General Conditions of Participation in the Affiliate Program (the “Program”) of Missoma.com (the “Advertiser”, “we” or “us”)
These are the terms which govern your participation in the Program as a “Partner”. By participating in the Program Partners agree the following terms and conditions: Limitations
- Partners with illegal, political, violent, pornographic and/or illegal content are generally excluded from participating in the Program (final decisions are at the sole discretion of the Advertiser).
In addition, we reserve the right to terminate the cooperation immediately if advertising material provided by us is integrated into this type of website. Possible resulting transactions are also rejected by us and there is no commission request.
- Only Partners who provide a valid imprint on their advertising space are accepted for cooperation.
- Furthermore, websites that are still under construction or produce errors in any form, as well as websites without the possibility of a content check are excluded from participating in the Program.
- Partners of the Program must in any case have full legal capacity and agree to comply with all applicable laws.
Advertising material/ link
- Without exception, the advertising media provided by us fort he Program may only be used on the advertising spaces registered when registering for the Program.
- Without exception, the Partner is only permitted to use assets pre-approved by the Advertiser and provided on the Program dashboard.
- The Partner is responsible for ensuring that the advertising material is up-to-date and undertakes to remove advertising material from its website immediately if it is informed of this by us, or if it has reason to believe that said advertising material may no longer be used.
- A change or expansion of the advertising material provided is not permitted without our prior consent.
- The Partner receives permission via the network to use the advertising material provided for the duration of the cooperation with the Program. If the cooperation is terminated, the advertising material may no longer be used by the Partner.
- Forwarding to the Advertiser’s website is only permitted if a registered Publisher website is visible to the end user. (no direct or nonstop forwarding).
- Contact the Advertiser if you’d like to use the provided assets to create your own advertising media as there may be restrictions
- The use of pop-up sand layers that are delivered when a page is loaded is not permitted.
Product Data
- It is not permitted to use the product data field provided by the Advertiser outside of their own website on third-party platforms such as Google Shopping.
- The Partner ensures that it always uses the latest version of the product data feed offered by the advertiser for its advertising activities.
Browser plugins / advertising via spy/adware
- The combination of advertising material source codes to create plugins for any browser (e.g. hotbars, toolbars) as well as advertising via adware or spyware is not permitted.
Post View / Retargeting
- Cooperation based on Post view or retargeting requires prior agreement with us.
Coupons
- The Partner may only use vouchers that have been approved by the Advertiser for the Program.
- Transactions will be rejected if they were generated via outdated or expired voucher campaigns.
PPC Bidding
- The Partner including any of their sub-network of publishers, is not permitted to undertake any PPC bidding illicitly on the Advertiser’s brand name.
- The Advertiser will not pay any commission on sales generated by such ads. The ads are to be removed immediately by the Partner, and the Partner risks being removed from the Program.
Commissions
- We agree to pay to the Partner the commission of 7% as specified, or where a higher % commission has been agreed, if we sell to a visitor to our site (a "Customer") a product or service that is the subject of the Program and if that Customer has accessed the Advertiser’s site and purchased the product or service via a Qualifying Link.
A "Qualifying Link" is a link from the Partner’s site to the Advertiser’s site using one of the URLS provided by the Advertiser in the Program, on condition that it is the last link to the Advertiser’s site that the Customer uses during a Session where a sale of a product or a service to Customer occurs. A "Session" is the period of time beginning from a Customer's initial contact with our site via a link from the Partner’s site and terminating when the Customer either returns to our site via a link from a site other than the Partner’s site or the Program expires or is terminated.
- We shall have the sole right and responsibility for processing all orders made by Customers.
You acknowledge that all agreements relating to sales to Customers shall be between us and the Customer.
- All determinations of Qualifying Links and whether a commission is payable will be made by Awin and will be final and binding on all parties. Prices for the products will be set solely by the Advertiser in our discretion.
