warrant and undertake that you have and will maintain while you are a member of the Program all licences, permits and authorisations necessary to be a member of the Program.
Consequences of breach
Without prejudice to any rights Awin may have and action it may take against you, if you breach these terms and conditions:
- AYM may cancel your membership of the Program;
- you will cease to be entitled to receive commissions in respect of AYM products; and
- you will be required to pay back any commissions in respect of AYM products paid to you following your breach of these terms and conditions.
Affiliates that are removed from the programme following a breach of these terms and conditions will not be able to reappear on the programme without explicit authorisation from AYM.
Termination
AYM may terminate your membership of the Program at any time and without notice. If AYM cancels your membership you must immediately remove from your website:
- any references to AYM;
- any creative or copy referring to AYM; and
- any links to the AYM website.
Commissions in respect of AYM products will cease to be payable to you following notice of termination. You must repay any such commissions which you receive following notice of termination.
Law and jurisdiction
These terms and conditions are governed by and must be construed in accordance with, English law. You and AYM agree that the courts of England will have exclusive jurisdiction to settle any claim, dispute or matter of difference which may arise out of, or in connection with, these terms and conditions.
