1. Commission Fees
a) Who Gives A Crap’s publisher affiliates earn a standard commission rate (which is agreed upon prior to joining) for all qualified sales on new customer orders (which means a purchase by a customer that has not previously made any order of Who Gives A Crap products, excluding any wholesale order)
b) We reserve the right to reverse commissions due to returns, order cancellations and erroneous order duplications. We also reserve the right to defer or refuse commissions for disputed orders or orders we reject and cannot fulfil.
2. Compliance
a) All affiliates must comply with all federal, state and local regulations within your jurisdiction. This includes applicable governing marketing emails (ie CAN-SPAM Act), and all other anti-spam laws.
b) Who Gives A Crap reserves the right to suspend or remove affiliates from our affiliate program at any time, without warning. Upon termination you agree to discontinue use of all links, logos, banners and promotional materials provided to you by Who Gives A Crap or our affiliate network. Affiliates terminated due to malicious publishing tactics will also have commissions revoked and face possible omission from our affiliate network.
c) Who Gives A Crap reserves the right to revoke any links from the program at any time, without warning.
3. We may reject your application at our sole discretion. We may cancel your application, or terminate your inclusion in our program at any time, if we determine that your site is unsuitable for our program, including if it:
a) Promotes sexually explicit materials
b) Promotes violence
c) Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
d) Promotes illegal activities
e) Is contrary to our values as a company
f) Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law
g) Includes "Merchant", “Who Gives A Crap” , “WGAC” or variations or misspellings thereof in its domain name
h) Is otherwise in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable to us in our sole discretion
i) Contains software downloads that potentially enable diversions of commission from other affiliates in our program
j) Competes with Who Gives A Crap on paid advertisements or search terms
k) Incorporates incorrect or misleading information about Who Gives A Crap or its products.
4. You may not create or design your website or any other website that you operate, explicitly or implied in a manner which resembles our website nor design your website in a manner which leads customers to believe you are Who Gives A Crap or any other affiliated business.
5. Who Gives A Crap reserves the right, at any time, to review your placement and approve the use of your links and require that you change the placement or use to comply with the guidelines provided to you. You agree that you are only able to use the affiliate link on your website, newsletter and social channels that you own and are related to the website you applied to the program with.
6. You must obtain prior written approval from Who Gives A Crap if you wish to use the Who Gives A Crap logo and/or product shots. Who Gives A Crap may provide any conditions on use of the logo and/or product shots at it sees fit and may refuse approval in its sole discretion.
7. It is entirely your responsibility to follow all applicable intellectual property and other laws that pertain to your site. You must have express permission to use any person's copyrighted material, whether it be a writing, an image, or any other copyrightable work. We will not be responsible (and you will be solely responsible) if you use another person's copyrighted material or other intellectual property in violation of the law or any third party rights.
8. You agree to indemnify Who Gives A Crap against any loss that Who Gives A Crap suffers for your breach of these terms.
9. Commission terms
Commissions will be paid once a month. For an Affiliate to receive a commission, the referred order cannot be returned or cancelled and mid-checkout conversions are not applicable for commission.
You cannot refer yourself, and you will not receive a commission on your own accounts. There is also a limit of one commission per new referral. If someone clicks the link on your site and places multiple orders, then you will receive a commission on the first order only. Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out. Commissions are not applicable for wholesale orders. Any type of programmatic activity or activity that involves selling or buying ad inventory to or from publishers through a bidding system using Who Gives A Crap affiliate links is prohibited. Who Gives A Crap has the right to reverse any and all commissions from all affiliates involved in such practices.
