EBY (Empowered By You) Program Terms & Conditions
Affiliate Program Overview:
- EBY (Empowered By You) offers an affiliate program through the AWIN Affiliate Network.
- The program is for individuals or entities interested in promoting EBY products.
- The agreement covers terms and conditions for participation, with EBY, LLC and the applicant being the parties involved.
Enrollment Process and Eligibility:
- Interested individuals need to submit a complete program application on the AWIN site.
- EBY evaluates applications and notifies applicants of acceptance or rejection.
- Employees of EBY, LLC and its affiliated entities are ineligible to participate.
- Unsuitable sites, as determined by EBY, include those with explicit content, violence promotion, discrimination, illegal activities, and more.
Agreements Following Acceptance:
- Affiliates agree to use special "tagged" link formats provided by AWIN for accurate tracking.
- EBY processes product orders placed through affiliate links, with AWINtracking sales activity.
- Personal styling or shopping services related to EBY products are not allowed for referral fees.
- Employees of EBY, LLC cannot participate in the program.
Referral Fees and Payment:
- Referral fees are paid on qualifying purchases resulting from special links. Payments will not be paid out on consumer returns.
- Fees are calculated as a percentage of qualifying revenues and paid monthly.
- Purchases made through affiliate links, excluding gift cards, are eligible for referral fees.
Policies and Restrictions:
- PPC campaigns are strictly forbidden by any search engine.
- Affiliates MUST NOT register/buy or use domains that users may believe are part of EBY
- Affiliates may not create websites that may impersonate the EBY website.
- Affiliates must adhere to EBY's policies and pricing for customer orders and services.
- Use of EBY Marks is allowed within specified guidelines.
- Affiliates must not disclose sales information to third parties without EBY's approval.
Term, Termination, and Modifications:
- The agreement lasts from acceptance until termination by either party.
- Termination may occur at any time with or without cause, and affiliates generating fewer than 50 click-throughs or one sale per month may be removed.
- EBY reserves the right to modify terms and conditions, with changes becoming effective upon posting.
Other Provisions:
- The agreement clarifies the relationship between parties, limits liability, and provides disclaimers.
- Affiliates must not use media releases to publicize their relationship with EBY.
- The governing law is the United States and the State of New York.
- AWIN required provisions are included, and affiliates indemnify AWIN in case of disputes
