WAYFAIR UK AFFILIATE PROGRAM TERMS OF AGREEMENT

Please read this Wayfair Affiliate Program Terms of Agreement (the “Agreement”) carefully before you apply to the Wayfair Affiliate Program (the “Program”) or start advertising on behalf of Wayfair.

Definitions:

As used in this Agreement, “we”, “us”, “our”, and “Wayfair” refer to Wayfair Stores Limited and its website wayfair.co.uk.  “You”, “your”, and “Affiliate” refer to the participant in the Program.

Enrollment in the Wayfair Affiliate Program:

  • In your application you have to provide a full and up-to-date list of all the domains/websites in your portfolio that will use your affiliate link.
  • After receiving your application, we will review your website(s) and notify you of your acceptance or rejection into the Program. We reserve the right to reject any application in our sole discretion if we feel any of your sites is unsuitable for the Program. Similarly, we may accept your application, but exclude any of your sites that we feel are unsuitable for the Program. However, we encourage you to contact us to explain your marketing intentions if you feel we have made an incorrect decision.
  • You can only work with us through one affiliate network (you are free in choosing which one).

Unsuitable sites may include, but are not limited to, sites that:

  • Contain content that is not appropriate or relevant to Wayfair and its products
  • Are primarily a link or banner farm that contains little to no content
  • Promote sexually explicit materials, discrimination, illegal activities, violence, or anything similar
  • Do not comply with the Wayfair Affiliate Agreement

By participating in the Program, you agree that you will not engage in any such activities. By participating in the Program, you agree to abide by the terms of this Agreement. If we reject your application, you are welcome to re-apply to the Program at any time. If we accept your application and one of your sites is thereafter determined (in our sole discretion) to be unsuitable for the Program, we may terminate this Agreement and your participation in the Program at any time or exclude any of the sites in your portfolio that we feel are unsuitable for the Program.

Linking to our Website:

Once you have been notified that your site has been accepted into the Program, you may only use tracking links made available to you through our Program (“Tracking Links”). As a participant in the Program you agree to abide by the following:

  1. You will only use Tracking Links obtained from the affiliate interface without manipulation.
  2. All domains that use your affiliate link must be listed in your affiliate profile which must be kept up-to-date at all times.
  3. Your website will not in any way copy, resemble, or mirror the look and feel of any Wayfair website. You will also not use any means to create the impression that your website is our website or a part of our website, including, without limitation, framing or copying of our website in any manner or creating banners or advertisements that mimic our website’s search, display, or social ads in any manner.
  4. You shall not purchase advertisements that direct to your site(s) that utilize Wayfair trademark terms or the Wayfair logo or Wayfair’s proprietary imagery (such as product pictures) without our prior written consent.
  5. Cookie stuffing, pop-ups, false or misleading links are strictly prohibited. In addition, wherever possible, you will not attempt to mask the referring URL information (i.e. the page from which the click originates).
  6. You shall not use redirects to bounce a click off of a domain from which the click did not originate in order to give the appearance that it came from that domain.
  7. Affiliate links may only be placed on (i) sites that You own and manage, (ii) social sharing sites such as Reddit.com, Digg.com, StumbleUpon.com, etc., and (iii) social media platforms such as Facebook, Twitter, Instagram, and SnapChat. Please be mindful of affiliate best practices in marking your posts as sponsored. In particular, you have to adhere to branding restrictions and guidelines. For example, you may not use the Wayfair brand in any way to register accounts on social media or via any other channel. Similarly, Affiliates must never suggest that they represent Wayfair in any way. I.e. they must never speak ‘as’ or ‘for’ the brand, they may only speak ‘about’ or ‘promote’ the brand or our products.
  8. Google Shopping - Comparison Shopping Sites (CSS)/Comparison engines: Any bidding on Wayfair products against Google or Google’s certified CSS Partners (e.g. Productcaster) will not receive any commission. If you wish to run any Google Shopping or other Product Listing Ads (PLA) activity, please contact us first.
  9. You shall accurately represent all Wayfair prices on your websites.

You will earn referral fees only with respect to activity on our site occurring directly through Tracking Links. We will not be liable to you with respect to any failure by you to use Tracking Links, including to the extent that such failure results in any reduction of amounts that would otherwise have been paid to you pursuant to this Agreement.

Store: wayfair.co.uk

You will only earn a commission for sales on the store if the link from your site directed the customer directly to that Wayfair store website. For example: If a customer clicks on your link that drives directly to wayfair.co.uk, You will earn a commission only for a resulting transaction on wayfair.co.uk, and not for any sales on any other Wayfair-operated sites. Similarly, transactions made via mobile apps operated by Wayfair are not eligible for commission.

  • Only sales converting within the cookie window after the affiliate click are eligible for commissions.
  • Only sales of items added to cart after the affiliate click are eligible for commissions.
    • Cashback and Reward Affiliates are exempt from the cart rule and may earn commissions on sales regardless of whether the item(s) were added to the shopping cart before or after the qualifying affiliate click

Promotional Codes:

  • Affiliates may only promote promotional codes that are provided through the Wayfair Affiliate Program, either through the affiliate platform interface or directly from the Wayfair Affiliate Manager.
  • Affiliates must never display false/unauthorized discount or voucher codes on their site(s). Affiliates found to be promoting such false/unauthorized discount or voucher codes face immediate suspension from the Program or even immediate termination and will not receive any commission for the respective affiliate sales.
  • Where promotional codes are issued with an expiry date, this should be clearly displayed, and codes should be removed or explicitly marked as expired after this date, unless you are advised otherwise. Any affiliates displaying expired codes without marking them as being expired may be suspended from the Program.
  • Promotional code terms and conditions must be clearly displayed on the affiliate site. Any affiliate found promoting codes which do not have the clearly marked terms and conditions available may have their commission set to zero until the terms and conditions are visible.

Cashback Guidelines:

  1. ‘Cashback Affiliates’ are affiliates where customers can earn cashback and/or rewards by clicking through the affiliate link to shop on Wayfair. It is up to Wayfair’s sole discretion whether an affiliate actually qualifies as Cashback Affiliate. Please note that a click on a different website during the checkout process might override the cookie, which may result in a non-tracked sale for the affiliate.
  2. For any sales purchased through a cashback site where the sale has either not tracked into a customer’s cashback account (although the customer had accepted cookies) or has tracked through at the wrong amount, customers are entitled to raise a transaction query through the relevant cashback partner within 90 days from the transaction date. Wayfair reserves the right to deny any transaction queries raised after the 90-day period.
  3. Wayfair calculates cashback excluding VAT, delivery and any other charges.
  4. Please note that purchases through our business programme “Wayfair Business” do not qualify to earn cashback.
  5. In the event orders or sub-orders are cancelled or returned, the corresponding value will be deducted from the paid cashback amount.

Commission validation

Wayfair will validate transactions for commission eligibility within 45 days from the date of the transaction.

Affiliates can raise a transaction query within 90 days from the transaction date. Wayfair reserves the right to deny any transaction queries raised after the 90-day period.

We reserve the right to reject all or any transactions that are not eligible for commission as per the Section on Transactions Eligible for Commission in this Agreement and/or are subject to duplicate tracking, disputed charges, Program violations as outlined in this Agreement, and/or for any other reasons related to fraud, misuse, or breach of our terms and conditions.
