Program Terms

Kennedy Blue Affiliate Terms & Conditions

Please read our affiliate terms and conditions carefully before you join our program or begin marketing of our program. These terms and conditions are written in plain terms intentionally avoiding legalese to ensure that they may be clearly understood and followed by affiliates. Adherence to the terms and conditions provides that our Kennedy Blue affiliate program is sustainable and profitable for both Kennedy Blue and our affiliates.

DEFINITIONS
As used in the below Terms: (i) “We”, “us”, or “our” refers to Kennedy Blue; (ii) “you” or “your” refers to the Affiliate; (iii) “our website” refers to the Kennedy Blue website located at KennedyBlue.com; (iv) “your website” refers to any websites that you will link to our website; (v) “Program” refers to the Kennedy Blue Affiliate Program.

COMMISSIONS
Advanced commission rules (conversion lines) are in place. Last-click attribution is no longer the sole method of deciding which affiliate earns the commission. Affiliate models such as traditional coupon-focused, loyalty/cashback and shopping cart abandonment are subject to commission splitting or commission elimination when closing on influencer (content-focused) transactions. These end-of-funnel models receive less than default commission. If you have questions about your commission, ask the affiliate management team.


COUPON GUIDELINES
If you are enrolled in our Program and your Website promotes coupon codes, you must adhere to our Coupon Guidelines as follows:

1. You may ONLY advertise coupon codes that are provided to you through the affiliate program or network.
2. You may NOT advertise coupon codes obtained from our non-affiliate advertising, customer e-mails, paid search, or retargeting, cart abandonment any other campaign.
3. Violation of these terms may result in removal from the Kennedy Blue affiliate program, reversal of sales, or reduction in commissions.
4. No commission will be given on sales where a customer uses restricted coupon codes.
5. We reserve the right to reverse transactions due to order cancellations, duplicate tracking, existing customer orders, returns, credit card fraud, disputed charges or violations of this agreement.
6. Affiliates are not permitted to use misleading text, images or links that imply any deal that is not expressly authorized through the affiliate channel. Use of exclusive coupon codes by unauthorized affiliates will result in voided transactions. User-submitted coupon codes from other marketing channels such as email are prohibited from use by affiliates.
7. Sub-affiliate transactions without referring URLs are subject to voids. We must know who is promoting our products and where the traffic is coming from. Coupon, loyalty and paid search affiliates are prohibited from using sub-affiliate networks to promote Kennedy Blue.

Only use logos, banners and images provided through the ShareASale interface. Contact the affiliate management team before using any images from the merchant website or social media.

PPC GUIDELINES
If you are enrolled in our Program and participate in PPC advertising, you must adhere to our PPC guidelines as follows:

1. You may not bid on any of our trademarked terms, including any variations or misspellings thereof for search or content based campaigns on Google, Bing, Yahoo or any other network. These trademark terms Kennedy Blue brand (or related trademark and brand names), KennedyBlue.com TERMS, and similar terms.
2. You may not use our trademark terms in sequence with any other keyword (e.g “Kennedy Blue Coupons”).
3. You may not direct link to our website from any Pay-Per-Click ad or use redirects that yield the same result. Affiliates must be directed to an actual page on your website.
4. You may not use our URL (KennedyBlue.com) as your Display URL, however use as a subfolder or subdomain (i.e. http://www.yoursite.com/KennedyBlue or http://KennedyBlue.yoursite.com) is permissible.

If you automate your PPC campaigns, the responsibility is yours to exclude our trademark terms from your program and we strongly suggest you add our trademarked terms as negative keywords. If you violate these PPC guidelines your current and past commission will be set to 0% without warning.

DOMAIN NAMES
Use of any of our trademarked terms or misspellings as part of the domain for your website is strictly prohibited. (e.g. KennedyBlue-trademark.com or KennedyBlue-coupons.com as examples).

SOCIAL MEDIA
Affiliates are not permitted to use TM, TM+terms or any variation or misspelling to create pages or accounts on Facebook/Youtube/Twitter/Reddit/Instagram etc., including but not limited to Kennedy Blue, Kennedy Blue coupons, Kennedy Blue reviews, Kennedy Blue, KennedyBlue without express written permission.

FTC COMPLIANCE

Please note that the FTC guides and resources are only intended to provide guidance. They do not purport to provide legal advice and they do not guarantee that you will be in compliance with FTC regulations if you follow the suggestions presented. You are advised to seek and obtain your own legal advice on how these rules apply to your website or other promotional activities for which you receive compensation.

You are required by Kennedy Blue to disclose your affiliate relationship on any promotion for them. This includes but is not limited to blog posts, videos, emails, social media and website pages. Your audience must understand you could earn commissions if they click your links. This disclosure statement should be clear and concise, stating that Kennedy Blue is compensating you for your review or endorsement. If you received the product for free or at a discounted price from Kennedy Blue for review, this also must be clearly stated in your disclosure.

Guidelines our Affiliate Management Team will be looking for in audits for compliance are:

Disclosures must be made as close as possible to the claims.
Disclosures should be placed above the fold; scrolling should not be necessary to find the disclosure. (e.g. Disclosure should be visible before the jump).
For Image-centric platforms, such as Pinterest, Instagram Stories, Snapchat, etc., #ad should be on the image or the first image in a series. On video platforms, such as YouTube, verbal disclosure within the video as well as text disclosure in the description is sufficient.

Pop-up disclosures are prohibited.
Social media posts must include proper disclosure which may include hashtags such as #ad, #advertisement and #sponsored. Hashtags such as #sp, #spon, #affiliate or #aff are NOT acceptable. Forms such as Ad, (Ad), //Ad// are acceptable on Facebook, as is natural language disclosure, if it's clear and concise. Eg: This post does contain an affiliate link, which means if you purchase after clicking the link I may receive compensation.

ADVERTISING & PUBLICITY
You shall not create, publish, distribute, or print any written material that makes reference to our Program without first submitting such material to us and receiving our prior written consent. You are not permitted to create advertising campaigns, or accounts that represent yourself as Kennedy Blue or as an agent of Kennedy Blue. If you intend to promote our Program via e-mail campaigns, you must adhere to the following:
1. Abide by the CAN-SPAM Act of 2003 (Public Law No. 108-187) with respect to our Program.
2. E-mail must be sent on your behalf and must not imply that the e-mail is being sent on behalf of Kennedy Blue.
3. E-mails must first be submitted to us for approval prior to being sent.
