Kure Bazaar

These Terms and Conditions (“Agreement”) govern participation in the Kure Bazaar Affiliate Program (“Program”) operated via the Awin affiliate network. By applying to or participating in the Program, you (“Affiliate”) agree to be bound by the terms of this Agreement, in addition to the Awin Master Network Agreement.

1. Program Overview

Kure Bazaar is a luxury clean beauty brand based in Paris, France, offering non-toxic, eco-conscious nail care and color products. This Program is designed to reward partners who promote our products in accordance with our brand values and guidelines.

2. Eligibility and Approval

Kure Bazaar reserves the right to accept or reject any application at its sole discretion. Applicants must operate a legitimate website, blog, or social media presence with content that aligns with the clean beauty, wellness, luxury, or fashion sectors.

Affiliates are prohibited from:

• - Operating in violation of any applicable law or regulation;
• - Operating websites that contain offensive, defamatory, pornographic, or unlawful content;
• - Representing competing nail brands that may cause confusion or brand dilution.

Affiliates may be deactivated at any time, with or without cause, at the discretion of Kure Bazaar.

3. Commission Structure

Commission terms (percentage, cookie duration, and payout frequency) are detailed within the Awin platform and may be amended from time to time with notice.

Commissions are tracked and disbursed exclusively through Awin, subject to standard validation, attribution, and fraud prevention protocols.

Kure Bazaar retains the right to void or adjust commissions in the event of:

• - Cancellations, returns, or chargebacks;
• - Suspected fraudulent activity;
• - Violations of this Agreement.

4. Prohibited Marketing Practices

The following practices are strictly prohibited and will result in immediate suspension or termination from the Program:

• - PPC Bidding: Affiliates may not bid on brand keywords, including but not limited to: Kure Bazaar, KureBazaar, kurebazaar.com, or any variants, misspellings, or brand + generic combinations.
• - Direct Linking: No direct linking to the brand domain via paid ads.
• - Trademark Plus Bidding: Bidding on phrases like “Kure Bazaar discount,” “Kure Bazaar coupon,” or similar combinations is not permitted.
• - Email Marketing: Use of Kure Bazaar’s name or likeness in unsolicited emails or newsletters without express prior approval is prohibited.
• - Domain Ownership: Affiliates may not register domains containing the Kure Bazaar trademark or any misspellings thereof.
• - Coupon and Deal Sites: Affiliates using coupon or cashback models must obtain prior written approval via Awin.

5. Brand Guidelines

Affiliates must adhere to Kure Bazaar’s brand positioning as a premium, non-toxic, clean beauty brand founded in France. Any deviation, misrepresentation, or dilution of brand values may result in termination.

Do not:

• Promote Kure Bazaar alongside low-cost, drugstore, or mass-market nail polish brands;
• Alter product names, logos, or packaging;
• Misstate product features, formulations, or certifications;
• Use unapproved creative assets or make unsubstantiated health claims.

Only materials provided via Awin or expressly approved in writing may be used.

6. Compliance with Laws and Disclosure

Affiliates are solely responsible for ensuring compliance with all applicable laws, regulations, and advertising guidelines, including (but not limited to) the FTC Endorsement Guidelines, GDPR, and any local consumer protection laws.

Disclosure of affiliate relationships must be clear and conspicuous (e.g., #ad, #sponsored, #affiliate).

7. Intellectual Property

All rights, titles, and interests in and to the Kure Bazaar trademarks, logos, product images, and content remain the exclusive property of Kure Bazaar. Use of such intellectual property is permitted solely for the purpose of promoting the brand in accordance with these Terms.

8. Termination

Kure Bazaar may terminate or suspend an affiliate’s participation in the Program at any time, with or without cause, by deactivating the affiliate account on Awin.

Upon termination:

• The affiliate shall immediately cease use of all Kure Bazaar intellectual property and promotional materials.
• Any pending commissions may be withheld or canceled in cases of fraud or violation of the Agreement.

9. Modifications

Kure Bazaar reserves the right to modify, amend, or update these Terms & Conditions at any time. Continued participation in the Program constitutes acceptance of the revised terms.

10. Limitation of Liability

Kure Bazaar shall not be liable for indirect, incidental, punitive, or consequential damages, or any loss of revenue, profits, or data, arising in connection with the Program or this Agreement.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

12. Communication

All affiliate communications, including requests for custom assets, changes, or clarifications, must be routed exclusively through Awin’s internal messaging system. Direct outreach outside of Awin is not permitted.
