This Agreement describes the terms and conditions for participation in the Relaxe Massage Chair Website Affiliate Program. The terms "Affiliate," "you," and "your" are referring to you, the applicant. "We," "our," "us" refer to the Relaxe Massage Chair Website. We are independent parties and this agreement will not form any partnership.
AGREEMENT DURATION:
This agreement will begin upon our acceptance of your affiliate application and will end when terminated by either party.
TERMINATION:
Either party has the right to terminate the agreement immediately without prior notice. If the Affiliate breaches the agreement or any provision hereof, or if the Affiliate is found to be promoting our products in a manner that is not consistent with the terms of this agreement, the Affiliate's participation in the program will be terminated.
AFFILIATE OBLIGATIONS:
Promotion Methods: Affiliates may use banner advertisements, button links, text links, and other links as provided by us for the purpose of the Program. The use of any other promotional material not provided or approved by us may result in the immediate termination of this agreement.
Valid Referrals: Only users who make a purchase through the Affiliate's referral link and remain customers for at least 90 days will be considered valid referrals.
Compliance: Affiliates must comply with all applicable laws, rules, and regulations in their marketing activities.
Misrepresentation: Affiliates must not misrepresent our products/services or mislead potential customers in any way.
Spam: The use of unsolicited email or any other form of spam to promote our products is strictly prohibited.
Keyword Bidding: Affiliates are not allowed to bid on our brand name, product names, or any variations or misspellings thereof on any pay-per-click search engines.
PAYMENT:
Affiliates will receive a commission for sending authorized sales via links provided by us. The current commission rates will be posted on the ShareASale platform. We reserve the right to change commission rates at any time without notice.
LIMITATION OF LIABILITY:
We will not be liable for any indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this agreement or the affiliate program, even if we have been advised of the possibility of such damages.
DISCLAIMERS:
We make no express or implied warranties or representations with respect to the affiliate program or any products sold through the program.
GOVERNING LAW:
This agreement will be governed by and construed in accordance with the laws of the country/state in which the Massage Chair Website is established.
ShareASale Terms of Use:
All affiliates are also bound by the ShareASale Terms of Use. Any breach of those terms will be grounds for immediate termination from our program.
MODIFICATION:
We may modify any of the terms and conditions within this agreement at any time and at our sole discretion. Affiliates will be notified of any changes and will be bound by the modified agreement once it's posted on our website.
By signing up for the Relaxe Affiliate Program, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.
