Programme T&Cs
As part of Ambassador Cruise Line affiliate programme, you are bound to the following agreement in which “we”, “us” and “our” refer to Ambassador Cruise Line and “you”, “your” and “yours” refers to the affiliate.
- The purpose of this Program is to promote the sale of products offered on our Website (the “Purpose”). To begin the enrolment process, you will submit a complete Program application. We will evaluate your application and notify you of your acceptance or rejection. We may reject your application for any reason at our sole discretion. We reserve the right to cancel any new or existing affiliate partnerships if we determine your site is unsuitable for our program, including if it:
- Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;
- Promote illegal activities or are intended to harass or defame anyone;
- Promotes violence or sexually explicit materials
- Incorporates materials which infringe copyright, trademark or otherwise violate our intellectual property rights or the intellectual property rights of others.
- Includes “Ambassador Cruise Line” or variations or misspellings in its domain name
- Contains software that enables diversion of commission from other affiliates
- Resembles the Ambassador Cruise Line website in a way that may mislead customers
If we accept your application, we reserve the right to terminate your participation in the Program for any reason in our sole discretion immediately without prior notice.
2. Affiliates are permitted to use the Ambassador Cruise Line brand and marketing resources available in this Programme. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials.
Affiliates must use banner creatives and tracking codes provided by Ambassador Cruise Line in order for us to accurately track customer data and commissions. Ambassador Cruise Line reserves the right to review creative placement at any time and approve the use of links. Ambassador Cruise Line may require existing placements to be changed or removed.
It is your responsibility to ensure you have express permission to use any copyrighted material (whether it be writing, imagery, video or sound). We are not responsible if you use copyrighted material or other intellectual property in violation or the law or any third party rights.
The Affiliate will never imply that they are acting on behalf of Ambassador Cruise Line and will never advertise Ambassador Cruise Line products directly. The Affiliate will never bid for advertisements that compete with Ambassador Cruise Line.
The Affiliate will never represent themselves, Ambassador Cruise Line or their relationship with Ambassador Cruise Line in a false or misleading way.
The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing Ambassador Cruise Line.
3. We have the right to monitor your site at any time to determine if you are following the terms and conditions of this agreement. We may notify you of any changes to you site which we recommend and supply appropriate links to our website.
Ambassador Cruise Line reserves the right to terminate this agreement and your participation in the Ambassador Cruise Line affiliate programme without notice should fraudulent or abusive behaviour be detected. If such fraud or abuse is detected, Ambassador Cruise Line shall not be liable for any commission on fraudulent sales.
This agreement will begin upon our acceptance of your affiliate application and will continue unless terminated. Ambassador Cruise Line may end this agreement at any time with or without cause by giving the other party written notice in the form of mail or email.
4. Ambassador Cruise Line may modify any of the terms and conditions in this agreement at any time at our sole discretion. In such event, you will be notified by email. Modifications may include, but are not limited to, changes in the payment procedures and commission levels. Your continued participation in the Ambassador Cruise Line affiliate programme following the posting of the change notice will indicate your agreement to the changes.
5. Ambassador Cruise Line use the affiliate network Affiliate Window to handle all tracking and payment. Please review the network terms and conditions for agreements relating to payments.
For a sale to generate a commission to an Affiliate, the customer must complete the order within the 30 day cookie window and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links or unique affiliate discount codes. Affiliate Promotional code usage is not valid on festive events and cannot be used over Ambassador’s Black Friday promotional period. The code cannot be combined with other promotion codes or onboard future cruise offers. Properly coded links are the sole responsibility of the affiliate.
6. Ambassador Cruise Line will not be liable to you with respect to any subject matter of this agreement under any contact, negligence, tort, strict liability or other legal or equitable theory for any indirect, incidental, consequential, special or exemplary damages.
7. All confidential information, including, but not limited to, any business, technical, financial and customer information, disclosed during the effective term if this agreement will remain the sole property of the disclosing party and each party will keep in confidence and not use or disclose such proprietary information of the other party without express written permission.
8. You agree you are an independent contractor and nothing in this agreement will create any partnership, joint venture, agency, franchise or employment relationship between you and Ambassador Cruise Line.
9. You may not amend or waive any provision of this agreement unless in writing and signed by both parties. The agreement represents the entire agreement between you and Ambassador Cruise Line and shall supersede all prior agreements and communications, oral or written.
10. If any provision of this agreement is held to be invalid or unenforceable, that provision shall be eliminated or limited to the minimum extent necessary such that the intent of the parties is effectuated and the remainder of this agreement shall have full force and effect.
11. By Promoting Ambassador Cruise Line Affiliates, you accept our terms and conditions, including but not limited to, the keyword bidding policy. Ambassador Cruise Line Affiliates reserve the right to remove sales and commissions from any affiliate found in breach of this policy.
12. Commission is only paid on cruises booked directly with Ambassador Cruise Line and not by our partners (e.g. Travel Agencies, Tour Operators etc)
13. The promotional codes cannot be combined with other charity/member/association/media or affiliate promotion codes or onboard future cruise offers. They may only be combined with an Ambassador Campaign Promotional code advertised on the Ambassador website.
14. The promotional codes are not valid on Ambassador’s Festive Events, selected charters and cannot be used over Ambassador’s Black Friday promotional period.
15. The promotional codes can only be used for new bookings only made directly on Ambassador’s website or through our call centre, it cannot be used for bookings made through travel agents or other third parties.
This Agreement shall be governed, construed, and enforced in accordance with the laws of the United Kingdom and shall be subject to the non-exclusive jurisdiction of English Law.
