Terms and conditions for use of service

We ask that you take the time to read the terms and conditions for using My Day which are set out below and designed to be easy to understand, fair and reasonable.

Rules for My Day

  • The services are not intended for and should not be used by anyone under the age of 18. You must represent that you are over the age of 18 and the intended recipient to the services at My Day. You may not access or use the service if either of the representations in the proceeding sentence is not true.
  • While you are using My Day, you must follow the rules to ensure a safe and productive planning environment. All authorised users must comply with our acceptable use policy.

Liability

  • If we believe that there is a violation of the contract or user terms that can be remedied by customer's removal, we will, in most cases ask the customer to take action rather than intervene. We may directly step in and take what we determine to be appropriate actions if the customer does not take action or we believe there is credible risk to harm us, the services, authorised users, or any third party.
  • We take no responsibility for your trusted contacts declaring death prematurely.

General provisions

  • Please review our Privacy Policy for more information on how we collect and use data relating to the user and performance of our service.
  • As our business grows, we may make changes to our User Terms and other policies. If we do, we will always provide you with reasonable notice prior to the change taking effect either by emailing the email address associated with your account or by notifying you though the services. If you use the services after the effective date of any changes, that use will constitute your acceptance of the revised terms and conditions.
  • No failure or delay by either party in exercising any right under the User Terms will constitute a waiver of that right. No waiver under User Terms will be effective unless made in writing and signed by an authorised representative of the party being deemed to have granted the waiver.
  • The User Terms will be enforced to the fullest extent permitted under applicable law. If any provision of the User Terms is held by a court of competent jurisdiction to be contrary to law, the provision will be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of the User Terms will remain in effect.

Complaints procedure

  • We really hope that you are happy with our services and that we meet your needs. However, if you have any issues please do let us know.
  • In the first instance please feel free to speak to the relevant member of our team and often we will be able to give you a response straight away. If you feel this is inappropriate or when the matter is more complicated please write to the registered address. All written complaints are logged and the aim is to investigate your complaint and give you a reply within ten working days, setting out how the problem will be dealt with. If this is not possible, an interim response will be made informing you of the action taken to date or being considered.

Terms and conditions for use of the memorial wall (Gold package)

Consent

  • If you are under the age of 18 you must have consent of a parent or guardian to use the memorial wall service. For contributors, if you are not next of kin please ensure you have their authority to create your tribute.
  • If you are using the service on behalf of someone else, before you disclose the personal information of another person you must obtain that person's consent to both the disclosure of their personal information and its use in accordance with the User Terms and privacy policy.

Copyright and material

  • Contributors retain the copyright over all their uploaded content but grant My Day a worldwide, royalty-free and non-exclusive licence in perpetuity to use and reproduce the content. Please make sure that any content you upload does not infringe any other person's copyright. All intellectual property relating to the website is owned by My Day.
  • Any material that may be viewed as offensive or otherwise inappropriate may be removed by administrators or My Day at their sole discretion. This action may include the full removal of a tribute or dedication without notice.
  • Any re-publication of any part of the website including any content is not allowed without express written permission by My Day. Any breach of this by either individuals, companies or any other organisation will be deemed to be a breach of both the spirit of the service and legal copyright and we reserve the right to take action to protect the interests of both My Day, administrators and our users.lease click here to add terms and conditions content
